Unfortunately, as part of the purchase process, Mazda has concealed material facts regarding the defect from purchasers and lessors of vehicles equipped with a defective VVT assembly.” The lawsuit claims that Mazda’s standard response to complaints about the VVT defect is to maintain that the vehicle owners failed to provide sufficient proof of engine oil changes. The automaker’s standards are subjective and designed to make sure it does not have to acknowledge or repair the defect under warranty, according to allegations raised in the class action. Vehicles that allegedly have the defective variable valve timing (VVT) assembly include the Maza CX-7, Mazdaspeed 3, Mazda 6 (2.3L) Mazda3, Mazda5 and MX-5. None of the defective engines have been in production since 2010, according to the complaint. Mazda allegedly attempted to cover up the engine defects to uphold its claim that its vehicles will be “free from defects,” a statement made in its warranties, the lawsuit maintains. However, class action indicates that the company has known about the problem since November 2007, when it issued a technical service bulletin (TSB) to dealers stating: When the engine is started, some vehicles may exhibit a loud ticking noise from the variable valve timing actuator at first start for a couple of seconds. This is caused by the lock pin of the variable valve timingactuator not fully engaging. Heat treatment has now been added around the hole of the variable valve timing rotor lock pin to prevent this from happening. The lawsuit says that the company determined that the variable valve timing assembly problems were caused by inadequate or improper hardening of the components when they were first manufactured and attempted several times to fix the problem. The company has also received a number of consumer complaints about variable valve timing assembly failure leading to catastrophic engine failures, according to the complaint. In January 2012, the company launched a “Special Services Program” for owners of vehicles affected by the problem, saying it would extend the warranty coverage specifically to repair the VVT on vehicles equipped with its L3T engine. it extended the warranty one year or 10,000 miles. However, the lawsuit claims that Mazda referred to the problem as a noise concern and did not advise consumers that it could lead to catastrophic engine failure, and excluded a number of vehicles with the defective VVT from the program. JmsWltn July 15, 2015 2006 Mazda 6 2.3 120,000 meticulous oil changes 4500 miles or less. full synthetic every time. never (EVER!) used a drop of oil in between changes. 2 days ago we get a knocking sound merging on to expressway but went away. got home checked the oil and was low. added 1..2..3.. and 1/2 quarts of oil to top it off, REALLY!?!?? there is no leaks no smoke no residue on/in/around the tail pipes or bumper and no drips or oil collected anywhere. Its as if it just vanished from the engine. Today (yep 2 days later)the knock showed up again checked the oil, a quart down. now i have a steady tap/knock that gets bad around 2100 rpm. I have been on the mazda/ford forums and am not at all the only person this has happened to.. some as low as 64k miles. we also had the all of a sudden transmission no reverse jump gear transmission failure at 37k but fortunately they covered that under warranty. and we never saw better than 23 mpg in this thing.. what a piece of crap! chakata July 14, 2015 i bought my cx7 back in 2007 brand new on the lot and is very fortunate that it stills run today. yes i have all the same problem as you all do but with alot of care and replacement it stills run. i’m most upset with the dealership giving me the run around when i have issue. i took my car in for an oil change and was charged for when the job was never done. i got into wth the manager and still nothing was resolve. i know when oil is changed or not cause i do them myself. after the incident i never went back. service is poor. major work done on my car is wheel bearing, ac compressor,inner and outer tie rod and yes my timing is bad with hissing noise but still taking chances to this day and last is oil leaking. Called Mazda customer service, after 2 weeks of “reviewing records” they say car is out of warranty. Clearly they did not listen to the first 5 min of the phone call which they asked me for the mileage and it was evident. DACHON June 8, 2015 I purchased my 2008 CX-7 Grand Touring used from CarMax 3 years ago. In July 2014, the VVT system went out at 90,000 miles. Of course it was not covered through Mazda, however my extended warranty covered the cost. The car has been in and out of the shop 8 additional timed since then. Three of the four cylinders had to be replaced (one going out 50 miles after getting my car back from the shop), the transfer case needed to be replaced along with a host of other problems. Last week I hear a pop and a bunch noise form under the hood. Turns out I threw a rod that shot through the engine. The engine, starter, turbo, transmission, drive plate, etc. ALL have to be replaces at a cost of $16,000! My extended warranty will not pay because