Ford Focus, Fusion Class Action Lawsuit Filed Over Power Steering Issues July 9, 2014 Irvin Jackson Add Your Comments A class action lawsuit has been filed against Ford Motor Company, alleging that the power steering system in some Ford Fusion and Ford Focus vehicles is defective and could increase the risk of drivers getting into auto accidents.ย The complaint (PDF) was filed late last month in the U.S. District Court for the Northern District of California by several plaintiffs, including William Philips, Phillip Clay Cecil, Robert Halsey, Temple Halsey, Performance Fire Protection, LLC and Jason Wilkinson. The lawsuit seeks class action status to represent anyone who purchased a 2010 through 2014 Ford Fusion or the 2012 through 2014 model year Ford Focus. According to allegations raised in the lawsuit, all of the Ford cars targeted by the class action claim use the Electronic Power Assisted Steering (EPAS) system, instead of traditional hydraulic-assisted power steering pumps. The EPAS system uses a steering control motor, electronic control unit, torque sensor and steering wheel position sensor to help the driver navigate. Learn More SEE IF YOU QUALIFY FOR COMPENSATION “The EPAS system, however, suffers from systemic defects,” the lawsuit claims. “The multitude of defective elements in the EPAS system renders the system prone to sudden and premature failure during ordinary and foreseeable driving situations.” Plaintiffs claim that the system seeps conforming coating onto the ribbon cable, causing loss of connections, the ribbon cable pins are misaligned, causing loss of connections and breakage of critical wiring, the contact plate can corrode, and there are defects in the system’s sensors and gear assembly. The lawsuit indicates that the Ford steering problems result in significantly increased effort needed to control the vehicle, and can cause drivers to get into an accident. Ford is allegedly aware of hundreds of complaints, according to the lawsuit, but has failed to act appropriately to ensure consumer safety. The complaint accuses the company of intentionally concealing the problem. None of the plaintiffs claim to have been in an accident caused by the steering system. The lawsuit points out that not only has Ford received complaints, but so has the National Highway Traffic Safety Administration (NHTSA). The lawsuit claims that the agency has received about 450 complaints of sudden failure of power steering loss regarding the affected vehicles. A number of those resulted in crashes and injuries. The claim accuses Ford of violating consumer protection laws, fraudulent concealment, unfair competition, false advertising, breach of warranty, negligent misrepresentation, negligence, unjust enrichment and fraud. I have no power steering at all. I have talked to my local dealer and Ford Motor Company customer service rep. and they both said the same thing. I understand they can only tell me what is on the computer screen in front of them. Ford needs to do the right thing and STAND behind their PRODUCT. I have been a loyal Ford customer for over twenty years, but if this is the new standard of cheap throw away vehicles, I will not buy another one. Heather August 19, 2015 My power steering is going out on and off when I drive it. In the shop this very minute for repairs. Called the Ford dealership here in Southern California and they want $1500 to fix it…..my car is being repaired elsewhere. I have a 2010 Ford Fusion SEL ED August 16, 2015 same problem with my 2012 focus; 3 years old with 63,000 miles and the steering assist went out;$1500 to repair. If ford doesn’t come out with a recall and reimburse this I am done with Ford Stephanie August 16, 2015 We have only had my 2010 ford fusion for 6 months. I do not have very good credit and I am paying 400$ a month in a car payment. Today my power steering went out and after seeing all this I am terrified. I am a single mother and I have no way of paying 1500$ to 2000$ to get my car fixed. I have no clue on what to do and due to my credit and financial reasons I can not just go get another car. Does anyone know if this has been recalled yet? How do I add my claim to lawsuit? Theresa August 14, 2015 I too have a ford fusion and the steering just went out , with the dash warning steering assist fault. I have a 2010 model and have 10 payments left to go And of course they want 1600 dollars to fix it . Mary August 13, 2015 2010 Ford Fusion, power steering failure. I was told by a mechanic that I have to get it fixed at a dealership. They are the only ones that can calibrate it. $1900!!! I have to get if fixed because it is all I have. I have to put it on a credit card that I just paid off, which will hurt my credit score, not to mention the financial burden. The dealership told me there is a recall on Ford Fusions 2011 and up and they would not accept mine being put on the recall list. They said maybe in the future