Mazda Class Action Lawsuit Filed Over Engine Defect

Mazda faces a class action lawsuit brought on behalf of vehicle owners, alleging that the automaker intentionally concealed information about an engine valve defect and has refused to repair the problem. 

The complaint (PDF) was filed in the U.S. District Court for the District of New Jersey on August 21, seeking class action status to represent all owners of Mazda vehicles that used engines equipped with a variable valve timing (VVT) assembly.

According to allegations raised in the Mazda class action lawsuit, the variable valve timing assembly has a “propensity to fail prematurely,” which may cause the engine’s timing chain to loosen or detach, leading to partial or total engine failure.

“Although this defect is covered under Mazda’s powertrain warranty, Mazda fails to repair the defect under warranty,” the complaint indicates. “Mazda has had actual knowledge about the VVT assembly defect since at least 2007. Unfortunately, as part of the purchase process, Mazda has concealed material facts regarding the defect from purchasers and lessors of vehicles equipped with a defective VVT assembly.”

The lawsuit claims that Mazda’s standard response to complaints about the VVT defect is to maintain that the vehicle owners failed to provide sufficient proof of engine oil changes. The automaker’s standards are subjective and designed to make sure it does not have to acknowledge or repair the defect under warranty, according to allegations raised in the class action.

Vehicles that allegedly have the defective variable valve timing (VVT) assembly include the Maza CX-7, Mazdaspeed 3, Mazda 6 (2.3L) Mazda3, Mazda5 and MX-5. None of the defective engines have been in production since 2010, according to the complaint.

Mazda allegedly attempted to cover up the engine defects to uphold its claim that its vehicles will be “free from defects,” a statement made in its warranties, the lawsuit maintains. However, class action indicates that the company has known about the problem since November 2007, when it issued a technical service bulletin (TSB) to dealers stating:

When the engine is started, some vehicles may exhibit a loud ticking noise from the variable valve timing actuator at first start for a couple of seconds. This is caused by the lock pin of the variable valve timing
actuator not fully engaging. Heat treatment has now been added around the hole of the variable valve timing rotor lock pin to prevent this from happening.

The lawsuit says that the company determined that the variable valve timing assembly problems were caused by inadequate or improper hardening of the components when they were first manufactured and attempted several times to fix the problem.

The company has also received a number of consumer complaints about variable valve timing assembly failure leading to catastrophic engine failures, according to the complaint.

In January 2012, the company launched a “Special Services Program” for owners of vehicles affected by the problem, saying it would extend the warranty coverage specifically to repair the VVT on vehicles equipped with its L3T engine. it extended the warranty one year or 10,000 miles. However, the lawsuit claims that Mazda referred to the problem as a noise concern and did not advise consumers that it could lead to catastrophic engine failure, and excluded a number of vehicles with the defective VVT from the program.

The class action lawsuit for Mazda vehicle owners indicates presents claims for fraudulent concealment, breach of warranty, and violating consumer protection laws.

we have a 2010 cx-7 turbo, and last month it thru a rod at 78k miles. after 3 grand spend on a replacement, they returned it to us last week w/ electrical problems, so i got those fixed at another shop. drove it for two day, got some bad misfiring/hesitation yesterday. today, took it to a fiend who i trust that has a shop so he can tell me what’s wrong so i can know what to say to the people that changed and the engine, i told him to test it out, and the engine THREW ANOTHER ROD! i’m afraid installing shop, american auto parts & salvage are going to try to shirk their 3 month warranty by saying some other part of the engine (like the turbo) made the engine fail.

Bought a 2010 CX7 off the showroom floor. Turbo went with about 25000-30000 miles on it. Stuck on the side of route 64 taking my 13 year granddaughter to the beach for a week. Had to wait 4-5 hours for a tow. Then with in about 6 months had to have front rotors replaced they looked as if the whole front of both sides where so bend out I could not believe the car was even still on the road. The BS story they came up with was the car set to long. We drove it everyday to work. About 3 months ago my wife was going to work and the car started missing very bad. Took to dealer and the list of things that needed repaired was unreal. Every gasket was leaking and I mean every gasket. Oil,transmission,radiator Valve cover gasket. Also had to have plugs and wires replaced. Just to mention a few. I’m 65 years old and I have owned a lot of cars in my life but this CX7 takes the cake. When I was in the shop the call me and say they have great news for me. There is a recall on the timing belt. Now would you not think I would have received a recall notice. Now after have the plugs and wires replaced I have a valve ( number 3) that is misfiring. It looks to me has Mazda is building their cars with subpar parts. And from I’m reading here something needs to be done. Like get all the money back for cost of repairs. Better yet give me back the $30,000 plus that we paid when we bought the car.

