Ford Focus, Fusion Class Action Lawsuit Filed Over Power Steering Issues July 9, 2014 Irvin Jackson Add Your Comments A class action lawsuit has been filed against Ford Motor Company, alleging that the power steering system in some Ford Fusion and Ford Focus vehicles is defective and could increase the risk of drivers getting into auto accidents. The complaint (PDF) was filed late last month in the U.S. District Court for the Northern District of California by several plaintiffs, including William Philips, Phillip Clay Cecil, Robert Halsey, Temple Halsey, Performance Fire Protection, LLC and Jason Wilkinson. The lawsuit seeks class action status to represent anyone who purchased a 2010 through 2014 Ford Fusion or the 2012 through 2014 model year Ford Focus. According to allegations raised in the lawsuit, all of the Ford cars targeted by the class action claim use the Electronic Power Assisted Steering (EPAS) system, instead of traditional hydraulic-assisted power steering pumps. The EPAS system uses a steering control motor, electronic control unit, torque sensor and steering wheel position sensor to help the driver navigate. Learn More SEE IF YOU QUALIFY FOR COMPENSATION “The EPAS system, however, suffers from systemic defects,” the lawsuit claims. “The multitude of defective elements in the EPAS system renders the system prone to sudden and premature failure during ordinary and foreseeable driving situations.” Plaintiffs claim that the system seeps conforming coating onto the ribbon cable, causing loss of connections, the ribbon cable pins are misaligned, causing loss of connections and breakage of critical wiring, the contact plate can corrode, and there are defects in the system’s sensors and gear assembly. The lawsuit indicates that the Ford steering problems result in significantly increased effort needed to control the vehicle, and can cause drivers to get into an accident. Ford is allegedly aware of hundreds of complaints, according to the lawsuit, but has failed to act appropriately to ensure consumer safety. The complaint accuses the company of intentionally concealing the problem. None of the plaintiffs claim to have been in an accident caused by the steering system. The lawsuit points out that not only has Ford received complaints, but so has the National Highway Traffic Safety Administration (NHTSA). The lawsuit claims that the agency has received about 450 complaints of sudden failure of power steering loss regarding the affected vehicles. A number of those resulted in crashes and injuries. The claim accuses Ford of violating consumer protection laws, fraudulent concealment, unfair competition, false advertising, breach of warranty, negligent misrepresentation, negligence, unjust enrichment and fraud. I live in India. The car has been giving weird sounds while steering left or right, and the service center has diagnosed it as some steering rack problem, The worst part is, they say it may cost Rs.90000. (roughly USD 1500).How can anyone afford that much on an old car? Ford should cut down prices of spares. Marcus December 27, 2015 Just want info on the recall if anyone can help. Thanks. Cheri December 26, 2015 2010 Ford Fusion Hybrid with 57000 miles. Steering failed. Had to have it towed to dealership. Rented a car. Fixed a week later. Same price point as others posted. Warning light then no power steering. Kathy December 25, 2015 I have a 2012 ford Focus with 70,000 miles on it. Yesterday it lost power to the power steering and gave an error message twice. I can’t afford to replace this I am still making payments also. I have issues with the transmission ever since I’ve had it. The dealership keeps telling me there’s nothing wrong with it (transmission). Ford should have to step up and correct the problems with these cars or give there customers a refund. Brian December 25, 2015 I have a 2010 Fusion.Ford told me no recalls on electronic power steering ,my went out on highway with my son in car and scared us. I been driving it about a year like this because i don’t have $2000 to fix it. Jose December 22, 2015 I have a 2010 Fusion with 129k miles. I have been loosing power steering at start up along with an error message. I restart the car and the problem goes away. I took it to the dealership and they want 1,700 dollars to replace the electric steering rack. I’m holding out for a better solution. Denise December 11, 2015 I have a 2012 Ford Focus and my car is in the shop for repairs. This is unacceptable! There should be a recall on this, this is a safety issue! If repairs are made, then a recall comes out, does the people get refunded? Collin December 10, 2015 I have a 2012 ford focus SEL that I just took in for the steering issue. 