Lawsuit Over Mielle Organics Hair Loss Rolled Into Multi-Plaintiff Class Action

The consolidated Mielle Organics Hair Oil class action lawsuit seeks to pursue damages on behalf of all individuals who purchased the product, regardless of whether they suffered hair loss.

In recent weeks, at least three women have filed Mielle Organics Hair Oil class action lawsuits, claiming that the products do not work as advertised, and ingredients in them can cause users to lose their hair.

However, all three plaintiffs refiled their class action claims as one multi-plaintiff complaint (PDF) in the U.S. District Court for the Northern District of Illinois on December 12, naming Mielle Organics LLC and The Procter & Gamble Company as defendants. The plaintiffs include Stephanie Williams, Krista Gillette and Georgina Gomes.

Mielle Organics Rosemary Mint Scalp & Strengthening Hair Oil is marketed as a cosmetic product that is beneficial for hair growth, by strengthening hair strands and nourishing the scalp. However, the lawsuits over Mielle Organics hair loss claim that the manufacturers knew or should have known about problems with certain ingredients in the products, yet failed to adequately disclose the risk.

While all three women involved in this new Mielle Organics lawsuit indicate that they experienced hair loss after using the hair oil products, they are seeking class action status to pursue damages on behalf of all consumers who paid a premium price for hair oil that may cause them to actually lose hair.

“No reasonable consumer would have paid any amount for cosmetic Products that contained ingredients causing hair loss and other injuries or containing a high risk of causing hair loss or other injuries,” the consolidated complaint states. “Thus, if Plaintiffs and Class Members had been informed that Defendants’ Products contained ingredients causing hair loss and other injuries or risked causing hair loss or other injuries, they would not have purchased or used the Products at all, or would have paid significantly less for the Products, making such omitted facts material to them.”

The plaintiffs specifically indicate they suffered hair loss due to the use of Mielle Organics Rosemary Mint Scalp & Strengthening Hair Oil, Mielle Organics Rosemary Mint Strengthening Conditioner, Mielle Organics Rosemary Mint Strengthening Conditioner, and Mielle Organics Rosemary Mint Strengthening Shampoo.

In addition to hair loss, they claim these products can cause blisters and sores on the scalp and are not fit to be sold on the market to unsuspecting consumers.

The consolidated Mielle Organics hair loss class action presents claims of fraud, unjust enrichment, violation of state consumer fraud acts, and seeks compensatory, statutory and punitive damages against the manufacturers.
