Toyota Accelerator Problems Result in Class Action Lawsuit

Two drivers in California have filed a class action lawsuit against Toyota Motor Corp. over design defects that may have caused over 2,000 Lexus and Toyota cars to suddenly accelerate out of control. The problem has reportedly resulted in at least 16 deaths and 243 other injuries attributed to sudden acceleration of Toyota or Lexus vehicles.

The Toyota class action lawsuit was filed by Seong Bae Choi and Chris Chan Park of Los Angeles in Riverside County Superior Court last Thursday. Choi is the owner of a 2004 Camry, and Park is the owner of a 2008 FJ Cruiser. Both say they, like other Toyota and Lexus owners, experienced sudden acceleration problems.

The complaint comes after a Lexus and Toyota recall issued on September 30, involving 3.8 million vehicles. Toyota claimed that the vehicles could experience sudden acceleration due to defective driver’s side floor mats, which can cause the accelerator to stick. However, the new class action lawsuit alleges that Toyota has failed to correct an issue with the throttle control system, indicating that the floor mats are not the only cause of the Toyota accelerator problems.

Choi and Park allege that some of the blame for the sudden acceleration involves the electronic throttle control system, known as the ETCS-i. They say that the original design for the system included a safety feature that would have put the engine into idle mode in case of unintended acceleration. However, the company allegedly decided to sell the vehicles without the feature in 2001.

The lawsuit, which seeks class action status for all owners of affected Toyota and Lexus vehicles, calls for a recall of all models with the defective ETCS-i.

The National Highway Traffic Safety Administration (NHTSA) previously rejected a similar request by some vehicle owners to investigate the system, according to a report by Bloomberg News. In a federal register notice published on October 30, NHTSA officials said that the only defect that accounted for the acceleration problems with Toyota and Lexus vehicles were the floor mats being out of position or inappropriately installed.

Investigators from the NHTSA began investigating reports of sudden acceleration in Toyota and Lexus vehicles in 2007. In addition to causing uncontrolled acceleration, when the gas pedal was jammed under the mat, investigations found that it also reduced the effectiveness of the vacuum power assisted brakes. The reduced effectiveness of the brakes increased stopping distance from 200 feet to more than 1,000 feet, and increased the amount of force required to fully apply the brakes from 30 pounds to 150 pounds.

The September Toyota and Lexus recall involved more than 3.8 million vehicles, including 2004-2009 Toyota Prius, 2005-2010 Toyota Avalon, 2005-2010 Toyota Tacoma, 2007-2010 Toyota Camry, 2007-2010 Toyota Tundra, 2006-2010 Lexus IS 250 and IS 350, and 2007-2010 Lexus ES 350 models. Owners have been told to remove the driver’s side floor mats until a permanent fix can be found.

The recall was prompted by a high-profile accident in California, which killed an off-duty state trooper and three family members in August. Investigators determined that the fatal crash occurred after the gas pedal on a Lexus ES 350 became caught on the edge of the floor mat, causing the Lexus to accelerate to 120 m.p.h. before falling off an embankment, rolling over multiple times and bursting into flames.

Minutes before the accident, passengers in vehicle called police and reported that the Lexus was accelerating out of control, and witnesses reported that the car’s tires were on fire, which was likely caused by the driver slamming on the brakes.

My 2005 Toyota Camry suddenly accelerated after I had just parked it in our underground parking facility. It suddenly lunged up over a curb and into the cement wall about two feet in front of me. An unbelievable shock! Toyota Corporate sent an engineer to investigate the incident, and he informed me that it was due to floor mats. This was impossible. Toyota will not admit to any flaw in their cars. I am willing to join a class-action suit.

I was in drive waiting for a parking space, when I too my foot off the brake, my 2003 Toyota Corolla accelerated in reverse. Could not believe it!! No injuries or accident, on the other hand, the car has to repeat this in the hands of a mechanic to be taken seriously. Anyone else out their with this problem?

I had a 2005 Toyota Highlander and last month came to full stop at a red light, started a right turn and the next thing I knew I hit a telephone pole that was 130 feet from the corner and totaled my car. My insurance company cared for the replacement but it didn’t matter that I felt like it was an acceleration problem.

On April 11, 2010, I experienced sudden acceleration of my Camry, causing me to run into a wall at a local Walgreen’s pharmacy. I suffered only minor injuries (abrasion from the airbag, and sore shoulder from the seat belt), was examined at a local hospital, and released. I was not cited by the police, and the evidence (significant tire marks on the pavement where I tried to stop the vehicle) definitely pointed to a vehicle malfunction. I filed a claim with my insurance company, who reimbursed us for the value of the now-totaled car. We were pleased with the settlement, and since I was not injured, decided not to follow up wit any litigation against Toyota. The insurance comany also decided not to initiate an investigation, the car was scraped, and all parties went on their merry way. On May 4, 2010, I started working for Toyota as a contract employee, on a one-year contract. Over the course of the next few days, I disclosed this accident situation with my immediate supervisor, and also with his manager. On Friday, May 14, while at lunch with my supervisor and three other Toyota employees, the topic once again came up. Following this lunch, one of the three employees felt the need to speak with the legal department about a potential conflict of interest situation. On Monday, May 17, at approximately 4:15, I was escorted to a conference room by my manager, and was introduced to two other individuals, a General manager and a contract employe liaison. At that time I was informed that the legal department felt they needed to investigate the situation, and that I would not be allowed on the premises during that time. I explained that there was nothing in the works regarding any litigation, by either me or our insurance company, and that I would gladly sign any document releasing Toyota from any claim whatsoever. They did not have me sign anything during the meeting, and I was subsequently escorted from the building. On Thursday, May 20, 2010, I was informed that I was not going to be permitted to continue my work at Toyota at all. I was never contacted by the legal department, was not interviewed by any investigating agent, and I had not opportunity to appeal. I feel that I have been wrongfully terminated, and would like to know if I have any legal recourse in this matter.