12/9/15. My focus is NOT covered under the recall. WHY? I have the year/make/model and the discrepancy at issue. Why are not all cars with this control module covered? MIKE December 9, 2015 I bought a used 2013 ford focus about a year ago for my wife with 38k on it. since then the transmission has been rebuilt 3 times. and just recently the power steering went. and it will cost $1400 to replace the steering column. we’ve have had a terrible expierience dealing with the dealership. very rude. they dont seem to care or stand by their product. and being a safety issue you would think ford would try a little harder about fixing the problem. they will probly wait until someone dies. ill never buy a ford again. Michael December 5, 2015 I bought a used 2012 Ford Focus Se from a dealership back in July with a little over 68,000 miles on it. Since then i have put about 5,000 miles on the vehicle. Last night my power steering abruptly gave out while i was conducting business driving as an Uber partner. luckily i remained calm and was able to assure my passengers that they were safe meanwhile i was unsure of this. I have read many forums and articles that expose that Ford is aware of this manufacture defect and have yet to take action. I have called Ford and they notified me that there is no recall that has been issued and to bring my vehicle to a dealership for diagnosis. However after all of the information that i have gathered i am not very optimistic about how this situation at the dealership is going to play out. Willie December 1, 2015 I am have the same problem with my 2012 Fusion. The dealer is acting as if I’m asking for a hand out. My car steering problem start while driving on 95 North at the speed of 70mph. Now that I’m home I just would like some helpful directions to repair this problem. Up until now I felt like a King riding in my Fusion. Now, a Fool is how i feel. michelle November 24, 2015 How can I get in on this lawsuit. Ford has NEVER sent me a recall notice, i keep being told ford will send me a notice when i can have it fixed. HA kinda hard to drive your car without power steering. I am a single mom I drive to school and work 5 days a week i cant afford to be without my car nor can i afford a rental. My powerseering has failed 2x FAITH November 22, 2015 HOW DO I GET ON THIS LAWSUIT? iT HAPPENED IN MIDDLE OF HIGHWAY WITH MY KIDS IN THE CAR??? Zachary November 21, 2015 My 2010 fusion (purchased used, 1 previous owner) last spring 2014 just lost its power steering. From all of these comments, the exact same thing has happened to me. First it said something about power steering assist failure, then followed by service advanetrac, and then service power steering now. I’m in college and can barely afford food let alone a fix like this. I purchased this car for about 8k thinking it would at least last me until I got my Bachelors. As well, I previously had a problem with the steering where I went into a curb and messed up my tire; and on top of that, my security theft system went all out of whack too. Terrible, not even an American made car. Mexican manufacturing at it’s finest. Stacy November 19, 2015 I purchased a 2011 Ford Fusion in February of this year. I did get a recall letter in the mail so I took my car to get serviced at the dealership in August. Two days ago my power steering completely failed. I took my car into the dealership and they told me I need to get my gear box replaced HOWEVER it is covered under the recall so I do not have to pay for it. Coljn November 17, 2015 2010 Ford Fusion, power steering went out and I crashed into a median. No injuries and just slight damaged to the bumper. But don’t have 1600 to fix. Any help joining the class action lawsuit would be amazing. Brittany November 17, 2015 I have a Ford fusion 2010. I bought it a little over 2 years ago. My power steering also went out. It’s been about 8 months now that I’ve been driving without it. It’s really starting to scare me but I can’t afford to fix it. Not to mention if I fix it, will it go out again in the future. Has anyone else driven around without the power steering for a long period of time. How long before the steering went out completely? I’m starting to feel as if my days are limited with what’s left of the steering. Also how do I join the lawsuit? christina November 16, 2015 I have a 2013 focus, I bought used in Jan 2015 had 41000 miles and i have put 21000. It has always had issue with shuttering and weird sounds. Got recall letter and made appointment to get it checked. The lady at ford gave a list saying it is normal and shooed me away, doing nothing not even looking at it. I was on my way to Memphis and 50 miles from there it does not want to shift. I took it slow the rest of the way. Did not use car until next day, started off ok then began to shift rough. Only made to Cleveland Mississippi before I had to stop completely because it started to grind. Left it at ford dealer and called for a ride. I live 3 hours from where my car broke down. They ordered the clutches but said that the whole inside of the transmission is rusted. What? rusted how in the He** did that happen. Not water tight I am guessing, I have not been wading in water with my car. So the powertrain warranty was up at 60000. If The ford dealer I took it too for the recall would have looked at it then they might have seen something that would have been covered. So my car has been broke down for 3 weeks now and I am still making payments and Ford wants me to pay for the transmission. Oh I forgot I have a money tree in my back yard. Michael November 16, 2015 I was driving down the road and lost my power steering. This scared the crap out of me as I