<p>The investigational vaccine was tested by researchers in the Netherlands, who examined the drug’s effect on 10 patients and determined that it induced an immune system response to mesothelioma tumors. <p>The investigational vaccine takes antigen from a mesothelioma patient’s tumors and infuses it into the patient’s own dentritic cells, which are a type of immune system cell. Researchers say that they hope to be able to increase survival time in patients with mesothelioma, and eventually would like to develop a full vaccine for people who have are at risk of developing mesothelioma due to asbestos exposure.</p>
<p>Asbestos was widely used in a variety of manufacturing and construction applications throughout the last century, with use peaking in 1973. Most uses of asbestos were banned in the United States in the mid-1980s. <p>The case was filed by Jayne Menssen, claiming that Penumo Abex LLC and Honeywell International Inc., as well as companies they evolved from, knew about the dangers of asbestos exposure, but failed to issue warnings or take precautions to protect employees.  Menssen worked as a secretary from 1967 to 1969 at Union Asbestos and Rubber Co., which later became known as Unacro Industries Inc. </p>

<p>After a four week trial and a day of deliberations, a McLean County jury returned an award in Menssen&#8217;s case on February 8, according to a report in <a href="http://www.pantagraph.com/news/local/article_7ca47388-1529-11df-b12d-001cc4c002e0.html" target="_blank">The Pantagraph</a>.  The verdict included $3.5 million in compensatory damages against both the defendants, but the jury also leveled punitive damages of $4.37 million against Pneumo Abex and $10 million against Honeywell.</p>
<p>A jury assesses punitive damages against a defendant when it can be determined that the defendant acted in bad faith, either by specifically misleading or deceiving a plaintiff, intentionally doing harm, or by clearly knowing that their actions could lead to harm but performing those actions anyway. Punitive damages awards are rare in any lawsuit, but particularly rare in asbestos litigation, since in many cases the defendant&#8217;s actions occurred decades before the issue came to trial.</p>

			<content:encoded><![CDATA[<p>A Baltimore jury has awarded about $10 million in a <a href="http://www.aboutlawsuits.com/mesothelioma-618/">Maryland mesothelioma lawsuit</a> filed on behalf of a man who developed a rare form of cancer as a result of exposure to asbestos when he was a young child.  The asbestos was allegedly carried home by his father when he worked as an engineman on an oil tanker more than 30 years ago.  <span id="more-8352"></span></p>
<p>The verdict was handed down at the end of last month in the Baltimore City Circuit Court on behalf of Leroy Conway, Jr., 45, who sued Baltimore-based ATTRANSCO, who employed Conway&#8217;s father  between 1974 and 1977. While working in an environment where he would become covered with asbestos dust and asbestos particles, Conway&#8217;s father carried asbestos home in his hair and clothes.  </p>
<p>Leroy Conway, Jr. alleged that he developed <a href="http://www.youhavealawyer.com/blog/2009/03/24/second-hand-asbestos-exposure/">mesothelioma from second hand asbestos exposure</a> when he was about 10 years old.</p>
<p><a href="http://www.youhavealawyer.com/personal-injury/asbestos-mesothelioma.html">Mesothelioma</a> is found in the lining of the chest and lung. The only known cause of mesothelioma is asbestos exposure, and it is often not diagnosed for 20 to 40 years after exposure. <p>During trial, the former captain of the ship on which Conway&#8217;s father worked testified that ATTRANSCO and the crew of the ship knew there was asbestos exposure, but that the company was unaware of the dangers.</p>
<p>The jury disagreed, swayed by evidence brought by the plaintiff that showed the Occupational Safety and Health Administration (OSHA) began regulating and warning about asbestos exposure as early as 1971, and that asbestos side effects had been documented by industry since the 1940s.</p>
<p>Conway has already had a lung removed due to the illness, and can no longer work. The jury awarded him $9.6 million for pain and suffering, and $636,000 for medical expenses in the Baltimore mesothelioma lawsuit.</p>

<p>The <a href="http://www.aboutlawsuits.com/topics/asbestos/">asbestos lawsuit</a> was brought by Robert Cox against Lorillard, which manufactured Kent cigarettes. Cox was diagnosed with mesothelioma in 2008 and claimed that Lorillard designed a defective cigarette due to the inclusion of the asbestos filters, and failed to warn users of asbestos health risks.</p>
<p>After an eight-week trial, the Los Angeles County Superior Court jury concluded on January 19, that Lorillard was not liable and did not have to warn Cox about the risks associated with asbestos filters.  According to a report by <a href="http://www.law.com/jsp/article.jsp?id=1202439424880&#038;rss=newswire" target="_blank">The Recorder</a>, the decision was based on expert witness testimony regarding the prevalence of asbestos use in the 1950s and what was believed, at the time, regarding its safety. The defense was banned from presenting evidence that demonstrated the amount of asbestos that could enter the lungs from use of the filters.</p>
<p>Lorillard has successfully defended itself over the use of the asbestos cigarette filters in six lawsuits filed since 2000.</p>

