Wage and Hour Lawsuits against Wal-Mart Settled for over $350 Million December 30, 2008 AboutLawsuits Add Your CommentsLast week, Wal-Mart Stores, Inc. announced that they have agreed to pay between $352 million and $640 million to settle 63 wage and hour lawsuits filed against the retailer in 42 different states. The lawsuits accused the company of cheating hourly workers by forcing them to work through breaks and not paying them for overtime. The wage and hour violation settlement may set a new standard for other companies who have been failing to pay employees according to the requirements of federal labor laws.In recent years, federal court wage and hour class action filings have surpassed employment discrimination class actions, with claims involving issues such as misclassifying employees as salaried or independent contractors, failing to pay for “off-the-clock” work or on-duty meal breaks, denied reimbursements and miscalculation of commissions and bonuses.Do You Know about…Spinal Cord Stimulator lawsuitsSpinal cord stimulator lawsuits are being investigated for individuals who suffered unnecessary shocks, burns or other problems, often resulting in the need for additional surgery to remove the SCS.Learn MoreSEE IF YOU QUALIFY FOR COMPENSATIONDo You Know AboutโฆSpinal Cord Stimulator lawsuitsSpinal cord stimulator lawsuits are being investigated for individuals who suffered unnecessary shocks, burns or other problems, often resulting in the need for additional surgery to remove the SCS.Learn MoreSEE IF YOU QUALIFY FOR COMPENSATIONClass action wage and hour lawsuits against Wal-Mart have generated a significant amount of media attention, as the retailer is the largest private employer in the world. The company has lost high profile lawsuits over wage violations in California in 2005 and Pennsylvania in 2006, which resulted in verdicts of $172 million and $78 million respectively for Walmart employees in each state.Earlier this month, Wal-mart agreed to pay $54.3 million to settle a wage and hour class action lawsuit brought on behalf of workers in Minnesota, after a judge found that the company had violated wage and hour laws more than 2 million times.Under the terms of this latest settlement, current and former employees in 42 states will receive at least $352 million, and the payments could reach $640 million, depending on the number of claims submitted by affected workers.According to the New York Times, the Walmart settlement resolves all but 12 pending wage and hour lawsuits against the company. Some advocacy groups have suggested that Walmart settled the claims to avoid becoming the target of increased wage and hour enforcement that is expected under the Obama administration. Hardly ever get my breaks and thursday I was threatened after a Year and half if I don’t step down I will be wrote up till I get fired.this happened Thursday around 130 when the GM took me to his office alone no witness and shut the door with a piece of paper over the window. I was threatened and a bit uncomfortable when he said he has always been fawned of me. Georgia August 28, 2012 yep it sure was difficult working for these folks esspecially the ones that have to put their nose in everyones business and not tend to their own. Amorette E August 13, 2012 So I just recieved my settlement check rom he overtime issue. Funny thng is that one day I open my mail after depositing the whopping $175 check to find out that the account the check through Wal-Mart was written from ad been closed. Oh yeah now the check for $175 has cost me $207 because the check was no good. Oh hell…. Jordan August 8, 2012 I worked at Walmart and I was only there one day. They fired me the next day because I supposably lied on the application because I didn’t have my licence and that in 6 months I could re-apply, (of corse that was a lie). I went home and called bobby ore and he said I had to wait the 6 months. So I waited and tried to fill out the application and it said that I was not available for rehire. So I then called Jim McKay and the first time I called him he said that he couldn’t understand why I was fired cause I was a greeter in tle so he said the greeters in tle didn’t need licence. Now its been 2 and a half weeks since he called me and told me that the Walmart I worked at said I wasn’t available for rehire cause I faulsafied employment documents when I didn’t. The Walmart I had worked at said I didn’t need my licence to be a tle greeter so did Jim mckay and now he tells me I do. But he also said that he has to contact regional and its up to them to decide what the compensation will be and I can now not get a hold of Jim McKay and I am starting to belive that Walmart corp. is saying and telling me things just so I might forget about the whole thing. Paula July 17, 2012 well news update.. even tho i am still healing up from my knee cap injury i got a pending lawsuit against walmart via workmans comp in indiana coming up pretty soon and i got an atty too larry July 8, 2012 I went homeless working for this company they dont appreciate nothing Marie June 18, 2012 from my knowledge as a past employee. nobody gets over time hours unless u are a FT employee. so trying to fight for back pay isnt worth it..most those who are hired on now are PT employees .. wish i could help you out more but i was injured on the job and got terminated recently while injured so i have my own court battles to deal with and loss of income included Paula June 15, 2012 Well i started at walmart in 2010 as a cashier.. worked my schedule.. was absent a few times.. had surgery in feb 2012 which i was on medical leave for that.. about 19 days.. came back to work .. did my job.. was working on a register and tripped on a loose cable underneath it .. thus result tripped and landed on my left knee ..the mgmnt argued with me over an ambulance