SoClean Class Action Lawsuit Filed Over Health Risks From CPAP Sanitizing Products

A lawsuit against SoClean manufacturer alleges CPAP sanitizing machines release harmful levels of ozone.

A class action lawsuit has been filed over potential SoClean health risks, alleging that popular devices used to clean and sanitize CPAP, BiPAP and mechanical ventilation machines release ozone gasses at dangerously high levels.

The complaint (PDF) was filed by Anthony Sakalarios on September 3 in the U.S. District Court for the Southern District of Mississippi, indicating false and misleading claims have been made about the SoClean 2 CPAP Sanitizing Machine, SoClean 2 Go CPAP Sanitizing machine and related products sold in recent years.

SoClean devices work by generating ozone to sterilize and deodorize CPAP breathing machines, which are used to treat sleep apnea. However, the SoClean lawsuit notes that to be effective at sanitizing the devices, the devices must emit levels of ozone that are higher than can be safely tolerated by humans or animals.

Sakalarios indicates he, and other similarly situated owners the SoClean machines, were misled by false advertising, which claimed the devices used “activated oxygen,” instead of telling consumers that it releases dangerous levels of ozone that exceed acceptable federal safety standards. In the company’s advertisements, it never mentions the use of ozone, and in some cases denies the devices are emitting ozone when asked directly, according to the complaint.

In fact, the advertisements claim the devices release no “harsh chemicals” at all, and Sakalarios’ lawsuit maintains that ozone released by SoClean machines is, in fact, considered a harsh chemical.

“The foregoing false claims deceive consumers into believing that the SoClean devices do not generate ozone, do not release ozone into the atmosphere, and are safe, healthy, and suitable for use in consumer’s bedrooms,” the lawsuit states. “SoClean’s falsehoods have allowed it to command a ninety-percent share of the market for CPAP sanitizing/sterilization devices.”

In late February, the FDA issued safety communication, indicating patients and healthcare professionals should not use what the agency considers illegally marketed ozone gas or ultraviolet (UV) light cleaning devices to disinfect or sanitize CPAP machines. The warning came following nearly a dozen reports of patients suffering respiratory complications.

Individuals reportedly experienced coughing, difficulty breathing, nasal irritation, headaches and asthma attacks after using these types of devices.

Just a few months later, in June, a massive Philips CPAP machine recall was issued, following the discovery that a polyester-based polyurethane (PE-PUR) sound abatement foam inside the machines may degrade and release toxic particles directly into the air pathways.

Philips has suggested that use of SoClean and other similar cleaning devices involving ozone and UV light may exacerbate the foam’s degradation, which could worsen respiratory side effects for CPAP machine users.

The company now faces a mounting number of CPAP machine lawsuits and class action claims, indicating that users have been diagnosed with cancer, severe respiratory problems and other health complications.

Sakalarios’ lawsuit seeks class action certification for citizens of Mississippi who purchased SoClean devices to clean and sanitize their CPAP, BiPAP or mechanical ventilation breathing machines. He presents claims of breach of warranty, fraudulent misrepresentation, fraud by omission, negligent misrepresentation, unjust enrichment, failure to warn, and calls for the manufacturer to provide medical monitoring for the devices’ users.

    Been using So clean 2 for five years now. I never liked the ozone smell, so I have always hit the cpap button and purged the machine before use. I have never had a single problem. No health issues, no problems whatsoever.

    I have used SoClean for a number of years. I have now been diagnosed with COPD. I have never smoked or worked around anything that would cause COPD.

    I bought my SoClean approx 8 years ago. This is the first I’ve heard of this lawsuit. I got my replacement Philips CPap and assumed it was a Philips problem. This probably explains my constant runny nose and shortness of breath. It hasn’t improved with discontinued use of the SoClean. I want my money back. I’m scared to use the $300 machine now.