it exceeds the value of the car. I’ve maintained my car and have receipts to prove it…in fact, I had an oil change 4 days before this occurred. I believe that the mechanical issue was known about at that time, but I was not informed. The car’s engine light would come on and I would take it to the dealer from which I purchased. I was told about other problems which would be fixed and the light would come back on a few days later. The last time I took the car back I complained about all of the symtoms of the turbo going bad. White smoke from tail pipe, jerky motions, oil burn. They reprogramed a sensor and that was it. They never mentioned the extension on the warranty. Come to find out it had expired a couple of months after the last visit to the dearler. I’ve just had it at an independent foreign repair shop for the timing chain repair. Within a couple of weeks “new” timing chain gave out, and another new one was put in. Noise never went away, oil leak started after timing change work was done. Last week the vehicle stalled on myhhusband on his way to work. He called me to get it towed. Not 10 minutes after husband left vehicle on roadside, it went up in flames! Spontaneous combustion! I was lucky not to have been stranded on the side of the road with a bad engine. I taked a service rep last time I was in mazda why they quit making cx-7. He told me bad timing chains. Engine failed a month ago on the interstate in my home state of Florida. Cost of repair has been stated to be $8,000.00. The cost figure includes a used engine with 8,000 miles on it. Year at this writing is unknown. Car is still in the dealership waiting Mazada parts necessay to finish repairs. This is the third Mazada that my family has owned and it will be the last. The local dealership is of little help and the corporate office in California is a joke. I wanted to address a letter to someone in authority and was told that policy forbade it. Morrison February 13, 2015 My wife and I were in the market for a vehicle the summer of 2011. We had a check from our institution in the back pocket so we went searching. Our search starts with the Toyota Venza (new), and the Infinity Q35 (pre-owned) . We visited approximately 5 dealerships the weekend previous to July 4th, 2011 – alot of test drives, alot of negotiations which were close, but not as satisfactory. After not moving the needle as much as we had desired, my wife has an idea to check out the dealership of Mazda in Huntington Beach. We look at the Cx7 & Cx9 (new) and after test driving a few, she decides to look into the Cx7 as she was previously unfamiliar with the vehicle. After mulling options over (blank check was good for up to 40k in financing, 4.1 APR) she decides to purchase the Mazda (24,900). We select a model, which has 13 miles on it – and though others (Venza, Infinity) were her chief desire, she believes that the decision was a good, more economical one. We (she) purchases the vehicle July 4th, 2011. One month in, the front driver tire blows out on the 55 freeway in Costa Mesa. The car is driven to the dealer the next day – to have a tire placed on. The price was surely “surprise surprise” – $250.00. We push to know why the tire was so expensive, it’s because the size is new for this size vehicle and there’s one maker of the tire. Bridgestone. We pay for it begrudgingly, and go about our way. Fast forward to February 6th, 2015, a shade over 3 years, 6 months of owning the vehicle. The vehicle history is good, maintenance is excellent (my wife is a therapist for children with autism so that’s why vehicle choice was extremely important – traveling client to client in administering therapy sessions) and without warning, she cannot reverse. She can drive forward, yet is losing power when the automatic attempts to shift from 1st to 2nd gear, so it jumps from first to 3rd. We take the vehicle to Browning Mazda in Cerritos and we are advised that the transmission needs to be replaced ($3,200.00). 3 years 6 months 64,262 miles, excellent maintenance history, & this vehicle needs a NEW transmission? This felt like a terrible joke. The power train warranty? 3y/60k. Expired just over 4,000 miles ago. If there’s an engine issue, we usually receive a warning (ie – check engine light flashes on when the oil hits around 3,500) – yet for a failed transmission the vehicle took a dump without warning. We contact Mazda (corporate) & are advised later in the day that they would pay half of the ticketed amount. That’s still egregious as there wouldn’t be a vehicle sold if most buyers knew that at such ridiculously low mileage, the transmission would fail them. We retrieve the vehicle and have it looked at for two more opinions and apparently there are no codes indicating the transmission is bad, yet it’s obviously the transmission according to the mechanic as indicated simply by the test drive. One transmission mechanic wanted to advise us that Mazda contains many Ford parts, including the transmission and the parts itself. He opens a book, shows a Ford Escape transmission cover (as an example to start) & shows the transmission cover for a Mazda Cx7. The covers??? Same