Wage and Hour Lawsuits against Wal-Mart Settled for over $350 Million

|

Last week, Wal-Mart Stores, Inc. announced that they have agreed to pay between $352 million and $640 million to settle 63 wage and hour lawsuits filed against the retailer in 42 different states. The lawsuits accused the company of cheating hourly workers by forcing them to work through breaks and not paying them for overtime.

The wage and hour violation settlement may set a new standard for other companies who have been failing to pay employees according to the requirements of federal labor laws.

In recent years, federal court wage and hour class action filings have surpassed employment discrimination class actions, with claims involving issues such as misclassifying employees as salaried or independent contractors, failing to pay for “off-the-clock” work or on-duty meal breaks, denied reimbursements and miscalculation of commissions and bonuses.

Class action wage and hour lawsuits against Wal-Mart have generated a significant amount of media attention, as the retailer is the largest private employer in the world. The company has lost high profile lawsuits over wage violations in California in 2005 and Pennsylvania in 2006, which resulted in verdicts of $172 million and $78 million respectively for Walmart employees in each state.

Earlier this month, Wal-mart agreed to pay $54.3 million to settle a wage and hour class action lawsuit brought on behalf of workers in Minnesota, after a judge found that the company had violated wage and hour laws more than 2 million times.

Under the terms of this latest settlement, current and former employees in 42 states will receive at least $352 million, and the payments could reach $640 million, depending on the number of claims submitted by affected workers.

According to the New York Times, the Walmart settlement resolves all but 12 pending wage and hour lawsuits against the company. Some advocacy groups have suggested that Walmart settled the claims to avoid becoming the target of increased wage and hour enforcement that is expected under the Obama administration.

last year around sept.2009 I was sent a packet to fill out to be compensatated for the time I was made to work off the clock by wal-mart,I sent it in to Minnesota, i have not received a cent to date, is someone taking the checks and cashing in on them, everyone makes out but the employee. I had to work every lunch, in which I had to clock out, because wal-mart said they had no one to cover my lunch break While I worked for wal-mart, I busted my butt for them, with little compensation.I also went to other stores to pick up merchandise on my own time, and was never paid. i just wish someone knows what happened to the checks?

Sherry
I was Automotive Dept. Mgr. and was paid less per hour then the men and I did all the work in the Dept. They tried to put everything on me so that I would quit.

KNEQUA
I WAS INCLUDED HOW DO I GOT COMPENSATED IF MY ADRESS CHANGE.

doris
all i have heard is that they are going by alphabedical order. I have read on some web sites that people have gotten them but the ones who did not send in there papper work did not get them. walmart has not changed and people are still working off the clock and are having to adjust there time. They wont say anything because they do not want to get fired. Thy are finding so many different ways to fire people. Now they are hiring but only part time and you are only a temp so they do not have to pay out insurance. The sate makes it mandatory to have ins you pay for it but cant use it because when you get sick you have to pay to much out of your pocket so what good is the ins you just stay sick.

char
I worked for crapmart for 8 years . Went to the doctor to get papers filled out for medical leave took them into personnel and got fired!!!!!! The managers at walmart suck they care nothing about you all they want is a fat pay check and big bonus. checking in with the labor board to see if I have a claim against walmart. This company is downsizing want people to do three or four peoples job for crap wages. wish everyone best of luck. Hope you get money from walmart. What walmart needs is a UNION, that way they could not treat people the way they do. wish I knew what happened to my papers for working in a locked building, do any of you know about that case?

Lori
When is the money going to get here ????? Has anyone received theirs yet???????

I worked for wal mart about 6 months, I was hired for the beauty and cosmetics dept., after being hired, I would have to work four and five different dept. in a night, they would buff or strip the floor every night using ammonia and other chemicals, I have a very bad case of sinus problems, I told the manager that I could’t stand the smell of those chemicals, we could wear one of those little face thing to go over your nose, I got sick one night after inhaling in the fumes. I went to the doctor the next day, I was taken out of work for a week, the said he advice me not to work around those fumes, I asked him could he give me a doctor excuse stating that I couldn’t work in those fumes, he said he couldn’t because he didn’t know for sure if thats what was making me sick. I ask the manager could I be transferred from a stocker to a cashier, the answer was no. I told him that I wanted to talk to the store manager, I talk to her and explain the situation, and she of course said no, so I quit.