    I have used CPAP for many years and was always concerned about germs living in the machine. I was excited about soclean. After approximately 3 months I had increased cough and burning throat. Then my nose became inflamed. My nose would be red, painful and the skin would "weep" a clear liquid. I talked to my Doctor and he said I may have been allergic to ozone. After that I would use the machine rarely and after the so clean finished it's cycle I would remove my mask hose from the so clean and just let my cpap run for a hour or so to clear itself of the ozone. How can Phillips be responsible for foam breakdowns partially caused by ozone and so clean is selling devices unapproved and warned about by the FDA?

    I used the Phillips Respironics Dreamstation and the SoClean from September, 2020 until the Dreamstation died with a service error in June 2021. My provider took it back quickly without asking questions and sent me home with a ResMed machine. On my way out I noticed they sold the SoClean on display and I said I needed the adapter to work with my ResMed.     Bought SoClean because med supplier recommended and sold unit. Headaches, sore throat, thick mucus, runny nose, coughing, dry throat. Did not know anything about recall until today.     I have used Res- med CPAP machine for years my wife cleaned the mask and reservoir daily. A few years ago we scraped enough money together to buy it so clean machine so that she would not have to do the mask reservoir every day like shit done throughout the years. If a medical doctor can explain to me without any doubt what caused my heart attack and the use of the CPAP machine is ruled out one hundred percent the and only then will I consider it. My cardiologist said that I stay extremely tired due to the fact that I quit using the CPAP machine.I bet I wouldn't stay tired if I use it again and die of cancer or breathing issues.     I have used the So Clean machine since they first came out. I have had nights when I woke-up short of breath. Every day when I get up, my nose and mouth is extremely dry. In the morning I have excessive nasal drainage, requiring me to repeatedly blow my nose for the first hour.

    I have two homes, so I purchased a SoClean for each location. I have had a terrible cough for the past 2-3 years and I just found out about issue with the SoClean being used with the CPAP! This is outrageous! There should be a class action lawsuit for anyone who has purchased a SoClean! They are so expensive on top of the fact that they are dangerous to your health!

The problem is how to deal with Phillips and SoClean fighting about who is responsible.     Every since I have been using my So Clean, I have had nasal drip, constantly, coughing, etc. It just never occurred to me, it was the machine. I have been taking antihistimens every day, but doesn't seem to help.

    I do smell the ozone from the machine and have noticed an intolerance and inability to wear my CPAP, which only started as soon as I got the SoClean. I've had a CPAP for over a decade without an issue, but ever since my mother purchased me a SoClean as a gift and I starting using it I've not been able to wear my CPAP for an entire eight hours of sleep and the foam on my mask no longer securely f[Show More]I do smell the ozone from the machine and have noticed an intolerance and inability to wear my CPAP, which only started as soon as I got the SoClean.     After reading the comments I notice a lot of similarities to my own experiences with my Soclean machine that I've been using on and off for my Resumed CPAP. I actually asked my Pulmonary doctor did I have to go on oxygen because of my difficulty breathing?

    I bought one of these several months ago. After having my CPAP recalibrated, I was told about the SoClean law suit because of the different health risk and why. I immediately stopped using it. I would like to be refunded my money, also. If this was sold under false advertisement and a health risk, there should be no excuse for refunding my money. I bought this product in good faith.

    I went to my doctor & the so clean machine was destroying the inner part of the CPAP MACHINE & was throwing out little black rubbery things a like a poppy seed but larger & were in my mask & bed. My doctor told me to quit using it.

    I have been using So Clean to sanitize my Res-Med Cpap for about 1.5 years. I only use it 3 or 4 X/week. I've woken every morning for the last plus year with extreme nausea and congestion and cannot figure out what it is. My doctor lowered my Trulicity dose but the nausea persisted so have stopped all together. Now I read all this stuff about the So Clean and I wonder if its the So Clean.