thought I was going to crash into the car next to me. I managed to get it pulled over but after reading all these complaints, this is exactly what happened to me steve November 16, 2015 2012 focus with the steering fault. How can I be apart of this suit? It is clear Ford is aware of the issues and are ignoring consumers. Marita November 14, 2015 I was driving my 2013 Ford Taurus down a busy parkway and my steering lock up and I had to take a ditch. Dealership said it was the rack and pinion and computer. It took me three days for my blood pressure to go down. Please add me to the lawsuit. Kimberly November 13, 2015 I have a 2010 fusion mine is slowly going out. Brandon ford will not even acknowledge. But we can fix it for 2,300. Go figure Kathleen November 10, 2015 I started my 2010 Ford Fusion in the parking lot after shopping. A warning lit up “Power Steering Assist Fault” I had never seen this warning before. When I put the car in drive, I got another warning ” Advance trac failure”, never saw that one before either. I drove my care with caution and a lot of effort to steer to my mechanic 3 blocks away. he told me I needed a new drive train but the dealer said the part cost $1649.00 and was on national back order and they had no idea when it would be available. So I have no car! I called two dealers and Ford Motor Co. to report the problem and all three said they never heard of this problem before today. So I asked, then why is the part on such an indefinite back order? No substantive answer other than “oh, could be lots of reasons” and ” well I really don’t know”. Now after reading all the preceding complaints filed with NHTSA and on this web site, I have to believe they are all lying! What is Ford Motor Company trying to hide? They say my car is not under warranty due to the mileage but if it’s their fault, mileage shouldn’t matter! It is their fault I have no car for the foreseeable future because they do not have the part to fix it! I either have to borrow a car or beg a ride or rent a car at my expense for who knows how long. I am so disgusted with Ford Motor Co, not for the problem…things happen…but for their lies and lack of responsibility! I, too, would like to join this class action law suit. Chenelle November 8, 2015 I have a 2010 Ford Fusion. Same problem with power steering. Dealer just told me $1700 to repair. I want to be included in this lawsuit. Niecy November 5, 2015 I am also having problem with my 2011 Ford Fusion. I was driving home one night was I was one mile from the nearest gas station when the service warning came across my display. Before I could reach the gas station there was a total lock on my steering wheel. I was stranded for several of hours with my kids the night it happened. I took it to the nearest Ford dealership first thing that morning which my warranty fix it. The part was 1500.00. Now that was 2weeks ago. Today on my lunch break on my way back to work my steering again went on a total lock no steering at all. It’s a struggle to try to operate the vehicle while doing any steering. I’m now very irritated from this issue. I have to take it back to the nearest Ford dealer again to get it looked at. I also want to join this lawsuit. I’m afraid that the issue will only get worse instead of better. Rebecca November 4, 2015 I have a 2010 Ford Fusion and when I started the car a few days ago the message Power Steering Assist Fault lit up. I am currently driving with no power steering. I don’t have the $80 to have it diagnosed at Ford so I’m going to Autozone after work to have it hooked up to a computer. I would like to join this lawsuit. I can’t believe Ford doesn’t have a recall for this problem with as many similar stories I am reading online. Mo November 4, 2015 2010 Fusion has been in my driveway for 2 years. I want to join this lawsuit. I’ve called Ford numerous times and the onlything I’ve learned is that it cost 2k to fix Collin November 3, 2015 I have a 2013 Focus, bought it from Carmax in January 2015. Since about March, it has been making a rubbing sound when I turn the steering wheel. I thought nothing of it until my gf said something about it. I guess I had gotten used to it and forgot it made that sound. TODAY, driving home from work, I was turning onto the feeder road when I noticed my steering was….sticky. when I turn the wheel either direction from the center position, it would catch and I would have to turn it harder to get it to turn. I was very concerned so I took it to my local mechanic. They said that the “electric steering gear” is giving out. This scares me because I don’t want it to give out while I’m driving! I asked how much to fix it, he said the total to REPLACE the gear was going to be almost $1,200!! I’m not made of money, so I can’t afford to get this fixed! I need to get as much info as possible to get into this lawsuit so I can have a car that won’t kill me on the way to work! Please send any info! Thank you very much Jessica November 2, 2015 How do I get in on this lawsuit Michele c October 28, 2015 I have a 2013 gord focus and my steering wheel has been making a loud like rubbing noise and it’s hard to steer and sticks when making turns so I took it in to my ford