Lap-Band Problems Lead to Government Subpoena of Allergan

Medical device manufacturer Allergan has been subpoenaed by the U.S. government regarding problems with its Lap-Band weight loss device, which has been linked to a high rate of complications and a number of deaths.

The subpoena was issued earlier this month by the Department of Health and Human Services Inspector General (DHHS-IG), according to a recent filing by Allergan. However, neither the device manufacturer nor the DHHS-IG’s office have released details surrounding the exact information requested.

In January, some members of congress began calling for hearings on the Lap-Band and other medical devices that now appear to be more dangerous than regulators initially thought when they were first approved.

In a letter (PDF) sent to their Republican colleagues at the beginning of this year, several Democratic lawmarkers urged the House Energy and Commerce Committee to look into activities of Allergan and other manufacturers of dangerous products, seeking records regarding the safety and design of the Lap-Band and transvaginal surgical mesh products, which have also been linked to a number of serious problems..

The Lap-Band, or laparoscopic adjustable gastric banding, is a band placed around the upper part of the stomach that creates a small pouch which quickly fills with food. The band causes the person to feel full quickly, which may result in weight loss. However, the Lap-Band is linked to a number of complications, including erosion of the band through the stomach wall, the band moving out of position, nausea, vomiting, difficulty swallowing, gastroesophageal reflux disease (GERD), abdominal pain, and leaking of the gastric band. In addition, recipients must change their eating habits, as they are unable to eat large meals and must eat a series of smaller meals throughout the day for the rest of their lives or until they have the band removed.

Recent studies have suggested that 40% of patients implanted with Allergan’s weight loss device may suffer serious complications and problems following Lap-Band procedures.  In addition, the FDA raised concerns in December that many clinics were not fully disclosing the risks associated with Lap-Band procedures in direct-to-consumer advertisements.

I had very few complications, my band was too tight and had to have some fluid removed in 2014. I gained some or most of my weight back after being malnutrition , there was excruciating pain sometimes when I ate I threw up a lot. Then in 2023 I was hospitalized for a collapsed lung a hole in my diaphragm I had bowel obstruction, my intestins were twisted , and I had a hiatal hernia. I woke up from a dead sleep around 4 am screaming with abdominal pain chest pain couldn't get any relief my brother called 911, and was taken by ambulance to the nearest hospital . There they discovered my lap band had eroded into my stomach wall. And had been that way for years. The surgeon repaired my hernia , and patched up my diaphragm and lung. I was released 4 days later with no restrictions and his advisory to contact a bariatric surgeon to have the band cut out. He told me the band had busted inside my body causing the hole in my diaphragm and forcing my organs to overlap and suvear damage no fixing the device it was mandatory that it was removed asap. I went home and made arrangements to see a surgeon but I never was able to make it to my appointment. So a few months later I ended up back in the hospital again with the same issues except I was transfered to temple hospital were a specialist could help me. I was hospitalized for 3 weeks and couldn't use my stomach at all they removed the band and repaired 2 holes In my stomach so I was fed through a pick line until my stomach had healed . So my question is would this be a malpractice case or could I sue allergian For the damages and pain and suffering that this band had caused . at home seems to think I've got a case from all the damages this thing has caused , I have permanent damage to my lung and diaphragm, chronic pain and stomach problems going to the bathroom , and eating . I'm lost in my situation any advice would help. My advice to u out there hard work dedication and loving yourself is more efficient. Exercise has slow results , but sometimes greatness takes patience.

I had the band removed in 2016, and now 7 years later, I'm suffering from a hiatal hernia, and throw up phlegm all night long most nights. I CANNOT eat or drink anything after 7p.m., at all, and if I drink even a glass of water, I belch and cough until I throw it up. I take 4 medications a day to rid my stomach of acid build up, which backs into my esophagus. My life changed drastically since this procedure, and i sincerely wish I had'nt had it done

I now read the life of the band is 7 to 10 years yet mine is 13 years old. I feel awful all the time. I can't work. I need another surgery. I am now 13 years older with less perfect health. I will not get into all the pain and my difficulties as others probably have posted here. Just to say the problems are numerous and painful and life changing, not in a good way. My problems are similar to everyone else's band problems. I am now facing removal that is very scary, after reading what some people have had to endure with that procedure. They think I may need a bipass because of GERD and the injuries the band caused my esphagus. I never wanted a bipass. I got the lap band to avoid the bipass for a safer procedure. I was told this procedure could be reversed without any problem. So now here comes probably 2 more surgeries. This band is horror. It ruins lives. Get this thing off the market so it won't destroy more lives and hold this company responsible for their uncaring, unethical treatment of people and their greed. Thank you!