I too can now join this club of engine fail. When I originally bought the car I had it less than a year before the engine light came on. Took it in 5 times and everything they claimed to replace the engine light would be back on withing a week. Now it stuck in 3rd gear and apparently it’s either the cars computer or a transmission. I’ve paid for way too many repairs on this car and am completely over it. Definitely will not be buy another Mazda again. This is just ridiculous.

I am in the same boat also. I have a 2006 Mazdaspeed 6 2.3L turbo that is well over the extended warranty for the vvt assembly. It has been making that rattling sound on start-up for quite a while now. I tried looking for some parts to fix it and I found and bought a kit on Edgeautosport.com that is supposed to fix the whole problem. I spent about $400 on the kit so now I just got to see if any of the mazda dealerships will work on it for me, or maybe find a skilled mechanic. Don’t know if I’ll own another mazda either…

Well I guess I’m joining the club along with everyone else, real nice of a company selling defective engines on a beautiful car for a mere 28,000 dollars, and their response is to pound sand. Companies like this should not be able to sell merchandise to the public, unless they honor their defective products. Not a scratch on it, and while driving it on the highway a few days ago it seized up and shut down. steering wheel locked up and thank god i pulled over when i did! anyways i NEED A NEW ENGINE!! ARE YOU SERIOUS?!!! it only has 68k miles on the damn thing!! I paid 28 grand for it in 2007 and its paid off. now this! I’m a single mom who doesn’t even have $20 in my pocket and now Mazda wants me to pay 10 grand for a new engine!! I CANT AFFORD THIS!!!! I googled this and looks like more and more people are having the same issue on them! YOU SHOULD OF HAD A RECALL ON THESE!!! BAD REVIEWS OF PEOPLE BUYING A NEW ENGINE UNDER 70K MILES!!!!!! I have an 03 mazda6. I bought it used in March 2016. 2 months after buying I had to replace the engine due to the lifter ticking. W months into driving the replacement engine threw a rod. I have no choice but to replace the engine once again. I will never oen a mazda ever again.

Just realized what that noise I’m hearing at about 3000 rpm. It’s the VVT! Just had the compressor replaced at local Mazda dealer for $1372.00. Now I don’t know whether to just sell the car and buy a clunker or put aside more money to get the VVT and associated parts replaced. Never buying another Mazda…

Purchased a 2007 Mazda CX-7 as a new vehicle and am the only owner. I’ve replaced the air conditioning, a door lock assembly at a cost of about $2000, until recently. My daughter is using the vehicle (just over 120,000 miles) and in the last 4 months I’ve spent over $4,000 on timing chain replacement, fuel pump replacement and several other parts trying to get the vehicle to run properly, but to no avail. I liked the vehicle until these problems started and cannot seem to be resolved with out spending another$4000-$5000 on the vehicle. Mazda has known this engine was a major problem and have done nothing to resolve the issue. Will never own another Mazda in my lifetime!!!!

2008 Mazdaspeed3: About a month ago, the compressor locked and had to be replaced for about $1600. Then, engine completely fails without warning. Mechanic said the rings got so hot they turned blue and the cylinders were warped and twisted. Now, I need a completely new engine for $$$THOUSANDS$$$ of dollars. I’m completely disgusted. I still have payments on the car and can’t even cancel the ridiculous high insurance. I don’t know what to do. A lawsuit settlement would be very helpful. I’m upside down in this mess. I too am left with a vehicle I can’t drive and still have payments.

I recently took my Mazda CX-7 in for a check up before my vacation. Everything checked and was good. Drove 2800 miles came home safe. Then my daughter drives it to work and it stops in the middle of the road. Now 3 tows later and a quote for a new engine of 7000.00 I am left with a vehicle I can’t drive and don’t know where to go from here.

