Fresenius Dialysis Treatment Lawsuit Overview

The Fresenius dialysis litigation centered on allegations that the companyโ€™s widely used dialysis products, GranuFlo and NaturaLyte, caused sudden cardiac arrest and death among patients undergoing treatment.

Manufactured by Fresenius Medical Care, the products were designed to help manage acid levels in the blood, but they contained ingredients that could lead to dangerously high bicarbonate levels if not properly administered. Thousands of patients and families claimed that Fresenius failed to warn clinics and healthcare providers about these risks, despite having internal data showing elevated rates of cardiac complications.

Concerns intensified after a 2012 internal memo surfaced indicating that Fresenius had known for months that improper use of its dialysis concentrates was contributing to a spike in patient deaths. The company was accused of alerting its own dialysis centers while withholding the same safety warnings from competing facilities that also used its products. In response, the U.S. Food and Drug Administration issued a Class I recallโ€”the agencyโ€™s most serious levelโ€”highlighting the potential for fatal outcomes.

The lawsuits were consolidated into multidistrict litigation (MDL No. 2428) in the District of Massachusetts, where plaintiffs pursued claims of negligence, failure to warn, and wrongful death. Fresenius ultimately agreed to a $250 million settlement in 2016 to resolve thousands of cases.

I lost my grandfather in 2005 from this drug. He raised me as if I was his own. I was a high school student who had never lose anyone close to me before. This was a very traumatic experience for me, it still hurts as though it happened just a day ago. 11 years later and I can finally get some type of closure. No there is no amount of money that bring him back, however I can use the money to do things such as purchase him a tombstone. We are all hurting whether its $1 or $100,000 it is still a dollar more than what we currently have. There’s no need to lose to a love one and some money.

Accept the settlement, it’s really no use in going after more money, God will be the one to lay judgement on them. We live in terrible times where people and companies with money can get away with this on earth but not on judgement day. My father was killed by their Granuflo. Frank one case don’t make the deal. They just continue with the MDL . If one the cases gets big money, that’s what they are trying to avoid. Johnson & Johnson has to pay over 5 Billion in the Talcum Powder lawsuit. So if you want to jump ship you might as well.

No amount of $$ is going to bring our loved ones back. The amount has been stated $250M and of that $220M will be divided. Every case is separate. If 97% does not agree than the chance of receiving nothing is real. We are all angry which i agree to but again this is a legal process and the settlement amount has been set. Again if 97% does not agree you are looking at receiving nothing especially since the first case presented was awarded nothing. There are too many people involved to think about one’s self and not others. A lot of individuals on here have families to take care of and bills to pay as this has been in litigation for over 3 years.

My attorney stated that the settlement will be based on the years the patient suffered and how long the product has been used. my mom passed in 2010 and my offer is 500,000.00 after lawyers fees!! My dad died within 15 minutes of this treatment. April 13 2011. He always told me they were doing more harm than good. Several times before passing he was life lined to hospital due to treatments on previous days. He suffered for a long time.

I am a Dialysis patient for one and one half years now. I dialyze at Fresenius of Coram NY. I started here in oct 2015. Since that date, I have been sent to the hospital with massive headaches 3 times. Also, I am suddenly developing rhemutoid arthritis in my hands and other joints, very painful. In the last 3 weeks, in the last hour of dialysis, (I only do two and a half hours) I am getting pains in the center of my chest. I getting very afraid I may develop a heart attack. After having read all of your posts and now I’m really scared. I’m asking for the names of the chemistry used tomorrow and I think I need to move to another unit. Thank you everyone for this information and I’m so sorry for your losses of your loved ones. Your posts may save other lives and may have saved mine.