Toyota claims no problem with my 07 Camry after inspection. I has two accelerator accidents in reverse nearly a year apart causing significant damage to the car and my home. The first one last year took the car backwards into the my garage just as the door was coming down. The second was backing out a parking space in a parking garage where it raced in reverse and hit a cement retainer wall. That was February 5th when I placed my first call to Toyota. Both accidents were repaired by my insurance and I am looking for compensation of a replacement vehicle since my cuurent car has no resale worth now and the balance owed is what they are selling for new. These accidents were clearly not my fault and as a lifetime owner of Toyota vehicles I believe Toyota should stand up to the plate.

Wow! lots of the above comments are very similar to the scary experience I had with my 2009 Toyota Camry. It happened to me, but thanks God I didn’t get in an accident so far. I did go to a Toyota dealer to let them know my concern with the accelaration on the car and that I wanted to make sure it was ok so they could take good care of me as a customer and as someone in danger. I had felt something wrong and weard with the gas pedal already when inmediatly I decided to take my car for inspection that same day. So I went to this Toyota dealer in L.A. where an employee inspected my car and assured me that my car was ok since it was made in Japan and that it was me who had it wrong in my head because of the news talking about Toyota’s car accidents, After that day I tried to forget about it until the accelaration problem happened again and again, Finally when I was convinced that it wasn’t in my head I had to take my car again to the dealer where I originally had bought it. I asked for the recall inspection and for the regular oil service, a few hours later they called me to let me know that my car ” had the accelarator defect” …of course I got upset. They suppossely fixed the problem, but since then me and my family have been worry and scared to continue driving it. I don’t trust my Toyota anymore and I also feel I shouldn’t be paying for a 2009 car that had a “serious defect” in the beggining. I feel deceived and very dissapointed.

My wife and I own a 2005 Avalon Limited which we loved until it spontaneously accelerated whilst parking. Damage very minor. Realizing it a death trap we cannot drive or sell it, just do not know what to do. Since this event in April 2010 learnt our next door neighbor has twice had the exact same experience in their Lexus.

My mother’s 2001 Toyota Camry has had 3 acceleration surges. The first accident happened when parking near a school playground cycle fence, surging onto the empty playground and doing significant damage to the car. Second incident occurred at a stop sign; accident avoided by quick turn to a side street and hitting the curb. Third incident happened April 2010 while attempting to park, car surged ahead, went through fence and landscaping. She had been driving about 3-5 miles an hour but the car accelerated to what she said felt like 120 mph while she was trying frantically to stop it. The key was turned off to stop the car. The police noted the brake marks where she had tried to stop the car. After this third accident because of surge, the 2001 Toyota Camry was towed to the Toyota dealership. They still have the car. Repairs were made to the body in the amount of $2000. They are waiting for someone to come from the Torrance Headquarters to inspect the car before they will let my mother have the car back. This is more than one month that they have had the car. My mother is afraid to drive this car again. We want to know how to claim in the class suit against Toyota. It is a miracle that she and her passenger were not killed. It is also a miracle that no children were on the playground when the first surge occurred 2 years ago. Of course, Toyota says there is nothing wrong with her car. But then we would like to know why they are holding the car for the Torrance Headquarters inspector. By the way, Torrance is more than 600 miles away from the Chico, California dealership where this 2001 Camry is being held “hostage.” How sick do we feel? I have two 2007 Toyotas in my garage and recommended my mother’s Camry to her. Toyota IS GREEDY AND CORRUPT!

today my 2003 camry accelerated so fast i did’nt have time to think and i almost hit the car in front of me but i managed to pass it and put the car in netural. the dealership was no help. i was told my car could not do that.i think people who have’nt had it happen to them should wait to talk untill they have had the experience. be prepared for a heart attack because it’s the scariest thing that ever happened to me.

I own a 2009 Camry LE which was purchased in January of 2009. My car has received the dealership “fixes” for the recalls, but at this point I would prefer to have another vehicle. I am terrified of driving my car. I have two kids, and I hate going anywhere with them in the car with me. I purchased my car for the safe reputation, and for the high resale value, and I am so sorry I did. I wish there was a way Toyota would buy back recalled vehicles from customers who do not want them anymore or at least pay the difference in the values of the cars. I am stuck with it since, I can’t afford to take the loss trying to trade it in anywhere. The trade in value has plummeted thanks to these recalls.