Purchased a 2007 Mazda CX7 for my son for college. 89k miles on it and test drive was great. He made it up to Reno from Las Vegas and within the first two weeks the VVT issue occurred with the timing chain coming loose and destroying the engine as it is a interference engine. I am beside myself with this and out just over 7k dollars and a non-functioning Mazda. Would love to know more about the lawsuit.

I have a 2007 Mazda CX7 and had the ticking sound and never knew it was a serious issue, I was told that it may stop and I was told not to worry about it. Last Month is had an issue with the car not restarting I thought it was a bad starter and replaced it and found out it still would drag and not turn over. I had it taken to a larger garage and they called and said TAG YOUR IT. Well the engine had locked up and that’s why it was dragging. I don’t have the money to replace the engine it may do the same thing again. So I’m stuck with a large paper weight. I want to thank the integrity of Mazda for helping nobody with the issue sound like they had knowledge sense 2007, same year as this engine, a paper weight. Sad thing is it had low miles for an 07 all I can do it get another vehicle Im not going to pay $5700 to replace it with a used engine and its too old to sink that much money into it without any correction.

Bought a 2008 mazda cx-7 last year with 64000 miles on it. problems started about a mth in the loud ticking noise which tirned out to be the actuator. I had this replaced along with a new timing chain. When I got the car back power was significantly lessened and it failed emissions. Gave it some time regained some power only to find out there was a massive active leak but its not an oil leak or a transmission leak. The car however does have an oil leak in the rear main seal so I’m constantly monitoring and maintaining the oil. The fucking vehicle has been a nightmare with repairs. I also had to replace the ac compressor which seized and tore the belt. I’m just trying to find the leak to slow it to sell it ….fuck this car and fuck mazda. As soon as ford got their hands on them these below par shit engines and transmissions came into existence!

I purchased a 2008 CX7 from the Mercedes dealership in Naples FL this past Feb. At the time of purchase the dealership at the vehicle listed at 80800 or so miles. However the odometer indicate 60800 or so miles. The vehicle now has under 65,500 miles on the odometer. This past Saturday 07/09/2016 the engine developed a skip and the check engine light came on. Drove the vehicle this way for about 2 miles until I got home. I also noticed that the vehicle had lost quite a bit of power. I have a code reader and found the fault code to be P0302, misfire in cylinder 2. Changed all the spark plugs and #2 coil. Made no difference. Monday I drove the vehicle to a local repair shop to diagnose and repair the problem. Late this afternoon the shop owner called me and provided the following information. The #2 cylinder had low compression. Without taking the engine down for an inspection, he believes that the timing chain may have slipped out of proper timing and that a valve in the #2 cylinder either bent as a result or is burnt. Checking with Mazda, the head for this engine is on back order for another 2 weeks. a new complete engine is not available. If the block is okay, the cost of placing the timing chain and head would be in the neighborhood of $3,000. I contacted the local Mazda dealer and spoke with a service rep. After explaining the symptoms I was told the following. That the 08 2.3 engine has been known to have this problem. That this was the initial production of this engine being equipped with a turbo and that the engine components would eventually fail due to this pressure. To replace the complete engine, parts and labor would be about $8,000. That is what I paid for the car before tax and tag. Monday the upper portion of the engine will be disassembled. If the block has not been affected, they will purchase a new head when available and timing chain components. Hopefully these parts have been improved on and that the cost will not exceed $3000. Lesson learned, my first and last Mazda. I would rather own a VW even though they are guilty of mileage tampering. At least their vehicles do not suffer from major engine failure.

I bought my Mazda 3 new in 2004. I don’t put a lot of miles on my car and the engine was blown at 22,000 miles!!! It was after the warranty years wise so I had to pay $7500 for an engine rebuild. Now I have 32,000 miles on my car and its making the same noise again!!! Do we have any options here?? The last repair put me in delinquency and I still haven’t recovered! Incredible I am glad to see I am not the only one but still very frustrating, I purchased a used 2007 Mazda 3 with the 2.3 L engine about a year and half ago no problem until the other day with only 60K miles I hear this terrible knocking sound, i take it straight home and then straight to the auto shop. the oil and service has always been prompt and taken care of. Make a long story short the gentleman at the auto shop tells me I need a whole new engine. I cannot believe this it had no signs of anything wrong no warning lights no nothing it just starts knocking like crazy. I do not know what to do either.

hey marty did you have any luck at the dealer? I have a 2007 cx7 and that loud vvt noise started around 500 miles ago. It always had a tick and it bothered me but mazda denied it saying that is was normalof course. I plan on taking it up to the stealership this week.