I agree with Ck, 250k is not enough to share with 19,000 families. Theirs no price you can put on our love ones life. Not to mention they LAWYERS DON’T even know who has lawsuits or not but they knew when we hired them. They think this is a game but God is in control. My heart aches for all of us who have been victimized by Fresenius. Thier neglegence & greed have damaged our lives beyond repair. I still grieve for my mom who died during treatment in 2011 & will never stop. She was in dialysis for 4-5 yrs & i will never forget how she suffered & realize only now that the meds meant to CLEAN her blood was actually POISONING it!! Wish we knew then what we know now, i know her last yrs would have been more full of life! At 44 i was pushed into the being the head of a large family my siblings and I still have not recovered jobs were lost, houses, and lives destroyed… Because there was no warnings i watched my mother slowly die and fall asleep too never wake up… And what so sad its coming up on her four year death anniversity and this Jones family still hasn’t woke up and neither has the Granuflo company

My father had a stroke because of this product and because Randy did not warn us of this product we continue to keep him on dialysis when trying to recuperate from the stroke all the while his fighting was in vain The product that gave him the stroke was been continuously pumped into his system as he was trying to recuperate from the stroke because he needed dialysis HAD they warned us that this product was bad we would’ve taken him off the product and let him recuperate from the stroke on his own because we didn’t have the option to do that my father died I won’t go away granuflo

My God all these so lay on my heart. My sisters and I lost our 51 year mommie 2/09; eleven days after her birthday. She transition while doing dialysis! No amount of money can bring her back. my father had a fatal heart attack 2 hours after his 2nd dialysis treatment. this happened in march 2009. it tore our family apart which is still true today. I agree that nobody is talking about this lawsuit. if the numbers are true and there are over 6000 complaints then something needs to be done and this company needs to stand up and take responsibility for a product that killed people.

It is now the year of 2016 and there hasn’t been any compensation yet. My mother passed away July 2012 and I still don’t have answers.. Justice shall be served although no money could amount to my moms life. My Mom suffered from this medication she developed congestive heart failure she was all I had I was all she had she passed away May 7 2014 this medication caused her to be in and out of the hospital with breathing problems we are unaware of medication that’s being pumped into us we can only trust in our doctors and the diagnosis and medication giving to us my mom was a very sweet lady!!!!!!…I miss her so much no money can bring her back but I hope and pray that they are held responsible for this deadly drug!!!!

My father also passed away after 4 days of his first and only dialysis treatment. Anyone who has lost a loved one the pain never leaves. this leaves a lingering guilt and feeling of mistrust towards the medical system. It leaves you frozen in disbelief and feeling you should have looked at what dialysis items the nurses were using. I will always feel mental anguish. It was like i watched my father have a lethal injection on death row for a crime he never committed. He was a kind, trusting and good elderly man and he did not deserve this and neither did I. I am an only child and will always hold this ache in my heart for my father dying in this terrible manner. I have a lawyer.

I feel for everyones loss in the a forementioned comments. I too lost someone dear to me My Father. He was on Dialysis for 3 years . He was regressing physically everyday . His Doctor told me he would have more vigor. Instead he passed on the same day of a treatment. I hope something good comes out of these class action suits.

John, I lost my husband, my whole world was destroyed and the lives of my children from these murders.. This has went on for far too long as of now the first bellwether trials begin on Jan 11,2016 & again in February. I myself feel this has went on for far too long and they need to take responsibility for their actions, they took from us and it’s time they pay for all the lives they have destroyed !!!

Why can we not find any updated information on this Class A lawsuit? It’s now August 2015, and the most recent updates on the case are from December 2014, and even they don’t reveal much information. Am curious when this case might go to some kind of trial, and what outcomes victims can (hopefully) expect, and when might they receive some kind of compensation?

I think these people are murders for profit, they should be held accountable they’re no different than the cartels…I personally am on dialysis and had my doctor tell me he would give a negative review to the board if I wanted to get a transplant,what gives him the right to play god with my life,because I’m not living to his so called standers,or maybe there’s just no money in the cure…im ready to get unchained from this machine. I don’t live for dialysis I use dialisys to live.