    My husband had many issues during his So Clean uses to the point that he passed away on March 3, 2022 he simply could not breathe!!!!! In the last months, no one could explain why this sudden severe problem! It is scary to think permanent damage could have possible been done….especially when you are trying to take care of yourself and do the right thing.

I too have been getting sore throats, headaches & sinus problems but I also suffer from allergies. I'm exhausted all the time too!     I used so clean for about14 months. I developed ILD and kept getting sicker. eventually I had to have a double lung transplant, kidney disease and other ailments. Be fore being told by the doctor to use a cpap I was very healthy. Within 5 months I could no longer work. I was on an oxygen tank 24/7. I used the Resmed cpap which worked well for me untill I added the soclean.

I do have a persistent cough after discontinuing use of the cleaning machine.     I have a So-Clean but, it makes my mask smell terrible- tried cleaning masks with soap and warm water - smell continued. Got a new mask...first time I cleaned it the horrible smell made my new mask smell just as bad. Can I get some money back ??? I knew it used ozone but I also just assumed the 2 hour waiting period was enough time for it to dissipate. If there are truly health risks associated with the use of the machine then we should have been notified!

    I use a RES-MED CPAP with a SoClean 2 cleaner. I was admitted twice for hemoptysis and found out I have multiple pulmonary nodules, chronic bronchiolitis, lung scarring and ground-glass opacities. I definitely want to be part of a class-action lawsuit.

I Have experienced severe sore throats when I do get an upper respiratory heaviness and I cannot seem to shake it for about 10 days now. I thought this was the answer to cleaning my machine, however, it turns out that it could this machine.     My wife bought me the soclean machine about 2 years ago and my upper respiratory Health has been going downhill since. Have experienced severe sore throats when I do get an upper respiratory and I cannot seem to shake it for more than 2 weeks. With the scare of covid round it's always a fear that I may have that but it with test proving negative it turns out that it could possibly be this machine.

I routinely (daily) continued to use the SoClean 2 to clean my mask , hose and BPAP machine and began to notice over a period of time I was developing[Show More]I purchased a SoClean 2 (CPAP/BPAP) sanitizer as recommended by my local BPAP retailer provider (VitalAire) on July 4, 2018 and began using immediately and from the get go noticed breathing in a gaseous odour when I used my BPAP on a nightly basis. I routinely (daily) continued to use the SoClean 2 to clean my mask , hose and BPAP machine and began to notice over a period of time I was developing stuffiness to the point of having routine nightly panic attacks for lack of ability to breath using my BPAP machine. I also noticed my sleep becoming more restless, waking with headache in morning and through the day and feeling unrest to the point where I was napping a couple times per day. Finally, in May 2021 I stopped using my BPAP machine and the stuffiness, slight daily headaches and disrupted nightly sleep cycles consult continued and currently remain much the same. In August 2021 I contacted my Respirologist’s (Sleep Clinic) office requesting a consult regarding my issues and stated I was no longer using my BPAP machine as I believed my symptoms were related to it’s continual personal use. Unfortunately, due to the COVID restrictions ongoing I was told the earliest (virtual) consultation with my Respirologist would be January 13, 2022. When my Respirologist learned my symptoms and more importantly that I had been using a SoClean 2 , during my virtual consult, he emphatically stated I should not have been advised to use the device and that it was basically marketed full of “lies” as to what benefits it had for CPAP/BPAP users. I am currently under diagnostic evaluation with my Respirologist in order to determine a modified treatment plan.

    I have been using the soclean since 2017. Always woke up with a stuffy nose and a cough. Always in the morning . I would like to get back my 399.00 I paid for it. I recently found out about this when I went to get my new machine.:

Since I am a nonsmoker and don't live or work in a smoking environment and didn't have breathing problems until I started using Resmed and SoClean, I'm pretty much convinced, at least one of these machines has been damaging my lungs. I would like to be included in a class action lawsuit.

It has been sitting in a box for 6 months I WILL NOT USE IT EVER AGAIN. I am going to discuss this with my doctor this week.