I was the one who started this lawsuit in Trinidad,Colorado which was settlted in December 2000. I was an assistant manager at Wal-Mart that was demoted because I refused to write-up two associates for not completing their job assignment. I told the manager that I cannot write-up these associates because they are doing their best and I can’t ask them for more. I will be the first to write-up or terminate a poor performer. I told him that for the amount of work that we ask these associates to do, for the amount of time to do it, it’s not enough time! The only way they can complete the job is to force them to work off the clock! is that what you want me to do Bill? He didn’t deny it, he just turned and walked away. I was demoted for not being a team player and I was not Wal-Mart material, though I increased my sales 20%. I am glad that there are other people who will standup for what’s RIGHT! That’s the American way.

Kendra
I have emailed the lawsuit firm twice about the $$$ and was told both times to be patient that they were in the process of “validating” the claims and deciding on distribution. BS

Carolyn
Where is the $$$$$$$? How much would each person will recieve, and how soon!

I started working for sam’s club in alabama in 1989. my first job was in outside sales. this involved go into walmart’s in our area and signing customers and employee’s for sams membership cards. the area we covered had 8 wamarts and I had to work all of them each month. another part of my job was to work business owners in our area calling for appointments and then going out into thefield to sell cards.because I covered so many miles each day there was no time for breaks or lunch breaks. If I didnt come back with all the apps I had listed on my call sheet my team leader always called me into a meeting .I also had to schedule setups a large business’s or corporations to sell advantage card to the employee’s. the management scheduled the times for the setups. I had several that had three shifts- I had to be there for all three shifts.24 hours straight.on alot of my setups management told me to go straight to work from home and they would clock me in work. after working there for 2 years and traing sales associates both men and women a male I had trained told me he made $2.00 more an hour than I -I went to my manager and told him about my info and he did give me my raise.-honest. I worked for sam’s for ten years and was paid 37 hours the entire time. like all the others who came and left I knew it was time to more on and out. after 5 years the lady over personal called and ask me to come back. I did work there again but not in sales. I worked meat dept. I wanted to go home at night after a regular shift. we all no that didn’t happen. a male membered started coming in and started huging and touching me while I was on the job. I went to management and told about what had happened knowing that the camera’s had caught the action but was to told by management that I was too friendly to everyone. In the same meeting I was told I had received my raise. I told him to let me see the pictures of the man grabing me – he said it was against company policy. at that point I quit for the last time. I told him I cant work for a company that protects the menbers for the dollar rather than their employee. my co-workers to begged me to go above the manager but after you have been screwed so many times by the same people- you just get enough. thanksfor letting me get this off my heart. I believe that what comes around goes around .finally wal-mart may get whats coming to them.

Donna
I also have been working at walmart and I will be going on 12 years soon. I would not recomend anyone to work there now. When I first started there I enjoyed going to work. Now its like we are slaves in there. In my store there have been so many associates who have gotten coachings and D days for ridiculous reasons. They dont care if you are sick and they are certainly not family oriented anymore. They have fired people recently that have been working with the company for 7,10 and 15 years. They must have done something right to have worked there that long. Its crazy!!!! As far as breaks go, what is that????? I still dont always get my breaks. They never have enough coverage because they are always letting people go and not hiring anyone else to fill the positions. My pay and my health insurance is ridiculous!!! I think that walmart should be fully investigated. I wish I could find another job but the economy stinks right now. Im not even making 12 dollars an hour yet and I have been there almost 12 years! Sam Walton would be upset by this….its really to bad.

Donna
I have worked at walmart for almost 12 years. Im very unhappy going to work now. When I first started it was a family oriented company. If you were ill they would understand. Now they could care less how sick you are. They are constantly coaching people on stupid things. I have seen so many people get D days lately that its crazy. Associates that have been there years, like 7,10 and 15 years have been getting fired for uncalled things. What is wrong with this company. Dont they know that it is the associates that make the place run. I feel like they want us to be robots in there. No one is happy in my store. We still dont get our breaks all the time!!! I also get shit for pay and my health insurance sucks….I only stay there because I have no choice at this time. I think they need to be fully investigated. I would never tell someone that walmart is a great place to work. Sam Walton is probably turning over in his grave…

I SO AGREE WITH THE ABOVE COMMENTS BY SO MANY OF YOU. I TOO WORK FOR WALMART AND HAVE WORKED MANY HOURS OVER MY SCHEULED TIME AND THEN TOLD I HAVE TO KILL(give back)THOSE HOURS THAT I WORKED THAT ARE RIGHTFULLY MINE. THIS IS A DISSCRACE FOR SUCH A HUGH COMPANY TO GET AWAY WITH THIS, PLUS THERE IS SO MUCH MORE TERRITORY TO COVER ON THE WAY WALMART TREATS THEIR EMPLOYEES. A COMPANY THAT MAKES OVER A MILLION DOLLARS EVERY SECOND OF EVERYDAY, AND THE BIG SHOTS REAP THE REWARDS, WALMART KEEPS THEIS EMPLYEES ON A STRING JUST LIKE PUPPETS. WELL I AM WILLING TO GO TO THE END TO STOP SUCH HORRIBLE BEHAVIOR FROM THIS SO CALLED FAMILY COMPANY.