shape. Same size. Same diameter. The only difference was the material each was made out of. He also advised us that Ford held a controlling stake in Mazda for a very long time and that Mazda in engine make up is similar to many Ford vehicles. I’m thankful for such insight as now, my wife, she’s apparently back to square one now & cannot trust a Mazda vehicle. We will just take it on the chin, pay the dealer, trade it in and get into the vehicle she wanted to originally (Toyota Venza) as it has a powertrain of 7y/100k, and we have another blank check and a few we are willing to pay more of a premium for now as opposed to settling (which appears now, that we did). My advice, if you could help it remain in a Toyota (I drive a Lexus and plan to remain with Toyota) or Honda (my wife bought a Civic new in 2001, drove it to 2011 without issue, netting 170k miles before selling to a UCI college student, then purchasing this Mazda vehicle). If my story helps you even a little bit, I am definitely thankful. This experience feels completely underhanded and we feel hoodwinked. Rhonda January 5, 2015 My 2007 Mazda CX7 with just barely over 100,000 miles on it, has been sitting in Cheyenne, Wyoming, where it broke down repeatedly on a family vacation from the exact reasons stated in this article. It was a complete nightmare and a story that many people cannot believe.Over $3000 in repairs on the trip (not to mention hundreds spent on rental cars, hotels and tow trucks) and we are now waiting for a new (or used) engine because the VVT failure destroyed the engine and kept us from continuing our trip. We have been on a “waiting list” for a new or used engine since July of 2013 … and are still #20-something on the list. That right there should tell you there’s a HUGE problem! I changed the oil every 3,000 miles on that car – even took it to the dealer to have it changed – I LOVED my CX7 … so they cannot blame lack of oil changes for the problem! I just cannot believe that Mazda can have such a catastrophic defect in their engine and not be held accountable. We are now looking at another ~$6000 to replace the engine on a car that was 6 years old when a known defect left us stranded. Did I mention that the vehicle has also had the radiator replaced AND a new transmission? Oh … AND our 2001 MAZDA Tribute, in 2010 while parked at my husband’s office, caught on fire from some sort of short circuit in a control panel. Needless to say … we are DONE with Mazda! Sherry November 18, 2014 2007 Cx7 Grand Touring 78,000 miles Four days ago while driving 40 mph, the CHECK ENGINE light suddenly went on and a tapping noise was heard as the car downshifted from 6th to 3rd gear on a slightly inclined roadway. It immediately shifted to 6th gear once reaching the flat area of roadway and appeared to drive normally the distance home (3 miles) unless the road inclined. The light remained on. Nervous, I arranged a flat bed tow the 26 miles to avoid any damage to the car figuring I was playing it safe and due to no available service being open, I had to wait til Monday to have the car towed. At the dealer, they started it right up and said it seemed normal except for the light being on so I relaxed and walked to rent a car across the street for a one day term like they told me to. I asked how long this would take and how long shall I make a rental contract for and they said “do what you have to, We have no idea right now.” Today I called when I still heard no news about the car, I finally got a “preliminary” report that a timing change issue occurred the computer reported a VVT issue and they were still in the process of estimating damage, costs and would call when they could talk about it. I was devastated as I hung up the phone. My car was in perfect condition and maintained by Mazda service only at every recommended service and oil change schedule. Having only 78,000 miles I find it unbelievable this happened at all. Mazda USA said they “May” make an exception to the 70,000 extension given in 2012 which I never even knew about and should have as the sole owner of the car. Now that it is 8,000+ miles over that courtesy extension because they knew of the defect I will have to wait a full review of records and Mazda conferring the dealer about what is going on. While this happens I am out the cost of the tow, and rental fees for a car with no indication from anyone as to how long this will all take. I have always bragged about my car and the amazing service I have been given by Mazda but today, I feel like I paid $35,000 for a car I will never be able to drive again and have no way to replace it right now. Wonderful and beautiful car due to my moms superior care of the vehicle since she bought it and my nagging to never listen to the page that states that you should change the oil every 7500 miles. I knew there was something up with that, there are complaints everywhere about Mazda’s inconsideration to their customers and false cover ups. She will be very interested to hear about Mazda’s incompetence and ridiculous ways. I have lost all respect for Mazda. If they would cover this up, what else would they cover up?