    Went to my lung doctor, told her I used a soclean matching. Was told to stop using it . She gave me the paperwork to show the FDA info so I now don't use my $300 unit.

His machine was used until he suffered a heart attack in late December. His cpap has been recalled as well. My dad has suffered numerous ailments...all of which baffled his doctors, so many symptoms could not be alleviated/ eradicated. Constant sores and nasal drainage, extreme confusion...not dementia or alzheimers per neurologist. Suggested it may be covid fog, dizziness and headaches...he has never suffered from these, falls, lack of balance resulted in him walking like a toddler, anxiety, depression that wouldn't respond to numerous meds, unexplained pain in limbs, and six blockages...3 Stent failures and 3 new ones almost entirely blocked. Cardiologist and primary all assured him his heart was in rhythm and everything was great! Yet, not so much. Honestly there is much more, but I will stop. Please contact me, and I can give the separate names or inform me of what we need to do. My mother has been in Respiratory care of home health and her company has been the supplier to both of my dads. To see all the issues surrounding the cpaps and this cleaner really angers me. Shame on you FDA...reminds me of the lax laws surrounding p.meds/ powerful companies as I saw unfold on the Hulu Docuseries DOPESICK. This really opened my eyes to the FDA and really how unprotected we citizens are when we put so much trust into our health system.

    Spent over $300 on machine I have been told is unsafe to use. I too have had issues with breaking out and breathing issues. At this point is it because of the So Clean machine or the Dream Station CPAP or both? I believe So Clean should refund if they are the problem. If the machine is not effective in cleaning as was sold to do then should be refunded.

    My so clean is 3 years old. The lid latch broke.Called So Clean and they said they do make a replacement lid part. But they give a discount price if it older than 2 years. The lid latch is so cheep Not well built machine for over $300.00. Don’t buy this product.

    I have used my SoClean for about one year. When I blow my nose, my tissue is often bloody. I often wonder, how can a company make a device that produces a dangerious gas (ozone). Sure, hospitals use ozone for cleaning, but in an empty room. I hope that a bloody nose is the only result of my use of my use of my So Clean machine. I have stopped the use of my SO CLEAN machine.

    I have a ResMed 10 and have used a SoClean 2 for about 2 years. It has now deteriorated the foam. I have found foam in the water tank and the motor.

    Been using so clean for 2 years, have been developing a rash around nose & areas where mask touch my face. also my nose plugs up alot. maybe this could be the reason. been to dermatologist for the rash & they cannot determine the cause. I've been on CPAP for 20 + years and never a rash.

Two different health care systems with all of their tests and scans can’t find the cause of these debilitating symptoms. After waiting since June for a replacement or repair for my BIPAP machine, for no result. I disassembled my BIPAP machine to remove the suspect foam. What I discovered was, there was about ten percent of the original foam left. It was pieces about an eighth inch thick that was gooey and sticky throughout the air passages of the machine. I removed the foam and cleaned all parts of the machine. I have the foam that was removed from the machine. I blame the ozone producing Clean2 machine with daily use for this degradation of the foam in my machine and constant health issues. Please include me in your suit against this manufacturing company and partners.

    Have used my SoClean for about one year. I have a constant runney nose, with blood when I sneaz . I do not know if this is a result of my SoClean, but it sure seems possible, reading other comments. Why did the FDA stop the makers of SoClean with using ozone was used for cleaning. I am 77 years old and may be dead before this case is settled, but I hope it stops So Clean from selling DEATH.

    Got in 2017 really liked it. Just found out today when I tried to order a new filter kit the therapy shop no longer sells them told me to stop using immediately.i was diagnosed with off in 2020 down to 35 percent lungs . don't know what caused it but this could be the cause.