Steve
I worked @ wal-mart for almost 5 years. First I was unloading trucks. Then, I worked in the paint department making 7.40 an hour. They treated me okay for about the 1st year. But after that, they cut my hours, moved me to a different department (my pay went down .40 cents), and made me work while I was off of the clock or during a break sometimes. I hope the checks get sent out soon. They deserve what they got anyhow.

Wondering
I have a relative that just go some money from a lawsuit against Wal Mart and we all got the same paper in the mail but 2 of us ignored it except him and he got some money. Now I want to know how can I get mine?

patty
where is the $$$$$$$$? when do we get it? how much is it?

clutch300
OK, walmart lost the case, show us the money! I filed the claim and have seen nothing! Walmart is still doing it and worse. I encourage everyone to make formal complaints against walmart with the EEOC, they at least stop harassing you because they know you will take them to task. Bentonville doesn’t care, and tell the managers to lie, so they don’t have to pay and can keep their jobs. Keep a journal, take copies, and list times and dates and places. Why? Walmart has a tendency to lose paperwork and change the employment agreement unilaterally. I have worked almost 5 years at walmart and have it with managers breaking their own rules, but managers never pay the same price as associates. If an associate does it they are fired, if a manager does the same thing, nothing. Totally discriminatory! If we don’t stand and fight, walmart will never stop!

carl
Please tell me if anyone Knows for sure when the checks will be sent out

asa
like i was saying you work 80 hrs and they pay u for what they want to and when u bring it up they talk trash about it and when they did decide to pay u out of the cash office they tax your money again. i feel that anybody ever employeed by walmart is entitled to something because walmart has to much money to do and pay people the way they do. i was employeed with walmart from march 25, 04 – june 5, 07 store 2606

asa
i worked at walmart for 3 years and thay started me off with 6.50. They hire u for one position and force u to do ten other jobs for the same price. Your hrs are never right and you bring it up the manager talk trash about

sharon
I agree that walmart does not care about their employees anymore. when I first started back in 2001, I really thought walmart was a great place to work. now I think they are like slave drivers. I see some managers just walking around all day not doing a damned thing and people like me working my ass off. they dont care if customers are waiting to be helped in the paint dept, they will try and get someone else to help them instead of doing it themselves which would be the right thing to do. we never have enough help out in tle or anywhere in the store for that matter. god forbid if someone calls in, we are assed out with cars backed up to lawn and garden. then they want to start coaching people for job performance. how can you get a car done in ten minutes if you are working upper and lower bay all by yourself. mangement dont care. iI told them we need at least two people in the shop at all times and could they at least hire 1 or two more part timers for coverage, but NOOOOO!! now with all the restructuring they are doing with zone managers and department managers having to cover 2 – 4 areas by them selves, it is bullshit. what do they expect from people. we never get our breaks on time if we get it at all.I have had to take short lunches just to get back and help others so they are not doing work by themselves. walmart is not a good place to work anymore.

gwen
If you got a break, good luck. when I did get one, I was paged back to my department before my break was over. No overtime, had to leave early during the week to take it off.

wanda
I too worked for Wal-mart. My breaks, I didn’t get many. sometimes none. Could not get lunch in four hours.

gwen
i worked for wal-mart 7 years. sometimes get lunch until my time to be off the clock. and breaks you could forget them. you would be pages to come back to your dept.before you even get started. management will ask you to work over and promise to pay overtime. at the end of the week, a overtime sheet would be posted by the time clock, with your name ,and overtime hours. you would have to leave early to take off the overtime.

tina
I was working for Wal-mart TLE for almost 3yrs. when I was called to the admin. office and was told that I was fired for cussing at a “zone manager” I did not do this, had witnesses to the fact that I did not do this, but because it was a “zone manager” and I was just a worker, they took her word over mine and I want to know what my options are as far as being falsely accused and terminated. I do not want this on my work record as it will make it even harder to find another job somewhere. So many other associates have been terminated from this one store it would make your head turn!