I had a 2009 toyota camry. I let them come a reposes it. I was afraid to drive it any more. I was in an accident where the car accelorated and I could not brake. I had to force the car into park. They are still trying to make me pay for it. I also have to pay for the other drivers damage. When I called toyota they said the insurance I had through them that I bought just in case my insurance lapsed did not pay for accidents. Why did I buy that insurance then. I called them also because I knew something was wrong with the car and they told me it was the driver not the car. My dad also drove the car and said it accelorated on him but nothing that he could not control becaude he caught it early. He also had to force it into park. He was just driving down to the store not far from the house. He came back and told me but we thought it may be a fluke. I do not want to pay for a car that tried to kill me.

I have always stood behind Toyota until I went in to trade it in and they tried to low ball me. My vehicle is a 2007 Solara with 42,000 miles and they wanted to give me $7000. The vehicle is in very good condition inside and out.

Have a 2000 Cambry V-6 with 60,000 mi. The starter went bad so took it to Toyota of Marin. Also had them do the 60k check-up. Got the car back and within a day it began to shift itself into reverse whenever forward speed decreased to about 5 mph. Checked all fuses and noticed that the licenses plate light wasn’t getting electricity, checked its wires and noticed that three wires going into the truck lid were cut. I Spliced the three wires and the light began working and the spontaneous shifting into reverse stopped. The Check Engine light was still on though, the fault code indicating the EGR flow was excessive and some Manufacture/Instruction fault. This fault is keeping me from passing the smog check and hence getting the car registered in California. With some research I’ve learned that these fault codes, no matter how much repair and new parts you pay for, will eventually come back once they start. Toyota quality is a big fraud and virtually all its dealers are web RATED as “pirates”. The electronics are sh*t compared with German cars. If you think spontaneous acceleration is bad wait ’til the car starts shifting into reverse by itself.

I have a 2007 Corolla with automatic transmission that I purchased used in July 2008. It has had 3 cases of sudden acceleration. The first time was Jan 25, 2010. In this case my wife was driving, waiting in traffic for at least one minute, with her foot on the brake only, when the engine suddenly accelerated. The engine continued to race very fast until it was turned off. It was driven to the local Frederick MD Toyota dealer, who found nothing wrong. Then my wife was waiting to make a right turn into traffic on approximately Feb 12. She then gave the car a little gas; the car suddenly lurched forward very fast and collided with another car. The engine again raced very fast afterwards until turned off. The accident caused about $3000 damage to each car, but no injuries. The car was towed to a body shop, and the body damage was fixed, and my wife picked up the car on Feb 24. She drove about 2 blocks from the body shop, waited about two minutes to make a left turn across traffic, when the third event happened. She had her foot on the brake again when the engine again suddenly accelerated. This time she noticed that the engine was racing at 7000 rpms. The engine sounded the same as it did the first two times. The car was towed to the same dealer, where it still sits as of April 23, 2010. The Toyota dealer refused to examine the car. We waited a few weeks before an independent technician hired by Toyota showed up to examine the car at the dealership. A report was given to Toyota, who then forwarded it to Toyota Legal Dept. We are STILL waiting for a report from Toyota Legal. Toyota seems to be only interested in the accident aspect, trying to prove that they are not responsible for our accident. They are still making no attempt to fix our car, beyond occasionally driving it around to see if the sudden acceleration happens again. So far it has not. The dealer repair shop has told us there is nothing wrong with our car. The first incident happened near Fort Detrick. The second and third incidents happened close to the end of the Frederick Airport runway. The locations may possibly be a factor. The Engine Control Unit (ECU) was replaced (under warranty) in May 2009. We contacted the NHTSB, and they showed a brief interest this week and last week in coming out to look at the car. They have little interest since the air bag never deployed. We have now been without our car for 10 weeks except for one night in Feb. We are still making payments on a certified car, still paying for insurance; still have an extended warranty, all for nothing. Toyota still lives in the dark ages, where they believe that the only car problems are those they can readily see or hear, through direct observation or by a test. They have no memory capability built-in to record most electronic faults, except when an air bag deploys, and then only for a few seconds of time before the accident. Then they act like smart asses when they say they can not find evidence of nor reproduce the defective activity, and tell the car owners there is nothing wrong with the car. I have bought nothing but Toyotas for 32 years, since I bought a Toyota Hilux pickup in 1978. Think I will keep streak going? When Hell freezes over! And for this loyalty I get royally screwed by Toyota. I have a car that is too dangerous to drive, and is dropping in value by the day as I continue to make payments, and can not afford to get rid of. After ten weeks, Toyota will not even try to fix it, will not offer even one day of loaner car use, will not cover one cent of repair costs if I find some way to fix it, and will not honor the extended warranty, and closes off by saying there was never anything wrong with the car. Somehow Toyota has managed to go from best to worst in an incredibly short time.

