Ford Focus, Fusion Class Action Lawsuit Filed Over Power Steering Issues July 9, 2014 Irvin Jackson Add Your Comments A class action lawsuit has been filed against Ford Motor Company, alleging that the power steering system in some Ford Fusion and Ford Focus vehicles is defective and could increase the risk of drivers getting into auto accidents. The complaint (PDF) was filed late last month in the U.S. District Court for the Northern District of California by several plaintiffs, including William Philips, Phillip Clay Cecil, Robert Halsey, Temple Halsey, Performance Fire Protection, LLC and Jason Wilkinson. The lawsuit seeks class action status to represent anyone who purchased a 2010 through 2014 Ford Fusion or the 2012 through 2014 model year Ford Focus. According to allegations raised in the lawsuit, all of the Ford cars targeted by the class action claim use the Electronic Power Assisted Steering (EPAS) system, instead of traditional hydraulic-assisted power steering pumps. The EPAS system uses a steering control motor, electronic control unit, torque sensor and steering wheel position sensor to help the driver navigate. See if you qualify for a sports betting addiction lawsuit. Learn More SEE IF YOU QUALIFY FOR COMPENSATION “The EPAS system, however, suffers from systemic defects,” the lawsuit claims. “The multitude of defective elements in the EPAS system renders the system prone to sudden and premature failure during ordinary and foreseeable driving situations.” Plaintiffs claim that the system seeps conforming coating onto the ribbon cable, causing loss of connections, the ribbon cable pins are misaligned, causing loss of connections and breakage of critical wiring, the contact plate can corrode, and there are defects in the system’s sensors and gear assembly. The lawsuit indicates that the Ford steering problems result in significantly increased effort needed to control the vehicle, and can cause drivers to get into an accident. Ford is allegedly aware of hundreds of complaints, according to the lawsuit, but has failed to act appropriately to ensure consumer safety. The complaint accuses the company of intentionally concealing the problem. None of the plaintiffs claim to have been in an accident caused by the steering system. The lawsuit points out that not only has Ford received complaints, but so has the National Highway Traffic Safety Administration (NHTSA). The lawsuit claims that the agency has received about 450 complaints of sudden failure of power steering loss regarding the affected vehicles. A number of those resulted in crashes and injuries. The claim accuses Ford of violating consumer protection laws, fraudulent concealment, unfair competition, false advertising, breach of warranty, negligent misrepresentation, negligence, unjust enrichment and fraud. I brought it to where I bought my vehicle and my car had a year warranty but not on that particular part which is the power steering rack. I had it towed to the dealership and I had to pay it to be towed. So they fixed it but there was no warranty on that part so they added $20 dollars to my payments every week because it wasn’t covered and the amount was About $1800. Then a couple months later the power steering went again…but this time they fixed it at no charge, but after they fixed it the second time it has some noise to it but I didn’t think nothing about it because I just had it repaired. However, a couples months down the line it went out on me again but this time they won’t fixed it, and the finance company won’t either and all they offered was to cut my payments in have for 12 weeks but still with the $20 repair order on my payments from the first time it was repaired. I had my Daughter and 1 year old granddaughter in the car with me when I almost had that accident on the day my power steering first went out. I have missed alot of time at work, I don’t feel like I should be responsible for paying for this work, and specially after I found out it was a recall on it! I want my money back that I have paid in to this car…because the dealership sold me a car that is defective and never informed me of the recall on my car that I’m still making payments on.. which I can’t even drive right now because I don’t have the money to repair the power steering again…but yet I still have to pay my payments…it’s just not fair. How would I join this lawsuit? Mark June 24, 2016 Girlfriends 2010 Power steering went out and took it to the dealer for a diagnostic. Dealer rated repairs $1900 for a fault that came with the car from Ford. Extremely livid at this point. Dealer said it was the power steering control module that shorted out and caused the problem. Richard June 23, 2016 Yesterday the power steering failed on my mother’s 2012 Ford Fusion. VIN # 3fahp0hacr275897, Service Power Steering and Service Advance Trac lights come on the dash. According to the VIN# check on the NHSTA website this is not in the listed recall automobiles. How do we join in the lawsuit? Edwin June 22, 2016 I bought a 2012 Ford Fusion 2years ago to this date, and I have taken it to dealer to “fix” problem… I’ve been told it was fixed back in December, but I still