after they helped me off of the floor.. i know i passed out for a few minutes they didnt care..they never called MEDCORP to report the accident, as they were supposed to i ended up going home myself and iced my knee cap.. woke up to it swollen .. clinic they sent me to .. didnt even realize i had a hairline fracture of the knee cap till i was back at the clinic 2 1/2 days later.. well now i got fired for taking days off on acct of the knee injury and the pain i was in … guess i am supposed to go to work in frigging pain while on meds that put me to sleep? ok so who wants to go against walmart for me.. i called the clinic to let them know i wasnt sure about making it to my appt to see the dr at the end of the month which i was scheduled off.. and also called a friend to let them know of this too .. the asst mgr who fired me asked if i wanted to sign something and i said HELL NO.. gave her my id badge and left.. one of the support mgrs said they didnt want anyone to know i was fired? well as of today i am sure my fellow associates know i was LET GO.. nice i was canned on acct of my knee injury.. great nice going walmart…. least some of the mgrs who trained me care enough to stay in touch.. but the mgmnt at my store sucks.. lets see u fall on your knee and fracture it and lets see you get lousey medical care.. and deal with the pain and have no pain meds.. lets see you walk around in my shoes and see you cry when the pain meds dont work.. then lets see mgmt fire you for the days you took off and lets see how you deal with paying rent and utilities etc.. i am waiting to see how you feel being in my shoes!!!!!!! DOROTHY June 12, 2012 I WORKED AT WAL MART 3 DIFFERENT TIMES HARDLY EVER GOT BREAKS AND WAS TREATED LIKE A DOG JUST LIKE ALL THE OTHER EMPLOYEES HARDLY ANYONE IS STILL THERE THAT USED TO BE NOT THAT I BLAME THEM ALOT OF PEOPLE THAT I WORKED WITH GOT SETTLEMENTS AND DIDNT EVEN WORK THERE AS LONG AS I DID DOROTHY June 12, 2012 DONT UNDERSTAND WHY I NEVER RECEIVED A SETTLEMENT FROM WAL MART I HELPED OPEN THE ONE IN MAC ARTHUR WEST VIRGINIA HARDLY EVER GOT BREAKS Tracey June 8, 2012 I would like to know, where to on, The Wal-Mart Vision Center Manager Overtime Suit. How do you know, if you’re Included on this? Is it all vision center managers, that worked before 2007? Is there a sight to go to, to view names or amounts? Lisa May 11, 2012 I worked for wal-mart from Aug. 2008 through Jan. 2012 when I was fired. They told me there were to many customer complaints against me and they fired me. Everytime I was pulled in the office for the complaints, they told me they were called in complaints except i think 3 or 4 were at the store. Everytime I asked them what they said I did to the customer for them to complain, the management wouldn’t answer. They always said that they didn’t take the message so they don’t know the cercumstances. Well if I am being yelled at for something like this I think I should know what I am doing. One time I was pulled in the office, I was disrespected my management. I think if they expect us to respect them I think employees should get the same respect. They told me that retail was not for me and that I should just look for another job. Also they said that I should be greatful that I had a job. Then the more I was thinking about it. Why was it such a big secret not to tell me exactly what the customer said I done to them to lodge the complaint in the first place. How do I know if those complaints were even me. There was another cashier named Lisa also. Also there were several times where I worked over 40 hrs. in a work week and many people said that wal-mart is suppose to pay time and a half. Don’t know if that is right or not. If so I would like to get the money they owe me for the hours I worked over 40 hrs. I wish I knew. Several times I was called on my days off to come in and work, other times if I was close to going over 40 hours I was told to take 1 1/2 hr. lunches to cancel out the time before I reached over the 40 hr. mark. Several times I didn’t get my 15 min. breaks because they forgot to tell us to go on break. We had to be told by management when to go on break before we went to break. They got busy half the time and forgot about us. then they told us to to take a longer lunch to make up for the 15 min. break. I think they break the rules to much and we can’t do anything about it because they are management and who will listen to us the employees. NOONE!!! I also find that management sticks up for each other but noone is there to stick up for the employees. I am kind of glad not to be working for Wal-mart. It was the worst place I have every worked at in my whole working career. When you needed time off they were not willing to give you the time you needed. I missed pretty much the whole season of my daughters field hockey, because the couldn’t give me off because we were short handed so was denied the time off. Which I don’t think was fair at all. Also I like when I told them I can only work certain hours because of my husbands work schedule and my 2 kids, they said to me you work our hours or you can look for another job. I really don’t think management should talk like that to their employees. Everyone tells us wal-mart helps their employees, I just didn’t see it. Well thank you for listening to my ranting. Just wanted to know if I am in the wrong or does someone thinks I am right. I would like to know how to be added to possibly get back pay they owe me. I haven’t received anything in the mail about the wages lawsuit. My friend called me and told me about it. Judy Q March 13, 2012 I was a overnight stocker, worked in a few different store in southern Missouri, treatment was all the same, drove you like cattle had to wait on the break calls, told we couldn’t leave until everyone department was done meaning we had to go help food