    I just found out that the Soclean is giving troubles as well as the Dreamstation Bipap (I started with a cpap and got worse so I was changed to Bipap). I am so use to the bipap I cant sleep because I stop breathing so many times a minute. I am annoyed that I am trapped into using it and it is taking so long to replace.     I bought SoClean last January and just learned of this. I immediately stopped using and called the company to ask for a refund. I was denied and refund, and the man I spoke with was very rude. It was very expensive and now I can’t use it. I get sinus pressure, headaches and other respiratory symptoms. Please include me in the lawsuit.

    Just found out about SoClean. I have been waking up with headaches and my nose is always runny. I called the company and was told their machines are perfectly safe and there is nothing they can do to reimburse me.     I purchased a SoClean2 in 2018 and have since been bothered with runny nose, chronic headaches, and dry eye. The VA recently warned me that this could be caused by the Ozone created by cartridge filter. The VA actually does not recommend using the SoClean2 or any product that creates Ozone. I would like to join the class action suit that is currently active.

About 8 months ago I was looking at prelims for knee surgery. I mentioned I was having some slight chest and jaw pain. My doctor ordered EKG's, sonograms, and lower, heart and carotid flow sans and an upper MRI. I have been scheduled to see a cardiologist in Ja[Show More]I purchased my SoClean 2.5 years ago.     I used So clean with my recalled Dreamstation cpap for appx 1.5 years I have been chronically ill I have liver damage have developed Asthma and many other health problems I did not know about ozone. There has always been a very noxious smell while running device.

I only found out about the recall because I needed a few new pieces and had to see my doctor. I have had a sore throat for months and repeated coughing. Why didn’t either company contact their users?     I have been using a So Clean device for years every day and I have a RESMED AirSense 10 machine since ( New 2014) and was replaced under warranty in 04/2018 due to what looked liked black spots floating in water tank. Then in 04/2021 same thing happed and machine wasn’t covered under warranty and I had it repaired at my expense. I just found out about the So Clean can be causing the issues I have [Show More]I have been using a So Clean device for years every day and I have a RESMED AirSense 10 machine since ( New 2014) and was replaced under warranty in 04/2018 due to what looked liked black spots floating in water tank. Then in 04/2021 same thing happed and machine wasn’t covered under warranty and I had it repaired at my expense. I just found out about the So Clean can be causing the issues I have been battling with respiratory issues which they don’t know what’s been causing them. I am disconnecting my So Clean device today as well as my wife’s, she hasn’t been on CPAP or So Clean as long as I have been.

    I use a Phillips Dreamstation CPAP along with a SoClean Machine. I just received an email about the recall of my Dreamstation. I’ve submitted a claim to Phillips to replace my CPAP. I want to be part of this lawsuit. I had no idea of the illness that have been caused by the SoClean.

    I have been using a call machine for many years, with out the so clean as well as with the so clean machine.     I have been using a SoClean 2 for several years. I also use a Dreamstation CPAP. I was diagnosed with cancer this year. I no longer use SoClean because of the various news articles read about potential dangers from the ozone emitted by the SoClean. I recently received an email from Phillips regarding the Dreamstation recall, and am now on the list to receive a new one.

    I purchased the so clean 3 and woke up to the so clean 3 being on and cleaning while I was wearing the mask. I took it off and unplugged it but I had a coughing fit for ten minutes, felt very nauseous and my throat hurts and it is hard to breathe. Why would the machine turn on while I was using the cpap.

I often have a scratchy throat, wonder if the SoClean is the culprit? I also smell the ozone. I hate the smell. When I was working it would run while I was at work so I never smelled it. My doctor asked if I cleaned my hose and mask and if I used my APAP machine every night and to which I said yes but never thought to add I have a Soclean. My respritologist advised I stop using Soclean immediately when I picked up my new ResMed machine. I too was advised not to use Soclean and stop using it for health concerns and was advised it is illegally on the market as a safe cleaner for CPAP equipment as the FDA or here in Canada, Safety Standards were never consulted on health and recommends that high use of Ozone equipment not approved does propose serious health risks. I am now seeking to join a class action law suit.