They have to honor the warranty you only need to provide proof that service was performed. Even if you did it yourself you only have to give them receipts for supply’s purchased. If you do you service yourself always put the date and mileage on the receipt.

I have a 2016 Mazda 3 with 25000 miles on it. The stop vehicle light came on, I pulled over. No coolant. I had the vehicle towed to my dealership and they say the motor is blown!!! They have ordered a new motor and now are telling me its NOT under warranty as I had my oil changes not done at a mazda dealership but at a midas oil change service center. These oil changes were done every 3000 miles(have all records). Can anyone help me?? What do I do? Also, it was a coolant problem NOT oil related!!!!

I bought a used 2007 mazda cx7 back in Feb 2014. If I can remember it had about 60,000 miles on it when I bought it. Always got oil changes and regular maintenance on it. Starting at the end of 2014 I realized I had a huge oil leak and had to replace the oil cooler… which costs roughly $600.00 and then about last year 2015 just before summer hit my AC compressor went out which cost about $800.00. After that was fixed, I was driving to work and pulled out to traffic only to realize I had no power to my car and that my check engine light came on, when they pulled the code it was a misfire… leading to replacing my actuator, guides, and time chain… which costed me about $2000.00 this car has been nothing but a horrific nightmare!!! here today 4/7/16 driving to work and I hear a very loud whinning/humming noise either its my turbo or the transmission… my car wouldn’t go over 40 mph 🙁 … sooo off to the shop again! I am so over this car!! I really don’t understand why mazda hasn’t recalled on any of this!! we all have had the exact same issues!

lauren, I feel your pain. I too was having the same problems. I was smelling rotten eggs, which was the oil burning off in my cat. 10,000 miles later cylinder 2 lost compression. I was adding a quart of oil a week between regular oil changes. pull your plugs and find the one that’s soaked in oil and that’s probably the cylinder you will lose first. I just bought a used engine hopefully it last long enough for me to dump it on some other poor unsuspecting soul.

I have the 2008 mazda 3 and even though I bought it brand new the car has had nothing but problems for 25k miles on. I have a new computer, new struts, new cluster, new clutch, and new window controls. At four months old the steering wheel locked up while I was doing 55 mph on a highway. Power steering was recalled four months later. I regularly have the oil changed every three thousand miles and my engine is losing oil all the time for no reason. Just recently I received the actuator code and now know why the engine tick is getting louder even after having the oil changed. This is no simple fix and after fixing the clutch I am pissed my money was pretty much wasted because I can’t put anymore money into a car thats probably going to die soon. This is my second mazda and I have had nothing but car problems for the past ten years. I will never buy a mazda again. I strongly encourage people that ask me about my car to never get one.

I have a 2008 MazdaSpeed3 with 57K miles on it. Always kept up with oil changes and maintenance. Drove it a few blocks away from home a few weeks ago and Boom! Blown engine, piston went right through the bottom of my engine.

I have a 2005 Mazda3 that I have loved, babied, and stayed proactive on preventative maintenance and suggested maintenance. It first started having its major problems at the 92,000 mark where the #3 motor mount had to be replaced. Then at 119,000 the AC compressor went out and burned the AC belt off. While they were changing the AC compressor out we went ahead and changed the serpentine belt and added a new AC belt. The engine would’t turn over, sounded like engine seized, and blew fuses, and ultimately would not start again. I’ve spoken with Mazda customer service, mazda service center, and 3 other master mechanics who have all said they don’t know how, but they believe the timing chain skipped time, which caused the pistons to hit all the spark plugs smashing all of them, and after a compression test there was no compression. Mazda service said at this point the only option is to get a new car or a new engine which will be a minimum of $3500. I do not believe a car that has been babied and cared for should have an engine go out after a little over 10 years. It’s not right.