I had gastric lap band surgery on 5/12/2010. My surgeon said that there could be problems once he got in there that he may not get the sleeve. Not only was he unable to do the sleeve but because the band and port had so much scar tissue it caused a hiatal hernia that was so enflamed that repair instruments could not go in the area. The band, line, and port were finally removed. However, the port had a mesh sling and staples which made removal even more difficult. I was told by the surgeon who did that (band) surgery that if I wanted to keep my weight down I should not have band removed unless there was slippage or worse. Recently I have researched the status of this since my 2010 surgery and experts have been saying the band should not be kept after 12 years due to complications. It was almost 9 1/2 years for me. My question is what would have happened if I had waited another two or three more years? I feel I am due some compensation for the money I paid out of my pocket to have the Sleeve down and because the band created so many issues I now have to pay out more.

The glowing year go worse it started getting harder and harder to get anything to go down I to my stomach to the point I couldn’t swallow liquids. Early in spring I started feeling exhausted all the time I went to my family doctor and found out I was anemic and had to start taking iron. By early summer I was so weak and couldn’t eat or drink so I called the doctor that did the lapband Iwent i. And they removed some liquids and was better for about a day went back and removed some more I drank some wate but could tell it wasn’t right so they removed all the liquids I went home with some relief but by that night it was back to no liquids going down. They scheduled an upper GI and the technician said some liquid seemed to be going through I came home and got a a call from the doctor he told me lapband has eroded into my stomach ( I guesse now we know why I needed iron pills ) and I would need to have it removed ASAP after waiting for insurance approval and scheduling survey about 2 weeks late with still no food and living off of ice pops my surgery came. After removal I had to stay I hospital for 4 days I ran a fever had to have magnesium over and potassium In an IV and ran a fever They sent me home with a hole in my stomach that had to be cleaned out and repacked every day. That was slow going it took about 2 and a half months to close up. A year later I still have some problems with foos getting hung on scar tissue I guesse and now I have problems with my food not digesting I get terribly sick but can’t trrow up haven’t been able to throw up since 2014 when I had the band implanted. Let me tell you it’s painful to be sick and not throw up but go through th motions anyway I have an appointment to see the doctor soon. I pray there isn’t some permanent damage that I have to live with th wrest of my life

He removed the band and port in July 2017. Since then, I had to have emergency gallbladder removal for a severely inflamed and infected organ. Now, I am experiencing excruciating pain and discomfort, along with nausea and belching, at the exact location of where the band was placed - the base of my esophagus/top of stomach. I am calling the surgeon's office today to see if I can schedule an endoscopy to see if the interior walls, of my esophagus, are damaged. On the morning of the initial surgical placement of this device, the surgeon brought me in an internal scope picture which displays the positioning of the band and the name of the device - Allergan. Now, I am extremely worried that my body is telling me that something is horribly wrong.

Fast forward, 2015. Not sleeping at night because of acid issues. If I laid down the acid would come up & asperate into my lungs, so I slept sitting up. However I couldn't go to the Dr. I had the procedure with, because he wouldn't accept my new insurance. So I hunted & hunted and finally found a Dr. that accepted my insurance, and switched over as quickly as I could. Sure enough we found out that I had esophageal dilation. It was so severe that it was as small as a toothpick. The Dr. immediately removed all the fluid, and my life has somewhat gotten back to normal. However my life has been turned upside down, as I went from 308 down 152 (at my lowest), now back up to 270+. It's not right that these possible complications, and side effects are so minimalized. As it is I will have to have my band removed completely as I am struggling with acid reflux again, and I was told by the Dr. that I would have to if the reflux came back. Someone needs to start a class action lawsuit, if so I will join! I have paperwork about my esophageal dilation. The rest of the information can be found! I am with you if this goes anywhere.

My surgeon has done an EGD scope and determined that the band needs to be removed because it has irrigated in through my stomach wall. Now, my current health insurance has said that there is an exclusion and they do not want to allow me to use my insurance for the removal surgery. I am almost debilitated by this pain and sick feeling. I can not work until I get the band removed and the hole in my stomach repaired. I originally lost 35 pounds toward my 100 pound goal before I lost my insurance and could not maintain it any further. I have since regained the weight. But, right now, that is not my priority! I need to be able to work, to function, and it is not possible. I really do not want to end up septic and die just because of this decision that I made to better myself.

I followed instructions given for after care, and realized that the Lap Band was a Tool used to assist with weight loss, develop healthier eating habits. My hopes were also to improve my health. Weight lost max was 25-30lbs. I have not had a fill in 1 1/2 years, now regained the weight previously lose. A couple of years ago the FDA was looking into the complications caused by the lap Bands, but I have not found an attorney willing to start the Class Action Lawsuit. I would be willing to participate. Also it may help if more cases are filed with the FDA (www/fda.gov).