To everyone who has complained about Toyota/Lexus, and been directed to customer service, its a scam, its only a information system which gathers information so that they can come up with excuses why it is your fault. The US Government needs to offer them the door, they aren’t really concerned if you are hurt, or your vehicle has damages, they are united into doing nothing. Lexus has a facebook page, see my story on Facebook, and post your own, folks on that page are mainly employees, or friends of dealerships, so post, and post, post today, and everyday until we the consumers are heard.

Good Morning, I have a 2006 Toyota Corolla and when i go over the BRIDGE Every Day After Work the car Stuck Accelerators and wont shift gears and the braking is hard also. high rpm’s

I am completely amazed after reading all of these comments. My husband owns a 2009 Toyota Corolla. Last Saturday on his way home from work his accelerator pedal stuck. Fortunately, he thought to get the car into neutral when the accelerator and brakes did not respond. After some time the car did respond and he luckily made it home safely. Glad we only live a couple miles away. He called the owner of our local Parkersburg dealership and asked him what to do. Mr. Hathaway told him that they would not have anyone available until Monday to look at his car, and that he could drive it for the weekend and bring it then, or if he didnt feel safe that he could have it towed in on Monday. They didnt offer a loaner vehicle and I'[m sorry, or nothing. He had a local tow company take it over on Monday as told and then they wouldn’t accept the car because he was not there with it. He was on midnights and was home in bed of course as this was early in the day. The dealership called him and said they need him to be there to sign it in. Of course he informed them that he obviously had no car. After some arguing, he had a friend take him over that afternoon. The man who ckecked him in, started making comments about how their would be reprecussions if they pulled the black box and the allegations were found to be untrue. Basically trying to intimidate him. After speaking with customer service, they finally did give him a loaner car. Now, his car has sat at Toyota, from the looks of it, has not been moved, and they have not called him. When he called yesterday, the customer service lady informed him that she didnt really know what was going but there was some concern of his after market floor mats. The funny thing is there are no floor mats in the front of his car. He does have them in the back of his car to go under our sons car seat to avoid ruining the upholstery. They are just looking for an excuse. So at this point nothing has been accomplished. I think he is contacting an attorney and the attorney general. We’d love any suggestions. they obviously have no plans on working with us.

I owned a 2005 Camry. While driving to school on a clear summer day on I-5 in CA I crashed. I was in the fast lane driving at 60mph with a semi right next to me. I needed to merge into the rt. lane to take my upcomming exit. When I accellerated, the car hit the lane pads to the rt so I steered slightly to the lt. the car was speeding up. I was immediately in the middle of the highway unable to stop the car and unable to see where I was going. I hit two gaurd rails and a cement divider, flew accross the highway into oncomming traffic where the car jumped into a revene and stopped. I was knocked unconscious when I hit the rails but remember screaming “Oh my God, what is happening?” as I could not stop the car while hitting the brakes. I ended up a trauma patient, lost my spleen, had massive internal bleeding and blood transfusions and fractured four ribs. I told the insurance company I don’t know how this happened because I did not press the accellerator much at all. I have been driving 35 years and never have had an accident. I kept telling my husband this was not due to navigational fault. Something went very wrong. I have waited to post this due to the media flury and public reactions when an initial finding is made. We orig. thought maybe the new tires the day before the accident had been faulty but forensics did not find this to be the case. I know it was the accellerator. I had the floor pads still in the car as we never received a warning about these and always checked consumer reports prior to purchasing any vehicles. It is obvious Toyota knew of this problem and hid it from their consumers.

I run an independant repair facility. These cars may have problems with the pedal friction or floor mats, but I believe that is a lie put out by Toyota. I had a vehicle with a sticking accelerator and the problem was the electronic throttle body. The problem comes from a vent hose on the throttle body designed to drain any moisture inside. That is where the problem truely is. Excess water is coming up the tube and causing the components to rust and corode. The throttle will then stick. Toyota knows about this because when you get a new part to replace the defective one, the drain is no longer there. They are trying to cover this problem up. About a $1000 per vehicle to fix.

I drive my car every day to carry my family to many functions such as school, soccer games and the YMCA. Each day I worry about the gas pedal sticking and is my family safe in this Car. I want to get ride of the car but due to the fact of the Safety and Large depreciation of my 2008 Camry I have no trade in value or resell value. I consider this car to be an expensive throw away car. I only hope that I do not kill somebody else that might be in the way of my run away car. Imagine….How would anyone of Toyota feel If it were his family member that were hit by some one driving a run away Camry or Toyota product. Would they speak out then… I pray that nobody else will be killed or injured due to neglect !! I will never by another Toyota or Lexus again just for that fact of the cover up. I was sold a Pre owned Lexus RX330 and was informed that the car never had been up north. Well I go home and I am going through the vehicle. upstate Pennsylvania. The salesman lied to me. I guess that it comes from the top down. What happen to the honor that use to be?

I was driving my 2005 prius in maryland, ended up in a accident full front of car was crushed, airbags never deployed, even the optional side airbags i purchased never deployed, have pictures of this. I ended up with a couple of fractured ribs from bouncing off the steering wheel. I now own a 2007 prius, I have noticed that when I take the car off cruise control that the car surges forward faster for about 30 secs to a minute before a little of deceleration, also i intergrated phone system has a habit of disconnecting while driving too.