it will happen, and if so, I could get reimbursed. How the hell does that help me now? How can I be added to this law suit? Ben August 13, 2015 My dad and I purchased a 2012 Ford Focus Se. Regrettably we did not do enough research on the car itself. When we bought it the car the vehicle only had 45,000 miles. The moment I drove the vehicle off the lot I could tell the steering made very scatchy noises. We put about 6,000 miles on the car before we realized the car was entirely getting to unsafe to drive. The steering would always make those loud scratchy noises until one day we started the focus and the steering was almost to touch to even turn. This is when we knew it was to dangerous to drive. I found a rack an pinion that a company called Detroit Axel sold and we bought it thinking this would solve the problem. Now knowing that not just anyone can replace it but because of the EPS the dealership has to replace it due to certain tools. This last year I’ve been researching more and more and its sad to say that this is just the beginning of the problems with this vehicle. What are we all going to do. . . Julio August 8, 2015 I have a 2010 ford fusion and I’m having the same problem. Esa fault. Got a quote for 1600$ and I can’t afford that. I need this lawsuit asap. How do I become apart of this. How can they recall 2011-2013 and not the 2010. It has the same engine and parts. Makes no sense. Someone please tell me what I can do. Thanks. nicole August 6, 2015 I have a 2010 fusion. I’m aslo having the same problem steering wheel locks up and advanced servicetrac light comes on Linda August 2, 2015 I took my car to new south ford meridians on July 31 2015 for the power steering recall. This suppose to been fixed. Saturday aug 1 I started my car n notice the steering wheel was hard to turn. Sunday I stared my car n found the same thing all but on the dashboard it read power steering assist fault. How can I be added to the lawsuit? Ashley July 26, 2015 We have a 2010 Ford Fusion SEL. The power steering went out in ours also. We paid the $1800 to have it fix due to not having any other way to get back and forth to work. I would love for them to do a recall on this. My sister has a 2012 and she just got a letter that there car was in the recall. I would love to be able to have this reimbursed due to the fact that everything is the same on the 2010 models and the 2011. Luckily when ours went out my husband was driving it and could control it where as myself I couldnt hardly steer it to pull it in the driveway. Jesse July 26, 2015 There is a recall (15340000) on the power steering for 2011-2013 fusions. If you own a 2010 like me, you are out of luck even though it’s the same problem that the recall was issued for. Michael July 24, 2015 I have a 2012 Ford Fusion with only 30,000 miles and was just told that I needed to have the power steering wrack replaced….the car was a couple of months over the warranty and I called Ford hoping they would reimburse us some of the cost and they were not at all interested. What kills me is I had a Hyundai Elantra and loved it and had 120k miles on it without needing any major repairs, and I bought a Ford this time because I had heard the quality had improved and the Fusion had a little more leg room. NEVER AGAIN!!!! Aletha July 22, 2015 My 2012 ford fusion powersteering went out with no warning. I took it to ford and its very costly to get it fixed. I feel like ford should be held responsible for fixing this problem seeing that i have only had my vehicle 90 days… kim July 21, 2015 I have already had my 2011 in for the throttle body recall that came out last year, the one they are talking about in the above article. I had already replaced it a year prior to the recall when i was almost in a accident from the car shutting down on me on the highway, without warning. When the recall came out they refunded me the money I had spent, and repaired it again with the corrected version. I was just looking online because I am problems with the front end making a loud noise, they think it is the ball joints. Anyway, I saw some of your’s comments about power steering issues. There is a recall out there for reprogramming power steering module, just issued last month, which will be free to have repaired at the dealership. Please see below, I hope this helps some of you! Good luck. RECALL NUMBER:15340000 RECALL DATE:6-2-2015 COMPONENT: STEERING:ELECTRIC POWER ASSIST SYSTEM nikki July 21, 2015 My husband and I have a 2011 ford fusion and as alot of you have stated, we are paying alot for this car and can’t afford this repair. We didn’t even get a warning before power steering stopped working. I feel as though ford should be responsible for this problem. sue July 20, 2015 I have a newer focus hatchback 2013 trans mission problems addressed Around 28k mile . And now the power steering went out at 39k miles Luckily I was out of heavy traffic, got gas. The