Volvo Settles Transmission Class Action Lawsuit for $3M and Repairs

A federal judge has approved a settlement agreement reached between Volvo and 95,000 owners of XC90 vehicles that had defective transmissions.

In 2009, a class action lawsuit was filed on behalf of owners of 2003-2005 Volve XC90 T6 sports utility vehicles (SUV).

According to allegations raised in the case, the Volvo SUV’s transmission was prone to fail shortly after the standard warranty expired for vehicles less than four years old and with under 50,000 miles.

Last week, U.S. District Judge Claire Cecchi, in federal court in New Jersey, approved the Volvo settlement, which will in the auto maker paying for repairs to all of the affected vehicles, doubling the length of the warranty on affected vehicles and agreeing to pay $3 million in attorney fees. In addition, the six plaintiffs who brought the lawsuit initially will receive a $33,000 incentive award each.

The company also agreed to play half the cost back to customers who went ahead and paid to have their transmissions replaced, rebuilt or repaired on affected vehicles with less than 100,000 miles at the time of repair, as long as they were new or certified pre-owned at the time of purchase. The company will pay only 25% of out-of-pocket repair costs for vehicle owners of non-certified vehicles.

Judge Cecchi agreed to the settlement after receiving very few objections to the proposed term, saying that it appeared that plaintiffs overwhelmingly approved of the terms.

    I am still waiting on a respond after 7 years or more on my Volvo which I had to get rid of. due to serious water coming in from the sunroof. the electrical system shut down in the truck during a trip on west side highway and week i couldn't use the truck due to bad smell from the water damages.

    Believe it or not. I have a 2016 T6 inscription and I’m having transmission issues. Issues with down shifting and on highway stalls sometimes and doesn’t speed as it should. Poor volvo design! I know a few others with the same year and newer with some transmission issues and volvo won’t admit and say it’s normal! The problem keeps going with the newer models! Ridiculous!     I bought a 04 XC90 T6 with the GM 4t65e transmission that failed. The car drives nicely when all is in running order. I took it to the dealer in Orange County Ca and had a terrible experience. They said they would provide me with a loaner car while I had mine serviced for a Fuel pump recall issue. A rental car agent asked me to go with him to fill out the paper work and pick up my loaner car. I h[Show More]I bought a 04 XC90 T6 with the GM 4t65e transmission that failed. They sent me home with a list of services recommended. The transmission went out a couple thousand miles later. I have spent so much on this piece of crap, from the struts, strut seats (several times, another faulty component) to suspension bushings, engine mounts etc. This thing was driven on highways and roads for it's 100,000 miles. built to fail comes to mind. What a LEMON!!!! This is my first VOLVO and most likely will be the last, I won't buy another one especially from VOLVO of Santa Ana, Orange County whatever.

    I have a 2004 Volvo XC90 that's had 2 transmissions replaced. With just over 150k miles on it now the transmission is starting to slip again. This would be the 4th transmission (original, plus 3 replacements) if I go through with it. If there was initially a faultily designed initial transmission the subsequent replacement should last more than 30k miles.     My 2005 XC90 T6 developed a winning noise in the transmission. Took it to a mechanic and he said it was the upper bearing going out. Checked with warranty department and they said I was 500 miles over required maintenance so they won't cover it. Couldn't afford to get it fixed so had to continue using.     Am owner of 2003 XC90 with Transmission Problems, Did class action protect all owners of the faulty transmission or just the Attorneys and their clients whom initiated the suit. How do the owners of the vehicles get their due process.