don’t have control in steering the car… How can I join the suit David June 21, 2016 The power steering failed on my 2012 Ford Fusion last Tuesday while driving. The dealer told me that my car is included in the recall but I have exceeded the arbitrary milage limit. No coverage for the $1600.00 repair. How do I join the class action effort? Sandra June 18, 2016 My power steering went out and it cost me to have an accident in my car Peter June 16, 2016 My 2012 Ford Fusion, new to me, lost power steering suddenly with no warning. A message “Power Steering Assist Fault” displayed on the dashboard. The sudden loss of steering nearly caused me to crash. I was driving under normal circumstances, just exited the highway and rounding a corner. I was able to pull over and turn off the car. I waited two minutes before starting the car again, and the message on the dash was the same “Power Steering Assist Fault”. I waited 30 minutes, started the car, and the message was gone. I called Ford Motor Corp and the dealer. Neither seemed to care much. I took the car to the Ford dealer June 4, 2016 specifically for the recall. Apparently re-programming the module didn’t work. Tomorrow, the Ford dealer is replacing the steering gear. I would like to join the lawsuit. Dilan June 13, 2016 This is with my mother’s 2014 Ford Fusion: The car was purchased brand-new at dealership #1 (not mentioning names on public review). After about 5,000 miles on it we experienced an intermittent “power steering fault” on the display with several other error messages and ALL of the dashboard lights lit up. It took 3 trips to the dealership until they replaced one of the computer modules which fixed the issue temporarily. Got a recall notice in the mail months later for power steering bolts/pins. So took it back to dealership #1 to perform the repair. Since the recall repair, the car has intermittently displayed the same error messages. Dealership #1 would only clear codes and would not investigate further. After that I took it to an independent repair facility, who investigated it further, finding nothing wrong with basic mechanical function and wiring. Several weeks later I was driving it and had the power steering fault message pop up. I was on a highway with no safe spot to pull over so I was looking for a parking lot, when the wheel started fighting me with every movement I tried to make. It was so severe and sudden that I pulled a muscle in my right arm and sent the car into the grass (did it in the middle of a left turn). Unfortunately the car had survived and still occasionally does this. Every member of our family is so terrified of the car now that it rarely sees highway speeds. Since then it has been at a second dealership who is trying their best to resolve the issue with no attempt of resolution from Ford Motor Company, and supposedly to them (and dealerships) the car is safe to drive. I can tell you that it is not, it’s like putting an anti-theft wheel lock on at speed. Racheal June 11, 2016 2010 Ford Fusion power steering issues. About to go to Ford dealership now and see what bs they have to say. Of course there was no recall on my VIN. More money for Ford. Cristin June 9, 2016 My power steering just went out!! 2010 Fusion!! Not in the recall, but the other half of 2010-12 have been recalled. The part is $1300 for a pin that can ONLY be purchased from FORD!! Extensive labor to fix due to pulling apart the front end…$2000 final ticket for repairs!!! After research MANY 2010 Fusions have had the SAME PROBLEM and matching repair bill! Contacted the Ford corporation, just “keep your receipts. if it ever goes under recall, you can get reimbursement.” But, you better have used a Ford dealership! PS, the diagnostics test is extensive, about half a day to run!!! Estimated $182 won’t cut it!!! Robert June 3, 2016 2011 Ford Fusion with 50,000 miles Today I started my car and I could barely turn the steering wheel. The dash indicator message center said “power steering assist fault”. I turned the car off and started it again. Everything was working normal. This is the first time this has happened. From the looks if it not the last. I called Ford and my car is not covered by a recall Jasmine June 3, 2016 I’m driving with my 1 year old in my 2014 Ford Focus and out of nowhere my car alert me to pull over due to steering lose. Luckily I was not on the interstate and was able to get in a gas station. My car have 32000 miles on it. Hopefully my extended warranty cover the repair. Mike June 1, 2016 Bought a 2013 ford fusion in november. While I was driving, a message came up on the dashboard that said, “power steering failure, pull over safely.” The next day, my power steering no longer worked. I managed to get it to a Ford dealer and they said my VIN was NOT covered under the recall. They said it would cost me $2000 to fix it. My car has 46,000 miles on it, the warranty for the car expired after 36,000 miles (how convenient). I would also like to join the lawsuit. Angel May 31, 2016 I have a 2012 Fusion and a 2013 Focus. Both bought used, fusion was Service Managers’ vehicle, 18,000 miles and the Focus, from rental company, 24,000 miles. Two