I have a Miata 2006, the engine blew up at 70,000 miles, with no warning light that the car was low on oil, I had checked the oil level 2 weeks prior to this incident and everything seemed normal. I have been without a car ever since, commuting to work as been a nightmare, the repair will cost around $7000. How can I get on this lawsuit?

I have a 2007 Mazda CX-7 and was pulling off the freeway earlier in the week and the check engine light came on. I immediately pulled over and contacted Mazda. Luckily the dealership was right around the corner from where I stopped. I took it to the dealership and they came up with the timing chain looseness and VVT. The funny thing is I new about the SSP and took the car to a dealership only to have them tell me that my car was fine and this was in 2013 around 20,000 miles ago. how could Mazda not have fixed the problem before only to allow it to happen now. The dealership is saying the fox is going to cost me around $2000 dollars for the repair. Will Mazda help or am I screwed?

Bought CX7 new, replaced timing chain at 58k, due to VVT defect. Engine oil ran really low at 120k due to blowen oil cooler gasket (another Known Mazda part defect). Of course there is no low oil indicator sensor/light, just my wife’s good ear and eye on temp gauge. This can cause lubrication failures, including the STILL defective VVT. No one officially offers the special oil cooler gasket, Mazda is happy to sell it only with the cooler for $450. I found a guy online who sells a home brew version that worked to fix the leak for less than $10. We always paid Mazda to do our oil changes, sometimes they put in different viscosities of oil from what is reccomended by Mazda corporate according to our service records. So now at 125k; We are experiancing louder ticking again after repairing the leak. We have complained numerous times during our ownership about the ticking and have been told “that’s normal, they all do that” I brought this to the attention of the dealer (not our regular service advisor) he said it would be $155 to diagnose the issue. Whith approval to diagnose, he came back and said we needed a new timing chain again at 125k. I complained back about this known defect, he kicked me to corporate, who kicked me back to the dealer….The only guy who stood proud, was our regular service advisor, who is getting the thing fixed without cost to us. I feel very lucky on this one. I’m still considering filing a lawsuit as my records are in great order, and Mazda corporate definitely has breached its duty to stand by its defect free implied warranty. Hey Mazda, your cars are ticking time bombs-boom boom. I feel 200k should be reasonable mileage to expect from a well maintained car regarding timing chain wear.

I purchased my mazda cx7 last year march. It was working fine up until this January. As I was driving to work on the expressway the steering wheel seized up on me and the car shut off. I almost had an accident. I pulled over and the car started up then it began to lose power and cut off again. I called for roadside service and they towed My car to mazda dealership. I was told that the timing belt came off. When I asked how did it just come off .the sales clerk said a rat probably got caught in it.her words exactly. Anyway they said that they put a new belt on and the parts. Charged me over $500 for two days later to end right back into the shop. My car is making a loud noise and shaking slightly now. It was doing it before and now I feel helpless because I feel that I may have been sold a lemon.

2015 mazda 6 starts up every time making a horrible noise then slightly goes away. Have had the car for two months it had 38,000 on it did the first synthetic oil change right away maybe 500 miles after purchase noise is getting worse

2004 Mazda 3S. At approximately 94,000 miles, my motor blew. No warning lights for low-oil. After having knocking noise, I immediately towed the vehicle to the auto-mechanic. Was informed that the oil was 100% depleted, however, I had an oil change approximately 2 months prior (1000-1500 miles previous). Mechanic did not see any visible leaks and or damage where the oil could’ve leaked from.