Lori
My husband and I both worked for walmart. It is in my opinion a horrible company to work for. I have bad knees. And one christmas I was in electronics by myself. handling phones, and customers. I finally said you get me help NOW. which of course they did not. I even had a dr’s note to sit when I needed too and they gave me hassel for it. Im glad my daughter chose not to work for them. But on the other hand lol I am happy to be gertting money back from them!!!

Nakia
I would like to no when will the money be sent out? I worked for wal-mart in I had to do other people work and work off the clock.

Randy
Well folks it’s not just an hourly problem, salaried management works a lot more uncompensated overtime than most of them realize when you look at my salary per year it looks pretty good but when you break it down to the hours I actually spent in the store I made less per hour than most 10 year veterans. And since I was salaried who cares if I got a lunch I was always on the clock from the moment I drove on the lot. Roberts description of walmarts management style above only scratchs the surface in reality its like living in a “fascist” state, under the threat of job loss at any moment. The upper echlon use “buzz” words such as direction, expectation and accountability…just words for I’m gonna give you more work than is possibile to do and then fire you when you can’t do it if they want to. I mean look at it this way the job seeker pool has increased by a couple million people so why not take advantage to get rid of the old timers that made walmart. I have seen over the last year market managers, store managers, assistant managers and hourly supervisors all with over 20 years make the choice to retire vs. getting fired. Me… I’ve never quit anything in my life….and have always taken care of my “people”…so where does that leave me…you got it…unemployed

Tracie
I was wondering if anyone heard if we are getting anything out of this lawsuit cause I filled my papers out and haven’t heard a thing in months and sure could use the money to pay alot of bills off. I worked for Sam’s and everytime I took a break I was always called back cause lines would get back up and didn’t have enough cashier working to cover.

Karen
Wal-Mart is still violating these policies. At the store I work in we are scheduled for at least 5 hours at a stretch with no breaks. If we take a break we are required to ask another associate from another dept to cover our breaks or lunches when no one is scheduled at all to help in your dept. Asking management to find another associate for you only results in them telling you to ask someone to do it not their doing their jobs and finding coverage.

Henry
I work at walmart now as a truck unloader and the pay is terrible i cant seem to catch a break either. My breaks are already forced to be taken after the truck is unloaded and if necessary set up for the following truck. the shift is 4 to 1 and i can find my self not geting my first break until 730ish… Just before the new overnight manager showed up i remember going to lunch at 1130 on occasion which is way against regulation. and finally i can probably go back and see that ive had more days where ive had to skip my last 15 to go home on time versus actually taking a 15 at all. The Walmart i work at sucks big time.

jason
I worked for walmart in mass and I got run over by a fork truck and broke my heel.as a young man that didnt know any better, I was told that I have to take my 15 min break and put some ice on it. When I came back i wanted to go to the hospital, they told me to go back to work or they would fire me for being a insubordinate baby!

Lisa
I worked for walmart for 3 months in 1998-99, and that was long enough. They would intentionally schedule people to close on Friday and Saturdays who they knew would call in, leaving the 4 or 5 of us who did show up to close the store. I was told by managers that the GM did that to keep payroll low so he could pad his bonus. The last night I worked was a Saturday. Several hours before closing, when it was obvious that it would be another night of the same, I clocked out, had one of the managers paged to the front, handed her my smock and badge, and told her what she could do with her crappy job. She said, “Well, I’ll have to put it down as walking out in the middle of a shift.” I said, “Good, cuz that’s what I’m doing.” She said, “Well, it means you won’t be able to come back.” I said, “Now why the hell would I want to do that?” and walked out. A satisfying end to the evening, without a doubt.

When I started at Wal-mart I was vary happy. Sam was still alive and he truely meant we are family. I went from sales floor asst to dept.manager to cash office, upc & clams, to traveling to other stores checking for mistakes then to support asst. manager since our store was small my job actuality was the same as a asst manager.{only I was hourly} My Job was on the line all the time .I would work of the clock all the time too.Sam had died about 4or 5 yrs ago know. I was taught by Sam that your associates are people if you treat them with respect. You will get it back. I was always fighting for them against upper management on a lot of tihings. Then I got breast cancer and had to be gone for 1yr & 3mouths. I got my job back ,but since I could not give 120% only { 100%} I got put back to Dept Manger .They where going to drop my pay , But they now better {remember I was a fighter and that wasn’t going to happen} About 3 mouths later I had to get more surgery done , And management was writing me up for every thing. So with my health on the line I lefted. I hope we all get what they took away for us -our respect and value on life and time. Stay strong we can do it !!!

matisha
i was working for walmart for the year of 2009 plz tell me what to do i got one of the papers in the mail to sue them but i didnt know what to do with it thank u