weeks ago had to pay $955.00 on the Focus (33,000 miles) to repair, ABS, Traction Control, No Power Assist and speedometer quit working problem. These things happened all at the same time. at week had the Fusion in for a bad ” rack and pinion”. (Fixed under 7yr/70,00 mi extended warranty) Car was returned to me after 3 days work, rack and pinion still makes same noise and steering is heavy now. How can I join the law suit? Diana1 May 28, 2016 For about 4 months now I have experienced problems with my 2012 Ford Focus steering asssist failing. Well it has now finally completely failed. I called the dealer who said “sorry there is no recall but for a dignostic fee we can look at your car. Thats why you should have bought the extended warranty.” Wow really, i didnt take because I should not be having problems like this. This car has had 2 recalls already. Its a lemon of a car and not safe to be driving on the road. Ford needs to own up to the problems and find a solution and issue a recall before someone dies. Knowing there is a problem ane doing nothing is the worst thing they can do. Leaving consumers on the road with car that is not safe and knowing even worse Rod May 23, 2016 We have a 2011 Ford Fusion. The electric power steering went out. Went to the Ford dealer and they down played the recall on this car. They got my VIN number and said my car was build in a factory, that was not on the recall list. But they said my lug nuts were and the floor mats were on recall. I want to be part of law suit toward the Ford Motor company. The car has only 57,000 miles on it. David May 20, 2016 I have a 2012 Ford Focus. The transmission went out last month and just after getting that fixed, the power steering went out as my wife and daughter were driving home and almost got into an accident. I called my Ford dealer and they said that my car was not on recall for this problem. I called the 1-800 number for Ford and they said until a recall is issued, there was nothing they can do. This is our only car and I cant afford $2,000.00 to fix this. I will join the lawsuit! Sara May 18, 2016 Power steering failure last night on my car (2012 ford fusion w/ 2.5) took to dealership no recall shows on oasis report.. Called ford motor company there’s nothing they can do. My car is to a T what the recall is out for. What can I do to get it fixed. Erin May 17, 2016 I have 2010 ford fusion with power steering Problem. Live in WV, while driving on curvy road power steering just stopped no warning. I was in curve and almost wrecked when power steering stop in middle of curve. I was lucky to be going slow or the steering wheel almost was jerked out of my hands, with the power assist leaving and me steering manually. I have never driven any vehicle with out power steering and brakes. This is crazy. Sign me up for the class action lawsuit Justin May 17, 2016 I purchased a 2010 Ford Fusion last year in February for my wife. Last week my wife was driving to the store when it started alarming service power steering now and alarming the service advance trac. Then the power steering went out completely luckily she wasn’t going far. We don’t have 2,000 dollars to be fixing the issue. This is her transportation to and from work and our family car. It is ridiculous that Ford can’t simply fix this issue. This is dangerous. My wife loved fords but she said she want buy another one. I want in this class action lawsuit. This is on Ford. They should take responsibility for this issue and do the right thing and fix it before it does cause someone to get killed because of the instantly losing power to the steering. Tima May 15, 2016 I have a 2010 Ford Fusion, while I’m driving, I’m the highway 65mph, my car alert system just goes off. I look down to see that my power steering is going out, then, it just failed! While I’m driving! My power steering just went out.. If that isn’t bad enough, first I lost control to steer, 7 seconds later the power steering is gone. I was terrified I was going to wreck, especially going that fast. What can be done, this is my only car? Michael May 9, 2016 I bought my 21 year old daughter a 2010 Ford fusion SLE (VIN:3FAHPOJAOAR324188) and her steering went out this week end and she could not steer the car. This could of been catastrophic! I believe they need to broaden the perimeters of there failure data as this should be included in the recall. I called Ford after reading on line complaints and they said it would not be covered under the current recall (2011) but spend my money at a ford dealer, have it fixed and it may be added to the recall in the future and if I have my receipt I could possibly get my bill covered! I wont hold my breath on that! Ford super duty I just spent 9K on to keep it running! Now this, no more Fords in my future. Katherine May 5, 2016 I was just now driving on highway in my 2011 ford fusion when my light came on and said service power steering then when I got off highway and pulled over to gas station my power steering completely went out and said service now I soon realized I have no pump and its electric so how or can I be a part of this law suit liane May 5, 2016 break failure and service