SoClean Class Action Lawsuit Filed Over Health Risks From CPAP Sanitizing Products

A class action lawsuit has been filed over potential SoClean health risks, alleging that popular devices used to clean and sanitize CPAP, BiPAP and mechanical ventilation machines release ozone gasses at dangerously high levels.

The complaint (PDF) was filed by Anthony Sakalarios on September 3 in the U.S. District Court for the Southern District of Mississippi, indicating false and misleading claims have been made about the SoClean 2 CPAP Sanitizing Machine, SoClean 2 Go CPAP Sanitizing machine and related products sold in recent years.

SoClean devices work by generating ozone to sterilize and deodorize CPAP breathing machines, which are used to treat sleep apnea. However, the SoClean lawsuit notes that to be effective at sanitizing the devices, the devices must emit levels of ozone that are higher than can be safely tolerated by humans or animals.

Sakalarios indicates he, and other similarly situated owners the SoClean machines, were misled by false advertising, which claimed the devices used “activated oxygen,” instead of telling consumers that it releases dangerous levels of ozone that exceed acceptable federal safety standards. In the company’s advertisements, it never mentions the use of ozone, and in some cases denies the devices are emitting ozone when asked directly, according to the complaint.

In fact, the advertisements claim the devices release no “harsh chemicals” at all, and Sakalarios’ lawsuit maintains that ozone released by SoClean machines is, in fact, considered a harsh chemical.

“The foregoing false claims deceive consumers into believing that the SoClean devices do not generate ozone, do not release ozone into the atmosphere, and are safe, healthy, and suitable for use in consumer’s bedrooms,” the lawsuit states. “SoClean’s falsehoods have allowed it to command a ninety-percent share of the market for CPAP sanitizing/sterilization devices.”

In late February, the FDA issued safety communication, indicating patients and healthcare professionals should not use what the agency considers illegally marketed ozone gas or ultraviolet (UV) light cleaning devices to disinfect or sanitize CPAP machines. The warning came following nearly a dozen reports of patients suffering respiratory complications.

Individuals reportedly experienced coughing, difficulty breathing, nasal irritation, headaches and asthma attacks after using these types of devices.

Just a few months later, in June, a massive Philips CPAP machine recall was issued, following the discovery that a polyester-based polyurethane (PE-PUR) sound abatement foam inside the machines may degrade and release toxic particles directly into the air pathways.

Philips has suggested that use of SoClean and other similar cleaning devices involving ozone and UV light may exacerbate the foam’s degradation, which could worsen respiratory side effects for CPAP machine users.

The company now faces a mounting number of CPAP machine lawsuits and class action claims, indicating that users have been diagnosed with cancer, severe respiratory problems and other health complications.

Sakalarios’ lawsuit seeks class action certification for citizens of Mississippi who purchased SoClean devices to clean and sanitize their CPAP, BiPAP or mechanical ventilation breathing machines. He presents claims of breach of warranty, fraudulent misrepresentation, fraud by omission, negligent misrepresentation, unjust enrichment, failure to warn, and calls for the manufacturer to provide medical monitoring for the devices’ users.

I have been using the SoClean since about 2013 or 2014! That can likely be confirmed with the serial # on my machine. I got it soon after thry came out because it was sibeasy to use. I have developed a persistsnt productive cough, sometimes irritated nose as well. I have many photos of the crap I’ve been coughing up! I just found out about the issues with SoClean. They never contacted me or gave any warning of the potential health issues. And also found that mt CPAP machine ResMed does not cover damages caused by the SoClean machine. Now I am very worried about health effects & potential cancer. I if course have stopped using the SoClean machine 2 weeks ago.

I purchased a SoClean2 in 2018 and have since been bothered with runny nose, chronic headaches, and dry eye. The VA recently warned me that this could be caused by the Ozone created by cartridge filter. The VA actually does not recommend using the SoClean2 or any product that creates Ozone. I am just falling on this page as I was searching on how to clean the soclean. I wake up in the middle of the night and mornings with a very runny nose and eyes. I guess I will clean my cpap machine really good and not use the soclean going forward especially after reading these other comments.

I purchased my SoClean 2.5 years ago. I used it daily. It always had a strong ozone smell from residual gas trapped in the mask and hose. About 8 months ago I was looking at prelims for knee surgery. I mentioned I was having some slight chest and jaw pain. My doctor ordered EKG’s, sonograms, and lower, heart and carotid flow sans and an upper MRI. I have been scheduled to see a cardiologist in January. After reading several articles , I believe the excessive ozone may have contributed. I have ceased all use and will not use or recommend this product. I use a ResMed CPAP, and have for over 20 years without issue If it helps I will participate.

I have been using the soclean 2 for about 3years. On my brithday in 2019 I was diagnosed with Amyloid Osis that is destroying my liver, kidneys and heart. I used So clean with my recalled Dreamstation cpap for appx 1.5 years I have been chronically ill I have liver damage have developed Asthma and many other health problems I did not know about ozone. There has always been a very noxious smell while running device.