I made an apt before it got out of hand to get an adjustment and it didn't work- no restriction, got another adjustment- still no restrictions, then called the Dr back and advised them that the adjustments they gave me are not working at all. They first said that I must have done something to either cause band slippage or stomach erosion. I told them no I have not done anything different since recovery from surgery. They did a fluoroscopy which they could tell no band slippage (I didn't over eat) and they were able to see that my band was leaking. this was around 2013. then they scheduled me to have a revision- the dr took it out and was going to put another one in at the same time, and that band was defective (leaking) they took it back out and tried to put in another one, then the Dr broke it. Needless to say, after paying my co-pays, deductibles for the 2nd time, I went home with no band. Then the dr tells me at my follow up visit that placing another band would be almost impossible due to scare tissue. After telling me after surgery that they would put another one in after I heal. since then the dr's have been trying to talk me in to another type of gastric weightloss surgery (sleeve, gastric bypass) which have a even more danger to them. Now they want me to pay again to have another surgery- uh no... I don't feel I should have had to pay for the 2nd one when I didn't do anything wrong to break it or cause it to malfunction. And like others above, I researched my band before I got it and everything I read and was told, said this would be long term. There has been nothing saying that it would not work over any specific period of time. The maker of the device should have to pay for any surgeries caused from a malfunctioning device. removal etc. At no time did any of my gastric dr's tell me that there was a recall on the devices. I'm wondering now if they reported it to get reimbursed and then still charged me as well??? I'm now researching what my options are now, as my health has declined because of a device that was defective.

I did this because I had tried everything from programs and meds and exercise and diet but nothing helps when the band is not working correctly because I stay with easy foods that go down with the band. This is not a way to live. I hope this goes further I took much time deciding what procedure to have. Now I am wondering if it was a right decision with all the problems I am having. I'm not the only one in the family having trouble. When my stepfather saw how well my band was helping he decided to have surgery and was very successful. But know he too is having trouble and seeks help from a different physician and is now having a second surgery to take band out and have the sleeve done. I don't understand how this can happen. We trusted the information given to us and now we are seeking help because that information was not complete. Sign me up I would like to be a part of this.

I had several blood transfusions and another doctor was called in to help. My spleen was saved and I went home the next morning. Four days later I passed out my blood pressure dropped I was white as a ghost and sweating. I was rushed to the Emergency hospital and immediately was tended to. I was given more blood and had several tests done. I spent the night in ICU. I was horribly sick. I was given three CT scans, MRI, and several other tests in the next three days. My spleen was leaking blood into my stomach, I had pneumonia, and if needed I would have to have my spleen removed. I found out the doctor who was supposed to do my lap band surgery let his Intern do it. He is the one who cut open my spleen and I do not know why my appendix was also removed. I was never told they removed my appendix nor was it listed on my records. Yet there were surgical staples in place of my appendix and no appendix. I have a scar two inches above my hip bone. Instead of the five small incisions I had seven. I lost my job, health and life insurance and my husband is now living in a different room. I didn't ask for this and I feel that the doctor lied by with holding this information from me. I would never have consented to have an Intern do my surgery and why the removal of my appendix? I am positive if another doctor had performed my surgery this would not have happened. My immune system has been greatly compromised and so far I have had every sickness passing around. My question is do I have a chance for a lawsuit?

I am so frustrated and depressed about all the problems i have had with this band and I am scared to even look into having it removed because I have heard that having it removed is more dangerous than having it put in not to mention the expense which I am sure I would have to pay Another thing i havent seen anyone mention dental problems since the band My dentist told me all the procedure I have had which is in the thousands of dollars are directly related to throwing up on a regular basis. I am so disgusted by this thing and I feel like I was totally duped when I agreed to having this procedure.

I lost about 145 lbs in a year but had to be rushed to the hospital because I started passing out. My potassium and electrolyte levels were extremely low and and EKG showed abnormalities in my heart rhythms. An xray showed that my band had slipped and my stomach looked like Hiroshima. I was rushed in for emergency band removal. Since the removal, I have shamefully gained most of the weight back. Also, I don't feel like the psych pre eval was thorough enough. I never suffered from an eati g disorder prior to the band, but after getting sick all the time with the band, I now find myself with bulimia tendencies in order to control weight. I'm not saying the band is the cause, however I question the possibility of it. I never purges before the band. If a class action suit were to be filed, I would like to know and be signed up as a patient who had adverse results from the band.

Forget about eating meat, pasta, scrambled eggs not to mention other foods because I end up puking...and yes I thoroughly eat the meat and whatever and the small meals but I still get horribly sick. Talk about pain? I have had constant pain since my band was placed & I think the port has actually moved out of place. My lifestyle has been sooooo restricted. Forget about going out to eat because I'm afraid I'll get sick, which I have by the way. I have regained my initial weight which I really didn't lose much of anyway since I only had 2 fills. What bothers me the most is that my dear surgeon failed to tell me that my band (Allergan) was recalled & that there was a lawsuit. Am I joining the lawsuit? You betcha and I plan on going after the surgeon as well. It is a doctor's medical oath to look out for their patients and he failed miserably. I urge everyone of you that have problems to go after your surgeon as well. When you pay over $13 grand out of pocket for something like this someone needs to be held accountable.