advance track message abs going crazy Derek May 4, 2016 I have a 2010 fusion, power steering stops working while driving, I took to dealer here in hot springs, they reset computer it starts working for a week or two and then it’s will flash a code saying low tire etc and it stop working again, ford reset computer and told me I had an electrical problem and I need to pay $115 an hour to diagnose which they said might take one to two days meaning thousands just to locate problem. They claim to have never heard of power steering failure as if I’m the only person in the world experiencing it. Power steering did stop working on me in a curve in which I slammed into a tree unlucky me I was uninsured, but I have since repaired body but still have the problem. Nobody will buy the car after I tell them what happen basically making the car worthless Maria May 1, 2016 Just 2 weeks after purchasing a 2015 Ford Focus, the power steering failed. Got it repaired. Now 8 months later it failed again!! Undrivable. Christopher April 29, 2016 My 2012 Ford Fusion has lost it’s mind! Serv. Advance-Trac, ABS lights are on and can’t hardly steer anymore and it’s so loud if trying to turn. Only my opinion but electronic steering boxes with plastic gears inside? Not the brightest move FORD! Shannon April 28, 2016 How do you file? This is very very unsafe! liane April 28, 2016 I bought an extensive ford warranty to protect my new to me used 2010 Ford Fusion hybrid. this did not help me when my rocker panels have completely rusted out ford won’t do anything nor the dealer I purchased from. also my brakes quit one morning they agreed to do an update after I showed them online that there was one.. same thing advance track lights had come on. they charged me for the service though. starting yesterday again the lights have been activated and the msg to service advance track. the grinding too. nothing but problems from this car. also my media controls stopped working a year ago and I’ve taken it to dealer several times they tell me nothing is wrong but it won’t play my usb. terrines winter driving this car can’t wait until I can afford something else. Chasity April 26, 2016 How is it worth this many complaints on not only this forum but several others the 2010 Fusion isn’t included in the recall? Ridiculous & shameful of Ford. My power steering went out on me last night with my children & disabled mother in the vehicle. Received the same two warning lights as everyone. Pulled over due to difficult steering. Turned off the car. Went inside a local store to purchase power steering fluid because, I was unaware that power steering is electronic in this vehicle. Came back out and restarted the 2010 Ford Fusion SEL and the steering was locked completely. I don’t know about other people but my family cannot afford around about $2,000 in a used car repair. I repeat this is absolutely ridiculous and shameful of Ford. They are aware that this is a common problem for their vehicles will the electronic power steering dated back to 2006 according to several web sites that I have looked at. How do I join the lawsuit? Melvin April 21, 2016 I have a 2010 fusion the power steering assist and advance tract comes on. I also have no power in my steering, I almost had an accident a few times. The dealer said it’s not on any recall list and I will have to come up with the cash to get it repaired. How do I join Jack April 16, 2016 I have a 2013 ford focus I bought used w 16k miles on it almost two years ago, I noticed the pwr steering started feeling like something wasn’t right, this was on Wednesday and today is Friday and I started to drive away and as I was backing out the pwr steering completely stopped working, so I went ahead a drove it a couple miles to see if it would start working to no avail. I do a lot of hwy driving miles and now have 82k miles on it, out of warranty of course,,I’ve seen many of 1000,s of this issue/problems. How do I join this suit? I’m 51yo and whenever a ps pump would go out u could still drive it and just took a little more effort to steer, w this focus the steering almost locks and I have to jerk on it w both hands just to stay in my lane and from a car behind me would definitely call the cop’s for dui as I swerve all over the road. The cost of re paid is $2000. OUCH!! Steve April 14, 2016 My wife’s car is a 2010 fussion. I experienced power steering failed at 40 mph.the trac came on first then service power steering now lights up. No power steering at 40 mph. If my disabled wife was driving I am sure she would have been in an accident. I call the ford dealer service desk to make an appointment he didn’t even know that it was electronic power steering. I/we want to join the lawsuit. Brett April 14, 2016 We have a 2010 Ford Fusion we bought for my son. His steering went out while him and my younger daughter were going to school. He went off the road and almost drove into a ditch, unable to move the steering wheel at 40 mph. We took the car to our local Ford dealer and they said his car was not under the recall. We spent over $2000 to have it repaired. Jered April 14, 2016 2012 Ford Fusion 62 k miles called ford and its