    Can anyone tell me how I can get Volvo to replace my trans with this lawsuit. I bought this vehicle with 90,000 miles had an extended warranty for one year. Before the year was up the engine had to be replaced and the trans started to jump and jerk hard. I was told that the computer would adjust to the new motor but never did and it still continues to get worse. PLEASE HELP Thanks

We wanted a VOLVO because we both thought they were very reliable and safe vehicles but on 11/19/2017 the transmission service urgent light and check engine light both came on. So we took it to the dealer and they are saying new transmission. Having purchased a brand new Volvo back in the late 90'S with no issue's and eventually sold. We thought we made a good decision. The car runs perfect at first. Was great running to the local stores or picking up the grandkids from school. We finally had the need to drive a bit longer and on the interstate and that's when the reality of the transmission issue came to be after about 10 miles or 30 minutes. The 3rd to 4th gear shift would go to a neutral and not engage. I could manually shift to 5th. After a while the transmission light would state we need to service the tranny. Then came the large/loud clunk's mostly when slowing down. Volvo says I need a new tranny for $6,700.00. Please help... I mentioned the "GOODWILL" PROGRAM HOPING TO GET A BREAK/DISCOUNT but they said we did not qualify...... Volvo knowingly allows this vehicle to be sold to other non suspecting honest folks without feeling any responsibility to right a wrong! This is unacceptable! As we got caught up in the recession which nearly ruined our lives thru no fault of ours..... We have limited income. I look for some help in getting Volvo to own up to their responsibility for allowing this vehicle to stay on the road without fully addressing the problem's they were aware of from the get go. You know this was very wrong...corp. greed is at play here! Very sad!     I bought my 2004 XC90 T6 at a dealership in town. The car originally only had the indicator on that service was required for the traction control. I took it in to the dealership, they told me to take it to a Volvo dealership so I did. They told me the connector cord to my rear dem pump is out and it will cost $3300 ($300 for the cord and if that doesn't work then the additional $3000). Plus my sunroof leaks and I hear that was a known problem as well.Today my indicator came on that transmission service is urgently needed. I no longer have the warranty of course, not to mention that the place I bought it from is now out of business. I got Volvo because they are supposed to be good cars, but now I feel like I am trapped in a money pit. I can't afford to pay more than my car costs in repairs! I only just read about the recalls, can I still get help from them?!

    I have a 2007 S40 Sunroof was leaking after purchase. I was told turn on exhaust. After 5 years it was raining water, they told me I needed a new sun roof. I did get it paying $700.00. I'm a senior now it is raining again in my car. I called ?Volvo they will not return my calls. Why should I have to pay for a defect in the car? I purchased Volvo because I thought it was a good car. We started needing to replace the timing belt ($841.45), right after we had issues with the car's computer and was reprogrammed ($133.00) the issue continued and we needed to replace the car's computer ($1217.33). a little after that we had problems with the pass[Show More]In June 2015 my wife and I purchased a 2004 Volvo XC90 T6 since the day we bought the car we haven't stop putting money on the vehicle. We started needing to replace the timing belt ($841.45), right after we had issues with the car's computer and was reprogrammed ($133.00) the issue continued and we needed to replace the car's computer ($1217.33). a little after that we had problems with the passenger front axle shaft and needed to be replace ($275.98) we had another issue with the sunroof drainage and also was replace ($1133.11). Lastly three weeks ago the transmission started to slip and fail, we took the car once again to the dealer and now the car needs a new transmission (estimated on the $7000 range). the car recently pass the 102.000 miles, we already spend more than half of what the car is currently worth and with the transmission issue we could buy a newer car. At this point we really don’t know what to do, we recently heard about the 2013 lawsuit and we started to wonder if there is anything that it can be done.

    About 2 years ago I purchased what I call the money pit. Soon after I purchased my (new to me) 2006 Volvo XC90 the problems started. I didn't do my homework on the car and have paid a dearly. Everything from the computer mother board, radiator and now the transmission needs to be replaced or rebuilt. It has less then 100,000 miles and I don't know what to do at this point. Help :/

    My 02 volvo c70 has 105.000 miles I changed transmission fluid at 104 and the check engine light came on right after and has been shifting weird. I took for a diagnostic they said bad transmission. Please help.

    Shame on Shame on Volvo and the affiliated dealerships that made repairs to my 2003 Volvo XC90! There were Class Action lawsuits regarding my (GM)transmission and leaking sunroof drains! Never notified me and I paid for multiple repairs! #VolvoNeverAgain!