According to a <a href="http://www.businesswire.com/portal/site/home/permalink/?ndmViewId=news_view&#038;newsId=20091221005186&#038;newsLang=en" target="_blank">press release</a> issued by the asbestos attorneys representing the families, Crane Co. settled before the damage award was returned and Garlock subsequently settled while the jury was hearing evidence about their individual liability for the award.</p>

<p>Although Garlock initially maintained that it could not be proven that their gaskets caused mesothelioma for the two men, the company settled after the court permitted the jury to see documents where Garlock admitted that their gaskets could cause mesothelioma, according to a press release issued by Baron &#038; Budd, P.C.  The attorneys indicate that it was shown that the gaskets contained 75 to 90% asbestos.</p>

			<content:encoded><![CDATA[<p>A former paper mill worker and his wife have been awarded $10.2 million in a <a href="http://www.aboutlawsuits.com/topics/mesothelioma/">mesothelioma lawsuit</a> in Washington over <a href="http://www.youhavealawyer.com/personal-injury/asbestos-exposure-mesothelioma.html">exposure to asbestos fibers</a> from dryer fabrics during his nearly 40 year career.  <span id="more-7189"></span></p>
<p>A Seattle jury awarded the damages to Henry and Geraldine Barbin last month in a lawsuit filed against Scapa Dryer Fabrics, Inc. and AstenJohnson Inc.  Both companies are former manufacturers of asbestos-laden dryer fabrics used on paper machines where Henry Barbin worked as a laborer between 1964 and 2001.</p>
<p>The Barabin’s asbestos lawsuit alleged that the asbestos dryer fabrics were defectively designed and failed to include warnings about the dangers of asbestos exposure.  After working as a pulp tester, paper tester and in other paper mill positions, Henry Barabin was diagnosed with mesothelioma cancer in 2006.</p>
<p>Henry Barabin was awarded $700,000 for medical expenses, lost income and household services and $8 million in non-economic damages for pain and suffering.  His wife was awarded another $1.5 million for her loss of consortium claim.</p>
<p><a href="http://www.aboutlawsuits.com/mesothelioma-618/">Mesothelioma</a> is a rare form of cancer found in the lining of the chest and lung. The only known cause of mesothelioma is asbestos exposure, and it is often not diagnosed for 20 to 40 years after exposure. As a result of the long latency period, the cancer is very advanced when it is diagnosed and life expectancy with the disease is limited.</p>
<p>Asbestos was widely used in a variety of manufacturing and construction applications throughout the last century, with use peaking in 1973. Most uses of asbestos were banned in the mid-1980s.</p>
<p>Although paper mill workers are often not listed among groups that are most at-risk for asbestos exposure, a French study of about 163,000 paper mill workers who worked in the industry for less than a year between 1945 and 1996 found that 36% of them had been exposed to asbestos. The study found that the rate of mesothelioma deaths was three times higher among paper mill workers who had been exposed to asbestos than for those who had not.</p>

			<content:encoded><![CDATA[<p>A boilermaker who contracted <a href="http://www.youhavealawyer.com/personal-injury/asbestos-exposure-mesothelioma.html">mesothelioma from asbestos exposure</a> has reached a $3 million settlement with several companies that he alleged were responsible for his exposure to the toxic substance during his 35-year career.  <span id="more-7106"></span></p>
<p>The <a href="http://www.aboutlawsuits.com/topics/new-york/">New York asbestos lawsuit</a>  was filed by Earl W. Tredinnick III, who was diagnosed the rare mesothelioma cancer last year, after working as a boilermaker between 1967 and 2002. </p>
<p>The $3 million settlement was reached earlier this month, after the jury was selected, but prior to opening statements.  According to a <a href="http://www.prweb.com/releases/2009/11/prweb3221544.htm" target="_blank">statement</a> released by the mesothelioma lawyers representing Tredinnick, the names of the settling parties and the amounts contributed by each were withheld under the terms of the settlement.</p>
<p><a href="http://www.youhavealawyer.com/personal-injury/asbestos-mesothelioma.html">Mesothelioma</a> is a rare form of cancer that attacks the lungs and chest lining. It is caused by asbestos exposure, usually resulting from inhaling or consuming asbestos fibers used in industrial processes. As a result of a long latency period of between 20 and 40 years between exposure to asbestos and diagnosis, the cancer is often at a very advanced stage by the time it is discovered and prognosis is poor.</p>
<p>Asbestos was widely used in a variety of manufacturing and construction applications throughout the last century. Use peaked in 1973, before the toxic substance was banned in 1982. Despite the ban, the U.S. Centers for Disease Control and Prevention says the number of mesothelioma deaths continues to rise each year due to the latency period, with the number expected to peak in 2010.</p>
<p>Tredinnick, 61, worked as a Local 7 Union Boilermaker at sites including Niagara Mohawk’s Huntley and Dunkirk steam stations, Ashland Oil, Hooker Chemical, Bethlehem Steel and DuPont in Niagara Falls.</p>
<p><a href="http://www.aboutlawsuits.com/mesothelioma-618/">Mesothelioma for boilermakers</a> is a higher risk than among many other professions, as they regularly work on pipes and insulated machinery that used asbestos. They also often had to grind down asbestos products, such as insulation blocks and asbestos paper. Much of their work can include grinding objects to fit correctly and installing and uninstalling machinery that can put high amounts of asbestos dust in the air around them.</p>