out of warranty. Asked about any recalls and they said there was one for the power steering but mine wasn’t on the recall. Service power steering now and service advance track. No power steering at all. I would like to join the lawsuit. Power steering went out all of. A sudden while driving. Thomas April 10, 2016 I have experienced sudden loss of power steering and would like to join lawsuit Tephanie April 9, 2016 I have a 2007 Ford Fusion and i was on the highway tonight driving 70mph when my steering when out suddenly. Then my battery light came on and then my alternator light. Never had an issue before but thank God I was able to get off on an exit to safety. Ethel April 5, 2016 I have a 2012 ford focus the car has been in the shop 4 times and the tires are still locking up. Got to work 2 hours late because the car cut off in the middle of the street could have died. Renada March 30, 2016 I have a 2010 ford fusion that the power steer ing failed on me and I called ford motor company and was told there was no recall on the 2010 and there was nothing they could do. I also called the National Highway Safety Association and made a complaint but nothing was done. How do I join the class action quit. I will never by a ford again. Terri March 29, 2016 2011 Ford Fusion VIN#3FAHP0HA6BR112337, Ford say’s this vin is NOT on the recall. We have had plenty of problems with the power steering shutting down. Angela March 29, 2016 I have a 2010 Ford Fusion and my power steering went out on me in the middle of me turning left off of a main road. I jumped a curb. I have been trying to look into what I should do and can’t find a recall for a 2010 model. Anyone getting any help on this issue? Amber March 28, 2016 I am SO upset with everything about this. I don’t understand why FORD would put all of us and our families life in danger just to save money by not fixing a problem they caused! It’s so heartless and pathetic if you ask me. I have a 2010 Ford Fusion SEL and my power steering went out randomly on my car as well. My whole family looked at my car, checking the wires to check if they needed replacing and all of the wires are fine! I would like to know how to join this lawsuit. We need to stand up for our safety before people get killed due to this, if they haven’t already. Ford clearly knows about this issue. Darryl March 28, 2016 To is March 27 2016 we own a 2010 Ford Fusion se the steering has locked up on it twice this month we have not had a chance to drive the car a good week straight without the steering locking up it is a used car had it about a month can’t drive it don’t know what to do at this point. I need help my wife and kids was in the car this last it want out. jessica March 27, 2016 I need to know about the lawsuit ive already had this recall done on my car it’s a 2012 ford fusion an they said it was fixed then a couple months down the rd boom power steering goes out an it all happened again I’m glad me an my family didn’t get hurt we are very fortunate an I think this will be the last time I drive a Ford feel like they don’t care about are safety at all hmm they say this was the # 1 safest car tht yr false advertisement Tammy March 24, 2016 I have a 2010 ford fusion I have had it 2 years and in the last two months have had the steering wheel lock up on me while driving down the highway three different times with all the issues with the steering devices I think ford needs to have a recall its gonna cause someone their lives fix the problem and make it rite for the owners that have stood by ford and keep ford as the top selling American made vehicles in the United States !! Robert March 21, 2016 My 2010 Ford Fusion’s steering has not locked up yet but seeing the frequency of failures and complaints, it certainly seems to be a Ford liability issue that requires immediate redress. I will continue to drive my Ford Fusion but this is notice that I continue to hold them responsible for their manufacturers safety responsibility for their product. Bob March 20, 2016 We are still paying for a 2012 fusion in which the steering has stopped working and we can’t afford to fix it. Would like to know more about the recall and lawsuit Chris March 20, 2016 I also have a 2010 ford fusion. My power steering goes out without warning, and it’s happened 4 times in the last 2 months. Going to the dealer on Monday to complain about it. I will also contact customer service representative (ford hotline) and complain there as well. Also, I put in a complaint with the National Highway Traffic Safety Administration. Lou March 19, 2016 I have a 2013 ford focus, just about to hit 50,000 miles and my steering started getting stuck whenever I turned the car to the right and tried to turn it back. Then a couple days later it started making a grinding noise as I turned it. Ended up getting it towed to the dealership and was quoted with a $2500 repair cost for a new steering gear, alignment and tie rods. This is the second issue I’ve had with this car, needless to say I’m never buying a ford again. Christine March 16, 2016 Can anyone help me get in touch with a lawyer working with this or one you guys have working on this with you?