Toyota Camry Crash in July, 2006. When I drived my car from Cleveland, OH to Pittsburgh, PA. It was going between 65 to 70 mph. At that time, I lost control of my car, and the car run out of the highway. The car fired and finally became a trash. The location was near Beaver Falls, PA What can I do now?

I cannot believe that I am reading story after story that matches up with mine, and until a few months ago I thought I was all alone and had experienced a fluke with my Rav4! In the fall of 2008, only a few months after purchasing my 2008 Rav4, I was travelling on the interstate. I floored the gas pedal to pass a slower vehicle on an uphill. When I passed the vehicle and released the accelerator pedal it remained pressed tight to the floor and I began to pick up speed at an alarming rate. I crested the hill and and was flying faster and faster, and was now in a one lane construction zone. I knew it was only a matter of several sconds before I would plow in to the cars ahead of me. I hit the accelerator pedal as hard as I could with my foot a couple of times hoping it would release but to no avail, I tried the brakes but they didn’t even faze it. I knew I had only a few seconds before impact and estimate I was going 90 to 100 mph at this point. I thought about putting it in neutral but honestly didn’t know if that would work or would cause the car to flip or something so I decided to try one last thing and reached down to the floor pedal and grabbed it and pulled it up. It worked—just in the nick of time. I was certain I was going to die in the next few seconds and was even planning to steer the car away from the other vehicles to spare them. It was horrifying. We took the car to the dealership that we had purchased it from and they insisted that the floor mat had jammed the accelerator. However, when I reached down there in my desperate last attempt to save myself, there was no floor mat around the pedal, it was nowhere near it. They refused to believe me and stuck to their story that it was due to my non compliant floor mat. I continued to drive the car being careful to never floor it, but have worried endlessly about it happening again and you can imagine my shock when last fall it became public that these incidents have been happening to thousands of people and it has been going on for years! We called our dealer and asked what we should do in light of this information and they told us to take the floor mats out and leave them out ( Toyota floor mats by now, since they had insisted that we needed those to prevent further mishaps!). Two weeks ago we recieved the recall notice for my husband’s Tundra, when he called the dealer he asked them if they were planning to do something about my car and they responded that they were not authorized to do anything with it since it is not on the recall list, in spite of the fact that I did have a stuck accelerator. We read the reports of the cover ups, the fatalities, the memos to save money by limiting the recalls, etc and became very concerned about the lack of response on Toyota’s part. I was interviewed by our local news and told my story. Our Toyota dealer called the news station and was very angry and demanded that they be interviewed to give their side of the story. It was a vitriolic, arrogant attack on my credibility and they said that we had never called them since the initial incident. I was treated as if I were the perpetrator and they were the victim. Our entire family drives Toyotas, they were all purchased from this dealer, and this is how we are treated when a problem of this gravity is encountered. Unbelievable. We are now considering our options and struggling with how we rid ourselves of these death traps without endangering anyone else. I’ m FURIOUS at how I have been treated personally and at Toyota for their shameful behavior in covering this up, minimizing it, sitting on their hands and allowing this to go on and on and having the temerity to blame, ignore, and shame their customers. They should be appalled at the loss of lives, the many accidents and their utter disregard for the very people who made their business sucessful. SHAME ON YOU TOYOTA.

Solara Owners, with gas pedal problems, please be advised that complaints will need to be made with corporate Toyota call the 1-800-331-4331 , check your owners manual it states that engine speed or idled engine is diagnosed with an electronic throttle control system. Insist that they place the Camry Solara on the recall list, along with this ask who makes the gas pedal on the Solara, and why is it not the same as the Camry, or is it? Then file a complaint with the NHSTA explain in detail the problems you are experiencing, you can do it on line, or call the 1-800-424-9393. Without our Solara’s on the recall list, we will be responsible for the diagnostic testing and any repairs. This is not our fault, why should we take financial responsiblilty for a defect that Toyota needs to acknowledge and fix on all make and models of Toyotas. Act now, write your congressman. Make change happen for all of us. The more complaints they get the higher the possiblity that they take necessary steps to fix our cars.

After all the problems we had with our 2006 tacoma and listening to the B.S. excuse about the floor mats, it would be hard for me to put any faith in anything the National Hwy. Traffic safety Administration said about anything. I suppose big business has a lot of pull with our protectors.