dashboard lite up And you could barely turn the whee . Very unhappy .. I would love to start a class action suite here in ga. C Teng July 20, 2015 My Ford Fusion 2010 has the same problem now and I was told it would cost more than $2,000 to fix it. Jamie July 20, 2015 This also just happened to my 2010 Fusion. Power steering went out at 70 mph on the freeway. It happened a number of times prior to this weekend but restarting the car would solve the problem โ which was still awful but at least an affordable fix. But now restarting is not solving the problem. The power steering is non existent and I’m at a loss at what to do. I can’t afford a $2,000 repair! Ford needs to step up and do what is right for the customers that believed in the safety of their product. Peter July 17, 2015 I was quoted $1,510 to repair a defective power steering system at the Ford dealership where I purchased my 2012 Focus. What a rip! I have a 2003 Hyundai and the power steering works exactly the same as the day I bought it! Seth July 17, 2015 I have a 2012 Ford Fusion se 40,000 miles and driving down the road one day the power steering went out. Called AutoZone and advanced auto parts and they have heard of this problem but call for a Sony it’s $2000 to fix this is ridiculous I pay $360 a month for the car and now I have to spend another 2000. My comment to the Ford dealership or do I have to do this every 40000 miles because if I get this fixed I’m going to be selling this car my grandfather worked before I guarantee you he wouldn’t want to know that this is how ford handling their issues.please stand behind their product and a something it’s a piece of junk figured out a better way to fix it and just do it. Very sad. Kerry July 17, 2015 I have a 2010 Ford Fusion Hybrid and I have lost power steering 4 times in the last 4 months. Each dealer I have taken it to, says there is nothing wrong with the car, or they fix something that is not broken and then they just reset the codes and it works fine for another 1000 miles. My car only has 49000 miles on it. The first time I took it in it was still under warranty and all they did was reset a fuse and the codes and sent me on my way. Now the 5 year part of the warranty is out and so they want me to pay $2000 for a new rack and pinion. One dealer said he needed to replace the control arms in the suspension and that would fix it. That was an $800 repair that was unnecessary. This dealer also did not tighten down a brake caliper which resulted in the front right wheel locking up and I had to have it towed and the caliper fixed. The dealer did cover all costs for this repair. I still have not had one mechanic tell me exactly what is going on with the car. They more or less say we will try this and see if it fixes it. Nothing I have been told has made any since. The one thing I would like to know that I do not see on this post is how to join the class action law suit. SALLY July 12, 2015 I have a 2012 Ford Fusion with just 10,00 miles to date (7-11-15). When driving home from work approaching a curve in the road I suddenly had NO power steering ! Yes, the steering failed while in motion. Still the next day, no power steering. Message flashed power steering assist / advanced track fault. Contacted local Ford dealership , stated they were unaware of anyone having such a problem. Fortunately , when purchasing this previously owned vehicle from Ford dealership, I also purchased the additional extended warranty but feel I should NOT have to pay a deductible. This was a very scary situation and I am afraid to drive my car. Ford should step up to the plate and fix this problem without delay. I have been driving Ford exclusively for 35 years and am a loyal customer. Sheila July 9, 2015 I have a 2012 Ford focus and my power steering went out and they are telling me 1749.00 to repair, thus should definitely be recalled. Noone this day has 2000 to drop into a repair on a car that’s 3 years old. If it would have been a regular power steering pump I probably would have just had it replaced and not thought about it, but it shouldn’t go or that quick. It seems like if you’re are going to put expensive parts in a inexpensive vehicle they should last longer. How do we become part of this lawsuit? Kristy July 9, 2015 I have a 2010 Ford Fusion and I am having the same issues as everyone else. Power steering Assault failure. It quit on me while I was pulling out at a major intersection. I do not feel that I should have to pay all of this money to get it fixed. Please help me get in with this lawsuit. Sylvain July 8, 2015 I have a Fusion SEL 2010, i didn’t use the car for 4 days, moved it about 15 feet, turned it off, the 10 minutes later turned it on and no more power steering, checked all the fuses everything is good. Is this class action valid also in Canada ??? kacie July 7, 2015 My 2012 ford fusion has done the same thing!!! $1500 to fix the power steering! I