Earnest
I HAD A HEART ATTACK WHILE WORKING FOR WALMART. OVER WORKED TRYING TO GET THE JOB DONE.NO BREAKS WORKING OFF THE CLOCK SHORT LUNCHES. THEY DO NOT CARE ABOUT YOU. THEY WROTE ME A WE DO NOT NEED YOU ANY MORE LETTER. AFTER I COULD NOT RETURN AND CANCEL MY INSURANCE. AFTER ALL THERE WAS NO WAY I COULD RETURN. I REALLY NEED MINE. I SURE HOPE IT IS SOON.

tim

chris

Maxine
I had called the people that sent to claim forms out, This was in october 2009, They had informed me we would receive the checks in feb, now reading all new comments, it’s a lie, My Husband says wal-mart is keeping the money in a high interest account, until they recoup what they will lose. My husband says we all should sue for interest. I know how wal-mart works, SAM is rolling in his grave. He was a fair and decent man.

Ashley
They are trying to get rid of the older associates that worked there 15 years and when sam was alive. My mom worked with them 20 years. She ended up getting sick and when she told them she needed days off and requested them 3 months in advance they did not give them to her once she ended up sick and told them she needed to go to appointments they told her basically your health or your job. She was fired in Nov 2009 She tells everyone that works there get out they are not worth your life. She is going to school now and is very happy.

Anthony
I WORKED FOR WAL-MART IN FLORIDA FOR 9 MONTHS AND DECIDED TO MOVE TO TENN. WHEN I APPLIED FOR A TRANSFER I WAS TOLD I WOULD HAVE TO TAKE A 1.80 CUT PER HOUR BECAUSE YOU DIDN’T NEED THAT MUCH TO LIVE IN TENN. AFTER WORKING AT THE TENN. STORE FOR ALMOST TWO YEARS I WAS FIRED FOR COMMING BACK FROM LUNCH 5 MIN. LATE.WAL-MART SAID IT WAS FOR MISCONDUCT. UNEMPLOYMENT SAID THERE WAS NO MISCONDUCT AND I COULD MAKE A CLAIM. I’D RATHER WORK IT HAS CAUSED A LOT OF HARD TIMES AND PROBLEMS FOR ME AND MY FAMILY .WHEN THEY FIRST FIRED ME I WAS TOLD NOT TO TRY TO COLLECT BECAUSE WAL-MART ALWAYS WINS. I DON’T THINK IT’S RIGHT FOR WAL-MART TO PLAY GOD WITH THEIR EMPLOYEES LIFES. THEY SHOULD BE MADE TO PAY FOR THEIR ACTS . THIS LAWSUITE AND WHAT WAL-MART WILL PAY OUT IS NOTHING COMPARED TO THE HEARTACHE THEY HAVE GIVEN TO THOUSANDS OF PEOPLE WHO PUT THEIR TRUST IN THEM. AND AS FAR AS THE OWNERS THEY ARE SO RICH THAT THEY COULDN’T CARE WHAT GOES ON IN THE STORES AS LONG AS THEYKEEP GETTING THE BILLIONS AND BILLIONS . AFTER ALL WHEN THE HEAD CEO CAN MAKE 26 MILLION A YEAR AND YOUR PAYING 13.000 ON THE AVERAGE YEARLY TO YOUR EMPLOYEES WHY SHOULD YOU WORRY?

John
I work for walmart and was asked to perform another job duty and they never paid me for doing the job. I worked extra hours and feel used. Walmart is know for using people

Sharlena
I started off in marketing for Sam’s club. After 6months I was transfered to the front end of the club as a COS (front end supervisor). I was in this possition for 1 1/2 yrs. Last October I was diagnosed with Lumbar Scoliosis. I was taking off of work for 3 days and returned to work on light restrictions. My company tried to force me into taking FMLA or personal leave. They stated that we do not cater to restrictions. Is’nt that stating that Walmart doesnt work with handicap associates. I fought them and refused to go on leave because I was capable, willing, and ready to work. Since I was able to work and they werent giving me any work I believe to be layed off. I filed for unemployment and found out that Walmart/ Sam’s club turned into the government that I volintarilly quit and did a no call no show for three days. I was on Fmla at the time. Of course the state approved my unemployment because I had documentation to prove my case. Now the company is and has been discriminated my handicap. During one of my visits to the club, the store manager told another employee not to talk to me. well it was stated ” there are some enployees that you want to talk to and there are some you should not if you value your job. This company has done nothing for me in my time of need axcept tryen to pin me to the wall. I too have had many of shifts were my break has not been covered for me. does anyone have any suggestions????