My wife purchased a 2006 Toyota Tacoma from a dealer in 2007. It had 19000 miles on it. We were assured there had never been any problems with the vehicle. We started having all sorts of electrical problems. The truck would lock the door when you got out and the key was in the switch, the windows could still be operated with the key out after the door was opened and closed. We then started having trouble with the accelerator speeding up on its own. This always hapened when the sterring was was turned to the left and it was not stuck at one speed, but would rapidly increase on its own. Finally it did it as my wife was leaving for church and the tires were spinning for 40 or 50 feet before she took out our mailbox and did over $700 damage to the truck. We called the sales manager and were told to bring it in the next day. My wife, myself and my tape recorder pulled in to the service bay the next day and was told by the service manager to get that to “get that damn truck out of there”. He then stated that he had checked the accelerator before and there was nothing wrong with it. He had never checked it to our knowledge. I tried to explain that I had an appointment, but he said he didn’t care. He refused to call to another building to talk to the sales manager. After a hour and a half of talking to the sales manager, one of the owners took us for a test drive in the truck. He tried to push the floor mats on the gas pedal so hard that he tore the mat. The owner finally told us to leave the truck and he would have some outside experts check it out. He lied about that. A couple of days later the workers at that dealership said the floor mats had not been fastened to the floor hooks and slid up on the gas pedal. I phoned the owner and explained that my wife had cleaned the truck out before we brought it in to be checked As we started to leave home I noticed she had not hooked the mat back in the floor hooks. I brought this to her attention. I told the manager that had I not noticed the loose mats I might have thought my wife just left them in that condition. I told him that could have caused me to accuse her of leaving them loose. HIS RESPONCE WAS, “THAT SOUNDS LIKE A PERSONAL TRUST ISSUE BETWEEN YOU AND YOUR WIFE”. When he began using the F word I told him what I thought of him and ended the conversation. We were later called by the service manager and told to not bring the truck back unless we could make it accelerate on its own. After 30 years of being a loyal Toyota customer we now own a new honda.

Funny how all of you are coming up with these stories now, jump on that wagon, see how much money you can get. After all the way of our wonderful country is to turn to lawyers to try to get rich. Accidents happen, Toyota is trying to make right, there are many things that go wrong from toys, to cars, to bikes. But now we all have to point fingers and “what is in it for me” attitudes. Wow, what you all have become.

We had the acceleration problem, last summer…a horrible experience, and were simply told “remove the floor mats”. We’ve also been told that because our car was made in Japan, it isn’t subject to recall, in spite of the fact we had the problem!! The local dealership never documented our complaint and responds that “people are making these things up”. We just traded our 2009 Toyota for a Honda and were told that we’d not get as much of a trade in due, in part, to the fact it is a Toytoa. Are there any class action suits for cars NOT included in the recall?

I own a 2007 toyota camry solara. My problem exist with a stuck pedal. When I am stopped at a light, and proceed to step on my accelerator momentarily sticks in a neutral position ,until it releases, while I am still moving forward with the same pressure on the gas pedal. I checked the owners manual and this is what it states: if the engine speed does not increase when the accelerator pedal is depressed, there may be a problem somewhere in the electronic throttle control system. My concern is this problem is associated with the recall, and my car is not on the recall list. I do not feel confident in toyota’s explanation with all toyota cars. I do not know if my car was involved in the 1st recall with the floor mats, throttle control, or the gas pedal. I want to know who made my accelerator pedal and if my car will be repaired by toyota. I do not feel safe, that this problem with the pedal will make my car go out of control. If it is a defective part, has it been determined that when my pedal sticks it will accelerate out of control. With so many other toyota’s being added to the list each day. I want to report that the camry solara should be added to this list. It is not safe to drive. This happens every time I drive the car. I am not currently driving the car. I expect all issues with acceleration be closely looked at by toyota, and the responsibility to repair at the cost of toyota be taken care of regardless of a recall letter being sent out to only the listed cars to date. This is a problem I did not anticipate, with a new car, and know it is due to defective materials used in the production of their cars. Treat all fairly. I can not afford to pay for a repair, and should not be inconvenienced in making a car payment, when a car is sitting in my driveway. Or should I be out on the road driving in a dangerous vehicle that has not been put on the recall list.

I had a 2003 toyota solora camry it had less than 23000 miles I took it in several times telling them when driving at times it would accelerate as if I had put on my cruise control they never once said it my be my floor mats they always would say they could not find anything wrong. several months later I had a accident and the car was totaled leaving me now to wonder just what was really the problem and why was the pedel sticking. I always bought toyota now they have lost a value customer

My mother has a 2006 Corolla. Last Wed. It accellerated as she turned into her driveway. The brakes did not work! She went 395 feet before a cement bird bath, a bird house on a wooden post and a tree stopped her. Her car is totaled. She has some physical injuries and is afraid to drive now. A few months ago, her car did something similar—though with little damage. Of course, Toyota assured us that there was no problem with her car and that it was not on a recall list. My mother has been a loyal Toyota customer for years. Never again!

I have a 2007 Toyota Camry and my car has accelerated 2 times. Once with my child in the car. There is nothing worse then telling your child it will be fine when you have no clue what the heck is going on with your car. I told toyota this a year ago and they told me theres nothing to worry about and your car has not been recalled. Now, that it is recalled and i advised the girl that makes appointments that my car has accelerated 2 times and i have a 7 year old and a baby the earliest she could get me in was 3 weeks from now. SERIOUSLY?? I am now driving my husbands truck and i do not want my car anymore and i have heard that people that have gotten the fix on their car are still having problems. I probably wont be able to get rid of it either now. Please count me in if there is a lawsuit. I need a reliable car for my children.