do not feel i should have to pay this!! People own cars for years and years and they never have a problem with their power steering! Obviously it is a problem with the make of the cars!!! When will anything be done about this? Im not asking for money or anything like that….i juat want them to fix my damn car! Chantell July 6, 2015 I have a 2012 Ford Fusion. Last week I had a flat tire, I put on the spare and had the tire replaced. Since then the power steering has gone out. After reading some of these comments i know I am not the only one. I live in a rural area, its about 40 miles north and south of the nearest city. I have 4 children whom I need to provide transportation for. This car is not safe. I do not that the $2200 to fix this problem. Do I qualify to be added to this case? Michelle July 3, 2015 The same thing happened to my Newly purchased Fusion. The tire went flat and after the tire was changed there was no power steering. I was forced to drive miles back to the dealer or pay out of pocket for towing. The dealers did some repairs and had to align the wheel The power steering still make a very loud grinding noise. mike July 2, 2015 I have a 2012 focus my power steering went out..bought it from Elsinore Ford…had it towed and Ford looked at it and said the powering steering gear was out and needed to be replaced….my car is only three years old and take very good care of it as far as changing oil, ect..it has 76,000 miles on it and of course my warranty went out at 60,000 miles I was told it was going to cost me 1,700 to be repaired I was floored…my car is only three years old I felt it was still a new car to me I told them I’m a single dad and did not have the money…they then said I owed them 150.00 for looking at the car…I told the lady how I felt about ford and they decided to waive the 150.00 and asked instead of fixing they could put me in a newer car I said I only have a couple years left on payments and have no money for a down payment…they said save a little and come back…my car is now a paper weight unroll I run into 1,700.dollars….owning a car for three years I would never expect I would have to pay that kind of money for repairs….if you want to buy a ford you better buy the extended warrenty or don’t buy one….just Google all the problems there having.. Katanya June 30, 2015 Today is my day. For my 2010 Fusion it was only happening when I started my car. So I was never on the road and it stopped working. Thank God!! Today I started my car and it came on so I turned my car off and waited a few seconds and restarted and it automaticatly came on. I restarted my car several times and still the same. So I’m home waiting on a friend to come and check it out. I’m not trying to pay any crazy $$$$ that I don’t have. Cassie June 29, 2015 My fusion has bad nothing but problems. my power steering went for the second time in 3 months. I have already had it fixed once. I have been having problems with the breaks and rotors.as well as other little stuff that has gone wrong with my car. I’m spending as much on repairs as I am in my.car payments. I work 45minutes from home and I keep.having to miss work for car trouble… Fran June 26, 2015 We too own a 2010 Ford Fusion SEL. Two days ago I left home, drove half a block to the gas station, put gas in, left the gas station and less than a mile from the gas station lost power steering and car would not accelerate. Luckily, I was just getting up some speed when the car lurched and a red wrench lit up on the dash. I wasn’t going too fast and managed to get it off the shoulder of the road. I was going to meet a friend and she came to my rescue. We decided she would bring me home and we would leave the car there. I shut the car off. Then decided to see if it would start. When it started it made so.e strange sounds, as though it was resetting itself. Much to my surprise I was able to drive it home safely. I have not driven it since. After reading these comments from fellow Fusion owners, I’m thinking I need to dump this death trap and get a Chevy. tangela June 20, 2015 I have a 2012 ford fusion sel and I have had nothing but problems with this vehicle! The power steering has gone out twice in less than 2 months! The throttle body has been replaced and I have had some wiring issues. The low tire pressure light stays on as well as the seat belt light. Never again will I buy a FORD!! They want my car note but don’t want to take responsibility for their screw ups!!! Heather D June 19, 2015 I have had to fix this problem 3 times! I am sick of this car and the Ford company not doing something about this problem. The reason for 3 times? First time codes were cleared and Ford said my tire pressure was not right in my brand new tires. Second time Ford said I needed an alignment and new tires! What? So naturally I take my car back to tire shop and Ford overinflated my tire and ruined them!!!!! Third time went to a different Ford