I have been using a So Clean device for years every day and I have a RESMED AirSense 10 machine since ( New 2014) and was replaced under warranty in 04/2018 due to what looked liked black spots floating in water tank. Then in 04/2021 same thing happed and machine wasn’t covered under warranty and I had it repaired at my expense. I just found out about the So Clean can be causing the issues I have been battling with respiratory issues which they don’t know what’s been causing them. I am disconnecting my So Clean device today as well as my wife’s, she hasn’t been on CPAP or So Clean as long as I have been.

I have used a SoClean machine for about a year now with my Phillips Station. I have always noticed a very strange smell when using the SoClean machine. The documentation they sent with the machine said a strange odor was normal when you first started using the machine, but that it would go away. It never went away. I’ve also noticed that my allergy symptoms (coughing, sneezing, nasal pressure, stuffy nasal passage, etc. ) have become greatly exacerbated for a while now. And it seems that this does coincide with when I started using the SoClean.

I have been using a call machine for many years, with out the so clean as well as with the so clean machine. I have developed a great deal of difficult breathing which no one seems to be able to diagnose. I am tired all the time and have very little energy. This has changed my life for the worst. My doctor told me not to use the so clean machine but I had problems before I used to so clean,but the so machine seems to have made it worse. Can you help me?

Ok the main issue is not the SoClean. Phillips recalled their machines because they found the defect in their system. They have not found “ANY” defects with the SoClean or any IR products. My machine is a ResMed MyAir and I have been using this for years with my SoClean 1. Phillips and this lawyer are trying to scare people away from a working product when their own products don’t work. Think about it and reread the article.

I purchased the so clean 3 and woke up to the so clean 3 being on and cleaning while I was wearing the mask. I took it off and unplugged it but I had a coughing fit for ten minutes, felt very nauseous and my throat hurts and it is hard to breathe. Why would the machine turn on while I was using the cpap.

Been using a cpap since 2000 and this respronics dream station for over 3 years with the SoCLean machine. For awhile now, I have been experiencing SOB, migraines, diarrhea, dizziness, extreme fatigue, coughing, memory loss, joint pain and aches, stomach issues and irritably. My doctors don’t know what is happening and have more testing done. I have contacted several lawyers but none of them but to help unless in have cancer, kidney disease or lung Issues.

I have been using the cleaner for several years as well. After reading this and all the comments I am stopping immediately. Packing it up tonight. I often have a scratchy throat, wonder if the SoClean is the culprit? I also smell the ozone. I hate the smell. When I was working it would run while I was at work so I never smelled it. Now that I am working from home because of Covid I smell it. I have developed bad back pain and tight hamstrings. Wonder if any connection. I will have to go back to cleaning my CPAP the old fashion way. Please add me to the suit. By the way, my machine has whined on occasion. I changed the chamber and that helped.

There has been a decline in my lung function since I started using the So Clean. For a while I had noticed the strange smell, but believed the So Clean had been FDA approved and was safe for use. Although, I already had a respiratory problem and visited my pulmonologist on a regular basis, my condition worsened, and as I stated above, my lung function declined. I started using the SO Clean in 2019 and continued using it to September 2021. I would be happy to be a part of the Class Action Suit because I do believe this So Clean can be/was hazardous to one’s health.

I spoke to Soclean today and they wanted to know if my respiratory condition of chronic inflammation and congestion, if I had informed my doctor. My reply was I trusted you, the manufacture, the claims of using safe Ozone would sterilize all my equipment but rather you’re asking what soap I use to clean my mask, if I cleaned my hose and if my machine was a Phillips. OMG! I used exactly as per directions. I use a safe soap (Dawn) and I regularly clean my hose and mask. They were looking for anyway to blame me. I am now going to have a discussion with my doctor about my respiratory issues that don’t have a found cause. My doctor asked if I cleaned my hose and mask and if I used my APAP machine every night and to which I said yes but never thought to add I have a Soclean. My respritologist advised I stop using Soclean immediately when I picked up my new ResMed machine. I too was advised not to use Soclean and stop using it for health concerns and was advised it is illegally on the market as a safe cleaner for CPAP equipment as the FDA or here in Canada, Safety Standards were never consulted on health and recommends that high use of Ozone equipment not approved does propose serious health risks. I am now seeking to join a class action law suit.

My husband and I bought the So Clean2 plus an extra filter 9 months ago. Even though it isn’t on our nightstand (because we both use it), I’ve had this dry cough and it feels like something is stick in my throat and I can’t get it out. Sometimes I wake up with a horrible headache. I started running my ResMed Air 10 CPAP machine for 15 minutes to get the smell of ozone out. We’d be happy to join a class action suit against SoClean.

My wife went to get a new c pap and the doctor said not to use the so clean, it will void the warranty and is dangerous. She has been using it for about a year and a half. My wife bought the SoClean 2 a couple years ago because she has asthma and reactive airway disease and wanted to be sure my respiration’s weren’t sending dangerous particles into the air. Well now we find out, just now even though our machine is registered, that it’s been deemed dangerous by the FDA?! Keeping the air quality HEALTHY was the entire point of getting this expensive machine! No wonder her airways have been so reactive since we got it. Now we can’t use it and are out several hundred dollars. I want my money back!

I too purchased the Soclean shortly after starting with my new Resmed CPAP. It does have a smell while running/cleaning. I’ve had terrible headaches and now I also have tinnitus in both ears. I’ve stopped using it, but spent about $300 less than a year ago. I’d love to know if there is a class action I could join.