dealer and they called and told me it was my front left ty rod and my left front wheel was making a thumping noise too and I told them about my steering wheel they said when they fix that it will be fine so I said ok well the steer wheel still make the noise they said that’s what it suppose to sound like, really , well that was around 2 months ago, guess what it got worse and I took it to my independent mechanic and they said it was the rack and pinion steering and the outside right ty rod now, the first side cost me almost 900.00 and now this is costing me 1100.00 or more depending now they all say there is no way this car should need all this stuff replaced only being 2 yrs old so somebody better do something because this is ridiculous and uncalled for and I’m going to file a complaint and get my lawyer because this car is a hazard to my 17 yr. Old daughter who drives it and myself I mean this car was pulling in to the other lane and one of us could have been killed and nobody gives a dam about it well I’m going public with this unless something is done and I suggest everyone else should do the same thing if we want satisfaction so please help getting ford motor company to reimburse us or give us another vehicle not a focus of course but something that is not breaking down every month I can’t afford to keep replacing their crappy parts for this car. Thanks for reading. Greg October 26, 2015 I have a 2010 fusion, when the power steering went out on me it could have killed me or someone else on the road. I still haven’t gotten it fixed because I don’t have $2,000 either. James October 25, 2015 I am a GM CERTIFIED MASTER TECHNICIAN. I have a customer with a 2010 Ford Fusion, with (epas) electric power steering. Customers complaint, hard to turn steering wheel, causing minor accident, damage left front fender, when tring to park car. Verified customers concern. After diagnostic’s found electric power steering gear assembly open circuit. Vin# 3fahp0ha5ar392783. I found out that Ford motors nows about problems with epas but has not offer any help to there customers. What are thay waiting for, major accident with the death of love ones. I now over the many years working for GM dearlerships there would be somekind of recall concerning problems. Thanks for ear. james October 18, 2015 Power steering does not work sometimes on startup. Usually I shut car off and then restart to get power steering to work.Took it back to ford twice. They said that it looked like we might have ran the car onto some high ground and damaged the rack and pinion. It’s my wifes car. No way she did any off road driving. Now, she doesn’t feel safe driving the car to work even on the back roads. Want to trade it in for a new chevy but hate to transfer the problem off to someone else and risk them being killed on the open road. I would like to join that law suit. Anybody aware yet of how to do that? Acohin October 8, 2015 I currently have the issue with 2010 Ford Fusion and don’t know what to do. I can’t afford that much money right now. Is there any other quick fix way? Andrea October 1, 2015 I was happy to see at there is a class action lawsuit on this. I have been going around and around with ford on my 2012 Ford Fusion and the power steering failure with less than 30,000 miles. There is absolutely no compassion with corporate or our local dealer. Oh you can file an insurance claim to have it fixed or pay the $2,000+…. Uugh no I shouldn’t have to do that!!! It’s extremely frustrating that they have seen this happen yet aren’t taking responsibility for it! Melanie September 29, 2015 I have a 2010 Ford Fusion that I bought used. The original buyer replaced the power steering gear (for $2000) and it just failed this weekend with my 16 year old daughter driving!! The Ford Dealership has been horrible and the part alone is $1500 but it’s on back order for two weeks!!! I was also told a courtesy is not available for me…only newer vehicles. I would really like to be part of this class action lawsuit. David September 29, 2015 I bought a 2014 Ford Fusion three weeks ago this Sunday sept. 27 2015 driving back from fla. the power steering went out without warning didn’t wreck but had a scare Valencia September 27, 2015 ‘@Chris. No I just had mine fixed to the tune of 2,000!!! I don’t think that we should have to be responsible for the cost. My car cut off in the middle of traffic with my kids in the car. How do you join the lawsuit. James September 27, 2015 I have a 2012 ford focus , it was purchased 2 yrs ago ,had got extended warranty , expired about two mo ago . I have had tcm module replaced now the radio is gone out and a week ago , and the next week the electric power steering is gone . I am not even finished paying for the car . I need help, can affored to get fix and pay for car . It only 3 yrs old . Please help. Called corporated they r aware of issues but that’s it. Chris September 25, 2015 Has anybody been able to fix this solution without having to pay the $1,700 Mark September 16, 2015 Marc & Frank it’s very simple someone has to pay for the defect Ford is not that’s for sure if you do the math it looks like Ford has made over 7 million dollars replacing them