dealer and surprise it has nothing to do with the tires it will cost me $2000 to fix it! Need to get rid if this car and not ever buy Ford again if this is how they treat their customers. Jeremy June 15, 2015 I have a 2011 Ford fusion with the same problem. It started a month ago with the first incident and has occurred three other time since. All of my occurrences have happened at sloe speeds right after cranking the automobile. Ford needs a recall to replace the faulty equipment. I place my wife and kids in this vehicle daily and I do not feel safe with them driving. mike June 14, 2015 Have the same issues with 2010 Ford Fusion. Both advance trac system and power steering assist. Dealer states the rack needs replaced and car is out of warranty and will cost approx $1,800 to fix. This is absolutely unacceptable for a car that had only 55,000 miles of mostly city driving. Would like to know how we become part of class action law suit. Dustin June 13, 2015 I called the NHTSA and it is still under investigation status we just have to be patient and wait until Ford does a recall that includes the 2010 Fusion Base Models. Mine has the same problem and it really is irritating!! Lesa June 5, 2015 I am having the same problems described in this article and I don’t feel โ have to pay all that money to get this replaced I have taken my car in on numerous recalls Breona May 31, 2015 I have a 2010 Ford Fusion SEL. One day my tire pressure got low, and as i turned the corner to the tire shop that was on the adjacent corner my notification panel stated service power steering soon. i parked at the tire shop, turned the car off , got the tire changed, and when i started the car again there was absolutely no power steering. i’m not going to pay 1700+ dollars for a repair because i’ve read instances similar to mine where the repair was done and the issue still remained. so i would like to know how can i become a part of the lawsuit. the failure in my power steering cause my car to get hit by another driver because it was so stiff and i could not navigate the car out of the way. Since then my power steering comes and goes when it pleases and this is very dangerous for obvious reasons. PLEASE HELP ME. I PAY A LOT OF MONEY FOR THIS CAR AND I CAN’T EVEN DRIVE IT. HOW CAN I BECOME A PART OF THIS LAWSUIT? michelle May 31, 2015 i just bought a CPO 2011 ford fusion in march of 2015, i was driving along a road at 50 mph and all of a sudden i get warning lights saying steering malfunction. the wheel locked up to where i could not turn it. i called a ford dealer and they told me for 250 they would scope the car to see what was wrong. i explained that this is a CPO and it has a extended warranty. he then said Oh there is a recall but we will still charge you for scoping the vehicle. i am a single mom where my hours vary week by week. i drive 500 miles a week for work so i need this taken care of . i thought this would be a safe car to take my 5 month old in as well as take me to and from work and college. i cant even trade in the car cause the dealer who i bought it from screwed me over on the deal larry May 29, 2015 i called a ford dealer today and they said 1,200$ just for the part, plus labor . Kathy May 29, 2015 I was getting ready to exit off of the highway when the alarm sounded and the message read power steering assist fault. When I started to turn I had no powering steering at all and I almost had an accident. I contacted the Ford dealer and they said that there was not a recall issued for this problem. The Dealership said the part alone was $1200 OMG! How do i get added to this CLASS ACTION. I researched to see if there were any recalls on tow Power Steering and come to find out they are all on on the Ford Trucks, now if the trucks are having issues from 2010 thru 2015 the cars will have the same problem as well. Travis May 23, 2015 My 2012 Focus steering rack failed while i was driving the other day, just got it fixed in the shop yesterday, $1400 -_- very dangerous EARL May 23, 2015 2010 Ford Fusion Hybrid. EPS failed as I pulled onto a highway. Very dangerous situation. This is why we pay to have a National Highway Traffic Safety Administration. Let’s make them do their job before there are fatalities. Dawn May 22, 2015 I have a 2011 Fusion that the power steering control module went out today. Luckily I was in a parking lot and not pulling out on a main road. Luckily my husband is a mechanic but it is still gonna be VERY pricey to fix. NEICY May 22, 2015 My power steering went out while my teenage daughter was driving home from work one night. I took it to Mr. Tire and they said a lot of codes came up they did not understand. I took it to Advance Auto and the guy said a code came up and I called the dealership and they want to charge me $140.00 an hour just to tell me whats wrong with it. Well my car has been parked for three months now and I am still making payments on it.