department finish, not getting out until 8 or later, forced to sitting in break room to take off hours at times it was up to 2 hrs at the end of a pay period.. Could not come in later or get off early. I shared a ride with another worker who started an hour earlier, I asked many times to start early if I was there, but when I asked can I get off early was told no so that was my answer, so I waited until it was time to start, knowing it would be late getting out. I called home office and asked if I had to stay as the managers were telling me and was told no once my shift was over i could leave, so I passed that on to the next co-worker, really did not matter we were locked in and could not leave even off the clock. I was considered a WAVE Marker and watch as a union starter, which most all my co-worker acted like cattle and wouldn’t listen when I told them home office said we only had to work our shift. Honestly that is what is wrong with Wal-mart they make to do that stupid cheer just to see how far they can make a person jump, then take complete control on your time on and off the clock while locked in, If there was a union and if the people WOULD stand against these treatments then they would be forced to comply with the labor laws and not brain wash the employees that they pay the best in town and have your best interest at heart. I did my job and did it well but I seen other who just collected a pay check and was told by my store manger when I was over heard telling one of these lazy ones to get the Fxxx away from me, I work for my pay check while he walked around carrying the same box for the last 20 minutes just collecting his. The manager had the nerve to tell me that there are workers and there are not workers and I need to learn to live with that and was told I was not a team player. I was sick of all the crap and being patted on the back and told we were the back bone to the company and having our store’s 300 thousand dollar days rub in our faces while making a few cents more than minimum wage, having to work almost 4 hrs to buy a package of steaks.. During one of these fake pat’s I asked for our crew to get a raise, and was accused of asking only for myself in front of every one. I was called in the office many times because I stood up for my co workers and reminded often that a union was not needed in Wal-mart because they looked out for their employees with out my help.. Never asked to sign anything so there were no records of these meetings. They keep the crews small so they can control them for if they were big a union would be possible. But if it were to spread through out all of wal-mart they wouldn’t stand a chance of stopping it. I would say a UNION is needed at Wal-Mart and start making them jump through the hoops they have forced the employee’s to do for many years. If they would hire me back I would make that my goal and break Wal-mart of it’s abuse. I pray that someone who can help, even a few can understand that this is the only way, will take this seed and help it grow and make wal-mart a great place to work. You have the power, you just need to stand together, these law suits are nothing just a small drop in the money they bring in and the little they pay employees other than management. Law suits won’t stop the abuse, Wal-mart just pay the court orders and find ways to get around it because there is no one who can stop them as a individual and thinking you can just quit and boycotting doesn’t help unless it is a mass of people. I haven’t received my check on this suit, got my letter telling me I was part of it a few years ago, but I would gladly sign it over to a union rep in order to bring wal-mart to a new understanding. If every one from this one law suit did, it would be one the biggest and strongest Union in the world funded by Wal-mart it’s self. Better than a slap in the face. Think about it… It is the only way people, United you’ll stand and divided you will always remain victims. John March 5, 2012 Marsha, I’m just outside of St Louis. I’ve heard from a few others at work that they have received check(s) also. Some, like me got one check with both parts in it. Can a Walmart Manager OR a supervisor make you wait past your scheduled lunch break until up to 10 to 15 minutes till you would get a meal violation? example. lunch break schedule 10pm to 11pm. they would say your not allowed to go till 10:30 to 10:45pm having you to work while on lunch without any time adjustments made. Doris April 20, 2011 I worked for Wal-mart from 11/2007-08-2010. I started working in the grocery backroom doing inventory and stocking. I got moved over to general mechandise side unloading trucks. I did this because I was asked by the asst. manager. I was told I would not have to get on the truck just to pull the things of the line and put them on a pallet. Well we got a gun ho younger woman working in the back room and now we all had to start unloading the truck. We were given and hour to and hour in a half to unload. Well I got hurt and written up for unsafe working when I was helping a guy move futons. I man who started after I did was making $.50 an hr more because he supposedly had more experience than I did. He worked construction before starting. I worked retail for several years. How is that more experience? I quit because of the injury and the threat of a write up. According to the handbook they would have fired me. I got a d-day, anyone working for walmart knows what that is. Because I left work to rush to the hospital because a family member had a stroke and was in a coma not knowing if they would live or not. I would like to know how to get in on this law suit. I have not been able to find a job since I quit. diane April 10, 2011 I never received anything for the interupted breaks and meal times. can we still submit? and where do we get paperwork from.