I leased a 2010 Toyota Camry on October 31, 2009. I heard on the news 3 days later about the recall and called the dealership and wanted to return it. They were rude and disrespectful to me and wouldn’t take the car back. On December 22, 2009, I was driving on a downhill road, and when I came to the stop light, I felt my driving pedal go down. I fiddled with it with my foot and it seemed to be okay, then when I turned left and went up another hill, on the downside of the hill, I felt it go down again and I looked down to see if there was anything I could do and when I came up, there was a car in front of me and I hit the driver’s side just on his bumper and didn’t hurt him or myself, thank God. I had enough sense about myself to miss him by steering the car gently to the left but skidded right into him. I am 64 years old and have never hit anyone. My car also is having a problem with a buzzing sound when I open the door sometimes, either entering or leaving the vehicle. I also am having problems with the light going on and off and flipping the switch by itself on the overhead. They have inspected it and tell me that they can’t find anything wrong…..How can they say that when still don’t know what they’re looking for. I am fearful to drive it and have great anxiety when I have to go somewhere. My business and working have suffered as I don’t want to take client’s, family or friends with me in my “NEW” car. This is not fair!

I own a 2008 Camery Hybrid and it is my 6th Toyota car that I have bought through the years. Untill now I have always raved about the reliability that Toyota cars have given me. Now I am scared to drive my car just worring that something might go wrong with the aacceleration while I am driving it. I hate asking friends to ride in my car due to safety concerns. This is a horrible feeling and it is not fair to all the Toyota customers that are driving Toyota vehicles. Can I join a class action law suite even though I have not experienced a problem as of 03/11/10

I have a2008 Lexus es 350 My husband purchased for me for my bday brand new. this morning I left my home to take my child to school i backed out of my drive way and started down the street when i noticed accelerator pull away from my foot, and my car “took off” I immedietly pounded the brake!! and they would not work.there were 6 childeren in front of me crossing the street walking to school! I thought to myself “god please dont let me hit them!” I swerved and threw into park. my car jolted for a bit and stopped. Thank GOD. I want in on the law suit. TOYOTA knew about the problem and did NOT give us a choice either! I am a mother of 2 and 5 step children . I am greatly disturbed by this.please anyone with advise…..

I just talked to my Toyota dealer this morning. he told me there are no problems with Toyotas. According to him, it’s all lies. I wans to join in a class action.

I would like to join a class action suit in California (Los Angeles). Can anyone tell me how I would go about doing this? I have a 2008 Toyota Camry and I am afraid to drive it. Prior to this car, I had a Lexus RX and had consistant problems with it lurching forward at a dead stop. Lexus of Glendale said there was no problem and it was a “feature” of a “smart car” that anticipates the driver’s needs. How lame is that? Even more lame is the fact that I believed them.

On 02/08/10 I WAS BACKING MY MOTHER ‘S 2005 CAMRY INTO MY DRIVE-W AY. I TAPPED THE GAS TO GET OVER THE GRADE IN OUR DRIVE-WAY. THE CAR SOUNDED AS IF I HAD PUSHED THE GAS PEDAL TO THE FLOOR . IN A SPLIT SECOND I HAD BACKED INTO MY OWN GARAGE DOOR. THE COST OF REPAIRS TO THE CAR AND REPLACING THE DOOR WERE OVER $ 5000.00 . THIS ACTION SENT MY MOTHER WHO SUFFERS FROM ALZHEIMER’S BACK TO THE MENTAL WARD FOR ANOTHER WEEK . SHE HAD TO BE PLACED IN ASSITTED LIVING AFTER THIS ORDEAL. SHE WAS CONVINCED I HAD DONE IT ON PURPOSE ! NOW WE ARE SPENDING $3600.00 PER MONTH FOR HER CARE !

I am terrified! I bought a used 2009 Camry with 20,000 miles already on it. They say that when the accelerator is worn, it is likely to surge. I have no mats and have had the recall “fix”; but I am still downright scared. Do I have any alternative?

I have a 2008 Toyota Solara convertible,. This vehicle has not been acknowledged by Toiyota as having an accelerator problem. It does however have the same engine throttle control system as the cars which are baeing recalled. Resesarching the internet, and listening daily to the news, I hear more and more talk about many experts believing the problem is not the floor mats, but a defective engine throttle control system. The most recent incident yesterday, March 8, 2010 in San Diego California, the driver reported the floor mat was not involved. Do I hae any recourse? I am afraid to drive my car!

I have a 2009 Camry XLE I have noticed it continue to accelerate a few times after I released the gas pedal I was not going too fast so applying the brakes worked. My dealer clamed they fixed it now by installing some kind of override for the brake pedal. I am still scared as hill to drive but I don’t have a choice. My Camry is by far the best car I’ve ever owned and I think if Toyota had been honest from the get go and not bs most of this could have been avoided. I want to know how I can be apart of this class action lawsuit?? Toyota is full of it and they should pay!!