    I have been using So Clean about 4 years. I developed a cough with clear flehm shortly after that. Doctors said no connection. One month ago I got a severe sinus infection. Not sure what caused it. I now have sinus drainage and headaches every day. I quit using the so clean one week after this developed. It's been 3 weeks now. I am feeling better now, but still drainage and headaches.

It had a very unpleasant odor when running so they sent me two new filters, this did not help. After purchasing the machine and filters I was told not to use it. Now I have a $400 nightstand decoration. My question is, are or can they modify it so it can be safely used?

    I've used the SoClean for a few years. Besides nose irritation, I've had a really bad problem with my ear irritation. I've also struggled with a cough and mucus. The smell from the SoClean is strong. I did have to replace my CPAP because of the particles showing up in the water from deterioration. This might explain a lot.

    Using a Resumed ASV unit with So Clean 2 for a couple of years . Machine just started to make a high pitched wine that increases with the depth and speed of each breath. My wife and I are unable to sleep due to this. Nobody ever told us about So Clean damaging CPAP units. I will not continue using it.     My husband died July 10,2020 from pulmonary fibrosis! He used So Clean to clean his bipap! He was never diagnosed with pulmonary fibrosis but when he died that was his cause of death! He was on oxygen 24 hours a day because he couldn’t breathe on his own!anymore!

I wake up with a stopped up nose and my husband has coughing and a lot of drainage each morning. We gave one to each of our son-in-laws and have a brand nrw one in our closet.     I too have had issues as I am an asthmatic and have been using soclean for 2 years now. I thought my asthma was just getting worse. Of course I have stopped. Any lawsuits for Florida out there? Thanks.

    I purchased my SoClean a few years ago but only used it for a few months, I noticed that the water in my reservoir contained a growth after I'd use the cleaner. I didn't like the ozone smell either, overall I don't think this was the best nor safest way to keep the cpap clean. I don't know what this has done to my lungs.

    Please let me know if there's a lawsuit in HI. I have been using SoClean for over 5 years and not sure if it is causing me bad allergies, difficult breathing and stomach pains some mornings. Guess I will not be using this product anymore!

    I use a ResMed cpap with a SoClean. I was awoken the other night by a taste of a chemical in my mouth, throat and upper chest. It took about 30 minutes for the pain, SOB and taste to subside. Called my cpap supplier but they where of no help. Looked on line to find out about the issues with SoClean. Hopefully this feeling in my chest will go away after I stop using the ozone.     I thank God I don't seem to have any health problems from my SoClean. The only loss I have is the $300 purchase price -- would love to recover that if NJ has a class action brewing....

    I have been using my so clean for 2 yrs now and my asthma has gotten much worse and now having other breathing problems. I feel I was mislead and now I am suffering for something I believed to be true. Missouri

    I have been using the So-Clean for over 5 years. I would wake up every morning with severe nasal congestion that would take over 1-2 hours to go away.I would cough up mucus all day.These symptoms got much better after I stopped using the So-Clean. I am concerned about long-term effects from using this device.

    Cant trust anyone. Look at our own government after September 11. All officials said the air was safe around the area of the Towers. Yet people and responders later fell ill. Money and power rules and people are disposable it would appear.

    I have Socleam machine for several years. First Dreamstatin I used it on just quit working. It emits a strong unpleasant order. I obtained a second Dreamstation at my expense but just stopped using it after reading of cancer dangers.

Both my wife and I have our own SoClean 2 machines and put them both on in the morning. I also have problems breathing at night and can also smell ozone in my mask at night.     I started wi a c pap n use if so clean for my device. Since then my numbers have increased an now have moved from c pap to by pap due to my air need n worsening w my lungs

    I have been using a Soclean for two years now and recently I’ve been having breathing problems and shortness of breath. Been to several doctors but with no diagnosis.