I purchased a 2008 Mazda CX-7 in 2011. Had no issues with the vehicle and had regular oil changes. In Aug of 2015, the engine blew just a few weeks after most recent oil change. I had the service center check out the engine the previous oil change due to a small leak. They said there was no problem and probably because of filter or excess oil. The engine blew due to the vvt actuator. I contacted Mazda, and they told me it was “no longer covered” because my vehicle was delivered in Dec 2007 and I was outside the warranty they extended. They also cost me over $300 because Mazda said they had to have it checked by a certified Mazda dealership before they told me it wasn’t covered or they would assist. So, I paid Twice to find the same thing. They would not assist even though I had proof of all oil changes done to the vehicle since purchase. All within allotted time and never was there a problem. I still owed $9K and they wanted $9K for a new engine. Not even an offer of a refurbished one. I now had no way to fix it, and had to get another vehicle and continue to pay on the Mazda. I voluntarily released the Mazda to the finance company to auction to which I will continue to pay on a vehicle that blew an engine at 69K miles. My credit is now affected because it shows a voluntary repossession! I will have to pay the $9K for the car over the next 36 months even though I don’t own it or face repossession of my other vehicle because they are Co-collateralized. So either pay, or lose my other vehicle. This is unacceptable, and I should not have to pay another dime on the Mazda CX-7. Not to mention I had to purchase (Lease) another vehicle to replace the Mazda which is costing me an additional $480 a month. Mazda is responsible for this.

My Fiance and I own a 2007 CX7. We bought it with 88000 mile 8/3/2013. Soon after we bought it we had the timing chain and VVT assemble replaced for this over torque issue. Last March 2015 we came to have this same issue again at 103000ish miles. At this time we were made aware of a possible known issue that these 2.3 liter Direct Inject Turbo Chargers can overheat and crack their aluminum housing. We have fought the Warranty company to check and replace the Turbo Charger, but they won’t stating that it’s not a confirmed solution to the issue of oil consumption. We have monitored and maintained the oil levels and changes every 3000 miles (sometimes even less). The vehicle is CONSUMING a quart of oil about every 2 weeks or 200ish miles. Then last night my Fiance ended up on the side of the road because the SUV had started sputtering and I believe the timing chain has stretched again (3rd time!!) and this time may have jumped timing!!! We now have 110,000 miles. 3 timing chains in less that 22,000 miles! What can be done? Please help?

I have a 2008 Mazda Tribute that I purchased new. The first engine blew at 28,000 miles. Was told it was not covered under warranty due to insufficient oil. I had less than 2000 miles on the oil change. I had to continue making payments on it and pay for insurance. I searched for years before finding a used engine with 30,000 miles on it. I put 60,000 miles on this engine before it blew November 2015. Again, I had the oil changed the day before it blew. No warning lights with either incident….check engine/check oil…..nothing. I was simply driving down the highway, loud noise, no engine. Very frustrating that such a large company will not back their product and have put so many lives in jeopardy physically, emotionally and financially. I totally support any and all actions to rectify this horrible injustice.

I have a Mazda cx-7 and it has literally been a nightmare. I purchased the car and drove it only to find it had no back breaks. The door handle was also loose when I bought the car. So I drove it for one and a half years. And all of a sudden my engine gives out. One day my car worked and the next day the heat stopped working and then the car started ticking and it broke down all in one day. I had just gotten an oil change four days before that. I took it to a repair shop and they couldn’t figure out why the motor had broken down. All they could tell me was I would have to get a new one. So upon repairing the car, the repair men had discovered that the previous owner had had the same problem and had replaced the engine and sold it. (I’m the second owner) now I’m trying to decide if I should put 3500 into a car for ANOTHER engine or just give it up. It seems Mazda has been having this problem with the engines going out because when I called around to get a new motor, the places started to tell me how many people were calling in trying to find one for the exact same cars. I will never buy another Mazda car.

In October 2014 I phased a 2007 Mazda cx7. It already had the timing and seals replaced in 12/2014 now 13 months later I am leaking from my timing cover/ oil pan and Mazda is saying they wouldn’t repair it cause it is passed the 12-12 mark So it’s not under any warranty and my extended warranty won’t cover cause it is not in conjuction with another failed part.

I bought a 2008 Mazda CC-7 from its previous owner. Recently divorced, single mom, not knowing anything about cars, I trusted this retired architect at his word. I had no idea of the problems associated with it. It wasn’t long until I found out. I had the car exactly one year, when my engine blew because of this exact problem. Now I ha e no vehicle and no way to het another one. Is there a way to get updates on the lawsuit, or sign up for it?

I have a 2012 Mazda 5 – Wife was driving home No warning lights came on and oil wasn’t low engine is blown. 53,000 miles on it and still owe the bank $9,000 dollars. Buying this car was the worst decision I have ever made.