My Cambry twice has surged and jumped 15 feet aprx, once in a parking lot (up over the curb &up the incline into some bushes) and another coming out of driveway into the street. I pushed down hard on the brakes (I was already braking) and put it into neutral. Thank God it stopped it. Both times I was coming to a “soft” stop and fortunately I wasn’t at a crosswalk or behind another car. It was extremely frightening. No mat in my car and I did NOT hit the gas petal. I wanted to trade this in but the value has decreased & I cannot afford a car payment. Toy gave me a case number and was concerned but said the 2004 Cambry had not been recalled. I asked a mechanic if he would consider putting in the part mentioned above by D Greg on 2/14 and he said he wouldn’t. It has to be the electronic system as I had no mat & I did not hit the gas. All I can do is drive it and pray it doesn’t happen again. I might add I have had the car surge while sitting with the brake on. It will surge then let off then surge again – but not w/ the pressure of the two times it jumped forward.

My 96 Toyota took off, in the snow, and spun around on two separate occasions, within 20 minutes. We were nearly crushed by a semi right behind us.

MY FAMILY OWNS 5 TOYOTAS. MY SON WAS KILLED IN A SCION XB IN MAY 2009. LAW ENFORCEMENT HAS NO EXPLAINATION ON WHY HE WAS UNABLE TO STOP HIS CAR. THE CAR WAS DAMAGED ON THE DRIVERS SIDE SO BADLY AND NO ONE KNEW ABOUT ALL THE PROBLEM WITH THE FLOOR MATS AND ACCELERATION PROBLEMS. WE HAVE HAD ACCELERATION PROBLEM WITH THE TWO TUNDRAS.

This Toyota problem goes back farther than 2005. I had a horrific accident in 1994 when my Toyota Camry took off like it was ossessed and I couldn’t stop it. I finally hit a tree to stop the car and I thank God there was no one else much on;the road ( Dec. 24th) I told the police what had happened and they wanted to cite me for drunken driving. I kept this car in my garage for a number of years but I needed to move and had to get rid of it. I lost my house and my job because of this accident. I still have a metal rod in my leg. This may not benefit me but it may help someone.

I lease a 2009 toyota and I experienced a problem in Dec. 09when I was going across the arch st bridge imaking a left turn and instead of the car slowing down when I stepped on the brakes it speeded up. I almost had an accident luckly I swirved out to the right so I would not hit anything . There was another time driving on the parkway south when my car would not stop. I took my car back to the dealer sometime late Dec. early Jan 2010 with the complaint, I believe I was told that my car was ok and later received notice in the mail of my first recall. Since than I have received two other recall letters. There uis also something wrong with the gears ,there is always a funny noise while driving like the gears are trying to change by themselves without me switching them. I am afraid to drive my car but I have no other choice.No one wants to listen, the dealership trys to downsize the problem but I bet they always want their monthly payments on time.

My wfie was drivig a new 98 Totoya corolla at 25 miles on a work zone when it suddenly acceleartred for no apparent reason. Since the roads were dug out on this strecth the car went out of control and hit the pavement. The result- mother-in-law sitting in the back broke her spine and nose. Car was totalled. We tried to complain but those days no one would listen. Toyota was the gold standard. Makes me wonder how pervasive this problem has been all along.

My wife was parking her 2009 Toyota Camry at the beauty salon, when all of a sudden the engine revved up and hit a suburban that was about ten feet from her car. I Thank God that the other car was there and that no one was hurt, but this accident caused us about $3500.00 worth of damage to our car and $5000.00 worth of damage to the suburban that was in front of her car, not to mention the increase in our auto Insurance for the next three years. I feel that we should be compensated for this defect on the part the Toyota manufacturer.

I have been a loyal Toyota customer for almost 30 years. I purchased my first Toyota in 1984 (Celica), kept this car for 10 years and traded it for a 1994 Camry LE, this one lasted 14 years. I was so in love with my Camry (even though there was a recall on this particular model due to a steering wheel problem) that I decided to buy another Camry, this time a 2008 Camry LE which I bought in December, 2007. This time I bought the car and paid cash for it, $23,000 . I figured it would be the last car I would ever have to buy since I am now retired and could not afford another based on Toyota’s “safety record” and reliability I would not have to worry. OMG was I wrong!!. When I heard that the acceleration problem was due to the floor mat getting under the gas pedal and jamming it I removed the floor mat on the driver side and threw it in the trunk. Now the carpet on my new car (only 2800 miles) is all stained, cleaning it does not help. Removing the floor mat did not help the acceleration problem either as I was backing out of my driveway two days ago and as soon as I shifted from Park to Reverse (which I always do with my foot on the brake) the car accelerated and I was lucky that I only hit the garbage bin from my neighbor’s house across the street from me. Thanks to my quick reaction I was able to stop it by putting the car in neutral and slamming hard on the brakes which by the way made a horrible noise. I am angry because I can’t buy another car, (I live on a fixed income), I can’t sell it because who in their right mind would buy this killing machine plus I am terrified of driving it for fear of killing myself or worst yet killing other innocent people because of Toyota’s negligence. I am also afraid that soon insurance rates will go up for people who own any of the recalled Toyota models. I would like for Toyota to refund my money so I can buy a safe car that does not pose a threat to my life and the lives of others. OMG I am so angry!!!