If we go out to eat, after two bites, I'm in the restroom throwing up, I always bring my food home and feed it to my son, or try to eat it over the next several days, or usually end up throwing it away. About 2 months ago, I was admitted to the hospital after going for a little over a week and couldn't keep anything down, no food, no water nothing! They first thought my band had eroded into my stomach, luckily it had not. I was severly dehydrated and my chemical levels were totally out of whack...they wanted me to make an appointment with my surgeon, since no other surgeon wants to touch a patient with a lab band... I made an appointment with my lab band surgeon and he removed some fluid and I was able to eat, and drink... He left the fluid out for about two months...So of course, that means I started gaining my weight back..I think I gained in all about 7 pounds back, I have gone back to him, and he has put more fluid back in...so I guess we'll see what happens now.

I have been miserable the entire time since my band placement in 2008. There have been very few good days...and many many days of throwing up and hurting. However, I do not run to the doctor every time I have a problem because I don't want him to think I am nuts....Should there be a class action lawsuit, and I cannot imagine that it won't be, I am 100% in.

I wore Billy bags for several months, stints replaced up to 1 year.  I never returned to my lapband dr. I had 2 fills and that was it. After i had my gallbladder removed i did not get another fill. I was disscourged from not feeling good afterwards and simply because my dr.who performed my surgery was/is unprofessional and could care less. Everything i told him he said was completely normal. Nope, I've heard now countless horrible stories from patients who are experiencing the hidden side to lapband complications or the severity of the complications. I've had stomach issues off and on since I had my band in 2009.  Just recently it's progressively gotten worse. I chalked it off as a few stomach bugs. Not the case I'm realizing.   Bloating is a constant, there's constant pressure in the lower abdominal area, above my naval, i have fullness when I barely eat ( ex.few bites of egg salad) sick to my stomach,  most of the time I'm not even hungry, other times I just dread eating because of the extreme fullness. Extreme discomfort is constant and pain at times. I weighed 240 pre band. Then on my own no fills at this point 145. Losing again but I'm sick and not wanting or needing to lose weight. Again I only had 2 fills that was in 2009-2010. Just wanted to know if any of this sounds like what you experienced?  I'm miserable and worried sick!  Will this pass, I'm wondering who I should see about it?  I do not want to go see the dr. Who put my band in.... Also I'll add prior to me feeling this way I could eat what I wanted and not feel sick or full, salad, 3 pieces of pizza,  in one meal.  Thank you so much for your time

My band ended up 75% into my stomach and required open abdominal surgery for removal of the band, repair of my stomach and clean-out of the foul infectious substances in my body. My Dr. later told my husband that had it been much longer for the problem to be found, I would have DIED. And yes, I did ask what would happen if the band caused problems, and was assured that the same out patient procedure would be used to take it out as had been used to put it in. Not the nearly two months stay in the hospital that I endured. If you must have WLS, get the sleeve, get the gastric bypass, but don't have a surgery that leaves a large piece of foreign material in your body.

I had to have open heart surgery to repair and clean the heart valve. While recuperating at home from that surgery I started vomiting profusely. Another trip to the ER and another hospitalization revealed my stomach was twisted. I was just told yesterday, July 11th, that I need another surgery to repair my stomach. I was told that I am literally starving to death. I was told I would not survive another surgery and would need to wait at least a year before this surgeon would operate. I am now facing being on a feeding tube until my body heals enough for surgery.

I have attempted to have it filled 3 times, each time ending up in the ER the next day to have a specialist be called to remove the saline because as soon as I fall asleep...fluid regurgitates out of my nostrils, it burns and taste like something died in my esophagus. I have left shoulder pain frequently no matter how much or how little I eat, also, the band has moved several times, my belly button changes shape and I can palpate the band way down where it is not supposed to be. Im going to have it taken out as soon as my insurance is effective...I am also planning to file a lawsuit. I DO NOT RECOMMEND THIS PROCEDURE TO ANYONE!

Since the surgery my health has diminished I went from working a full time job and raising 2 boys to being on disability and 1 son moving in with his dad because I was not able to take him to sports and such. I have just had my band removed 10/19/12. It took that long to find another Dr that would agree to do it since they did not put it in not to mention I have been having numerous other surgeries and just not had time to fit this surgery in. I still have severe left shoulder pain and nausea and right now having lots of abd pain and pain where my port was but I hope this improveswith time.