    I purchased my XC90 right out of the showroom in 2005 in Tempe,AZ whenever I had a problem I would take it in and since it was under warranty everything was taken care of. I did an extended warranty and it ran out in Dec 2015 and now I am suspecting that my transmission is going and I had it in the Phoenix Volvo shop prior for another issue and that's when they dropped the transmission to get to t[Show More]I purchased my XC90 right out of the showroom in 2005 in Tempe,AZ whenever I had a problem I would take it in and since it was under warranty everything was taken care of. I did an extended warranty and it ran out in Dec 2015 and now I am suspecting that my transmission is going and I had it in the Phoenix Volvo shop prior for another issue and that's when they dropped the transmission to get to the motor part and since then I started having problems with a thud on occasion 5X now in approx 6 wks time. Now I see that there was a law suit and now warranty and my vehicle has 77,000 miles this is so upsetting and I have taken care of the vehicle. Is there anything that can be done if it is the transmission now ?????????????

Volvo dealer had it for over six weeks and told me I should be glad I had a whole new front end! I said no, I spent over $50k on a car that has major problems less than a year. In 2013 the transmission went out with 50 K miles. Volvo Cars N.A. paid for the replacement including the radiator, all cooling linetc. under their "good will " program, no out of pocket expense to me. In Dec 2015 i tok it in and had several items of maint done including front suspension, and some motor work, the car was stalling upon acceleration, they told me there was oil buildup in parts and a bunch of other crap. they also said the radiator was bad. When I questioned them they said it was out of warranty and since it was paid for in good will program i had to buy new radiator $6100 later to took the car home after three weeks. The next day the "anti-skid" warning light came on, after another week in the shop they said the sensor was failing- ANother 1000, which i did not do. within one week of having it back, a pop noise was heard and a low growling sound was coming from the front end, Towed into dealer and after two weeks they told me it was the angle gear- a $4000 expense. after negotiation with Volvo , NA they agreed to pay for the part and i had to pay the 2100 labor. i agreed. another two weeks goes by and they tell me the angle gear is replaced but now the transmission is making a noise and Volvo will pay the 4700 to replace less a 1000 deductible. I think something is seriously fishy here.... PLEASE HELP ME> i dont have this kind of money and they want an answer now.

Almost 3 years of dealing with it getting worse and having to have my extended warranty company get involved, I finally found someone outside of volvo service department inform me that it was indeed a transmission issue, had it replaced, and never felt the hard jolting shift again. However, I am now told that, due to the many years of the stress that the jolting was placing on the vehicle, I need new engine mounts. The car sounds slowly over time has gradually gotten louder and sounds like the car is running without oil. (hard to describe sound). This is very frustrating to me mainly because I was having the issue with the transmission well before my primary warranty was up and that I basically paid for a new transmission because it was close to the same price my extended warranty was for it. A few years later, when I have this discussion with the service department, I'm told that, "unfortunately we are a small company and it's hard to ever get volvo to take care of these types of issues because it wouldn't be cost effective". With that being said, I guess Volvo doesn't mind staying small due to the fact no one has really anything good to say about them. I will never buy another Volvo. It was the worst experience. It's a shame that even with all of the complaints, they can get away with not having to take responsibility for major parts like a transmission. I have read that some owners have been in life threatening situations over this transmission issue. How is this possible?!!

Has had a new dashboard computer system installed, radiator replaced and now needs transmission repairs.     I had a 2002 volvo c70 with less than 78000 miles on it. I had just had the transmission serviced with a flush and fill by a volvo specialist in Woodbridge VA. After servicing, the transmission began slipping and acting badly. Three days later I was involved in an accident which totaled the vehicle with terrible front end damage.     I bought a 2006 XC90 in 08/2013 it current let has 111568 miles, I'm the second owner. The transmission service light just came up, I think the transmission went bad, I have done some research and found out that VOLVO was sued because this type of VOLVOS where built to fail. I need some help.