<p>So far this year, 61 out of 104 workers who died of work-related causes in the French-Canadian province have died of an asbestos illness, the board reports.  Across Canada, <a href="http://www.aboutlawsuits.com/mesothelioma-618/">deaths from asbestos-related mesothelioma cancer</a> overall have increased 67% over the last 15 years, even though Canada has stopped using asbestos as a building material decades ago.</p>
<p>Quebec has a “zero tolerance” policy for asbestos exposure, which has been connected to a number of lung-related illnesses. However, both the province and the country have come under sharp criticism both internally and externally because Canada exports 175,000 metric tons a year of a form of asbestos known as chrysotile. The substance is shipped primarily to poor countries, and Quebec has the country’s only asbestos mine.</p>
<p>Asbestos use was banned in Canada in the late 1970s, however it still can be found in many old buildings and homes. <a href="http://www.youhavealawyer.com/personal-injury/asbestos-exposure-mesothelioma.html">Exposure to asbestos</a> is known to cause a number of ailments, including <a href="http://www.youhavealawyer.com/personal-injury/asbestos-mesothelioma.html">mesothelioma and asbestosis</a>, as well as other diseases. Second-hand asbestos exposure is also a known danger, as employees who work around asbestos can bring fibers home on their clothes and in their hair, which family members unknowingly inhale or consume.</p>
<p>According to a report released by the U.S. Centers for Disease Control and Prevention (CDC) earlier this year, the number of <a href="http://www.aboutlawsuits.com/asbestos-deaths-from-mesothelioma-still-on-rise-3655/">malignant mesothelioma deaths from asbestos exposure in the United States</a> also continues to increase each year. As a result of the long latency period of between 20 and 40 years between exposure to asbestos and diagnosis, the number of asbestos deaths is expected to peak in the next few years and to hopefully return to background levels by 2055.</p>
<p>The British government’s Health and Safety Executive (HSE) estimates that about 4,000 people in the United Kingdom <a href="http://www.aboutlawsuits.com/asbestos-exposure-in-uk-campaign-6804/">die from asbestos illness</a> every year, which equates to about 20 people every week.  Although stringent regulations were placed on the use of asbestos in the U.K. in 1983, the number of deaths from asbestos exposure are expected to continue to increase in the country, peaking by 2020.</p>

<p>The decision affirms a verdict returned in March 2008 by a Superior Court jury in San Francisco in favor of Joan and Daniel Mahoney.  The <a href="http://www.aboutlawsuits.com/topics/california/">California asbestos lawsuit</a> resulted in a finding that Georgia Pacific Corp. was 30% responsible for John Mahoney’s development of mesothelioma, and the company was ordered to pay $6,289,544 of a $20 million verdict after adjusting for Georgia Pacific’s percentage of fault, settlements made by other defendants prior to trial and a stipulated amount of medical damages.</p>
<p>Mahoney alleged that she contracted <a href="http://www.youhavealawyer.com/personal-injury/asbestos-exposure-mesothelioma.html">mesothelioma due to asbestos exposure</a> from products that included an asbestos compound made by Georgia Pacific to fill cracks in sheetrock.  At trial, evidence was presented to establish that Georgia Pacific was aware of the dangers posed by exposure to asbestos, and continued to make the compound until the federal government banned asbestos in the late 1970s.</p>
<p>Joan Mahoney is a former actress and singer who toured several times with the USO, according to a report in the <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2008/03/12/BADMVINSN.DTL" target="_blank">San Francisco Chronicle</a> at the time of the jury award. From the 1970s to the 1990s, she and her husband ran a home remodeling business. In August 2006, she was diagnosed with mesothelioma cancer. She had been the caretaker of her husband, who had suffered a stroke that left him paralyzed and unable to speak. As a result of the debilitating effects of her cancer, Joan Mahoney had to place her husband in a nursing home to ensure he got proper care.</p>