and by the looks of it it will triple over the next year and it also looks like the NHTSA doesn’t care about it either they closed the case 9/10/2015 some deal must have been made because with every steering rack failing world wide and mark my words they will fail and we have our young kids driving them and not doing anything about it is Despicable. Amber September 12, 2015 I am beyond done with my 2010 Ford fusion! I was driving with my 2 toddler boys and my power steering went out! luckily I was able to pull over and have my husband come pick us up! we could of gotten into a bad wreck! I called a Ford dealership to see about getting it fixed and he told me it would be $2000-$3000 to get it fixed and I could do payments on a credit card. I don’t have a credit card nor do I have that kind of money to dish out! so I am out of a car and irritated. I just don’t understand why the 2010 are not being recalled when there are so many who are having these problems! this is a little ridiculous! how do I become part of this lawsuit?? Frank September 10, 2015 Marc, I couldn’t agree more. I’ve got the exact same issue with my 2010. Now what? It appears we deal with it for another 2 years, hoping the 2010’s area addressed or we shell out $1,600. Marc September 8, 2015 I am at a loss of words when ford puts out a recall for the power steering problem on the 2011 to 2012 ford fusions, but not the 2010. I know that this has taken place as our family owns both 2010 and 2012 fusion but the recall only fixed the 2012 model. Meanwhile our 2010 fusion has the issue. After going on a short drive the code failure for “advanced traction control” and “power steering” showed up. Ford needs to own up to their screw up and finish the recall. I would really like to hear their reasoning why all three years of fusion (2010-2012) have the same exact problems but only 2011-2012 are fixed. This is a serious issue that will cause accidents. Denise August 31, 2015 2010 Ford Fusion SEL showing Power Steering Assist Fault on dashboard. Car was in motion when this occurred and I lost power steering while driving with my toddler. This is an extremely dangerous problem. It happened to me at least 10 times while driving in the past couple of months, except this time around I have lost all power steering. It cannot be reset by the mechanic that I had to tow my car to and he is telling me that the rack must be replaced. That is a nearly $2,000.00 fix and Ford is telling me that there is no recall on this, yet thousands are having the same problem? My mechanic told me that Ford is completely out of power steering racks (hmmm, must be because EVERYONE is getting theirs replaced!!) at the moment. This is absolutely ridiculous and unsafe. Wynde August 30, 2015 I have a 2010 Ford Fission. My :service advance track light comes on and matter my speed, my car dies and I pray that I will get out of the road. I had it to Ford dealership and they say it’s in my key Reprogrammed everything Worked great for a month and now it’s doing it again. Now it will not start at all Its Sunday so going to have it toward tomorrow back to dealership SMH!! I still owe 4 years @ $333.32 a month! !!!! Mark August 28, 2015 Robin Make sure you call the NHTSA 1-888-327-4236 and file a complaint they have a open investigation on this issue the Number is PE14030 it’s for sure a safety defect the more complaints the better chance we have of FORD fixing this unsafe junk. Amy August 28, 2015 I have a 2010 Ford Fusion. I’ve had nothing but problems! First the ac compressor, the throttle body and now the power steering! My children were in my car when the bells went off! My power steering is completely out and I have children to provide for! I have a back and neck injury which definitely prevents me from attempting to fight the wheel to get it to a dealership…not to mention afford the cost of repair. I feel like letting it roll off a cliff! Never again will I buy a Ford! Someone please tell me what to do in order to be added to the lawsuit! Robin August 28, 2015 I have a 2010 Ford Fusion. I have only had it for less than 2 months. I was driving with my daughter yesterday and pulling onto the highway with lots of other cars and my power steering failed!!!! It was very hard for me to manage to get it pulled over to the sholder. I called the dealership and they told me there is a recall on 2011 to 2013 but not on mine. I’m scared to drive my car now. I drive on a really curvy windy road to work everyday and will definitely crash if this happens when I’m driving at a high speed. I don’t have the money to fix this and feel like ford should pay for this. How do I become part of the lawsuit? Mark August 27, 2015 I have the same issue 2010 Fusion 43000 miles I for sure will never buy another FORD over this issue over 1500 complaints to date on NHTSA website almost every day for the last 2 weeks someone has filed a complaint about this I hope everyone keeps doing so we may need to share all our info and file a new lawsuit 1000’s of them now my biggest issue is I paid $1800 to get it fixed but they say i could happen again not setting well when my daughter has to drive it so i pray every day it don’t happen again to her.
