Mentor Breast Implant Lawsuit Filed Over Mold Infection, Bio-Toxin Disease

Complications from leaking breast implants allegedly caused a Georgia woman to develop a mold infection, which led to bio-toxin disease, according to a product liability lawsuit filed against Johnson & Johnson and it’s Mentor Corporation subsidiary. 

The complaint (PDF) was filed this month by Melissa Shirley in the U.S. District Court for the Northern District of Georgia, alleging that her Mentor saline breast implants were defectively designed and unreasonably dangerous.

Shirley underwent breast augmentation surgery in June 2003, at which time saline breast implants manfufactured and sold by Mentor were implanted.

More than ten years later, in 2015, Shirley indicates that she was diagnosed with bio-toxin disease, which is often caused by exposure to mold and results in severe and chronic inflammation and a number of resulting health problems. According to the lawsuit, Shirley developed this condition due to problems with the Mentor breast implants, which manifested as enlarged lymph nodes, sternal pain and mastodynia.

On May 14, 2015, Shirley had the breast implants surgically removed, at which time it was determined that the breast implants were leaking.

“Plaintiff, her prescribing physicians, and her health care providers neither knew nor had reason to know at the time of Plaintiff’s use of The Implants of the aforementioned defects,” the lawsuit states. “Ordinary consumers would not have recognized the potential risks for which Defendants failed to include the appropriate warnings.”

Shirley presents claims for product liability, negligence, strict liability, breach of express warranty, breach of implied warranty, and negligent misrepresentation.

Breast Implant Health Risks

The complaint comes amid increasing concerns about the risk of problems with breast implants used during augmentation and reconstructive surgery in recent years.

In March 2017, the FDA issued a breast implant cancer warning, indicating that it was aware of at least 359 medical device reports involving women diagnosed with a rare form of non-Hodgkins lymphoma, known as breast implant-associated anaplastic large cell lymphoma (BIA-ALCL). The illness has been linked to at least nine deaths.

The agency indicated at the time that the lymphoma cases appeared to be more common among breast implants with textured surfaces, as opposed to smooth breast implants, but a definitive connection was not able to be made.

Australia’s Therapeutic Goods Administration (TGA) launched an effort monitor the association between breast implants and anaplastic large cell lymphoma, more than doubling the recognized number of cases identified among Australian patients between September 2016 and April 2017.

Researchers from the TGA published a study in May indicating that side effects of textured breast implants may be linked to a 14 times higher risk of ALCL in some cases.

The TGA has estimated that the breast implant lymphoma risk may be between 1-in-1,000 and 1-in-10,000, with most cases occurring between 3 and 14 years after implant, but the median being 8 years and some cases diagnosed as much as 37 years after breast surgery,

Due to the potential lymphoma risk with breast implants, regulators have made efforts to increase awareness among health care providers about cases of the rare cancer linked to textured breast implants, indicating that they should discuss the benefits and side effects of the implants with their patients.

The FDA has also recommended that doctors consider the possibility that a breast implant recipient is suffering from anaplastic large cell lymphoma (ALCL) when they present with late, onset, persistent peri-implant seroma.

In the United States, a growing number of women are now considering potential breast implant lawsuits against the manufacturers of the products, alleging that inadequate warnings have been provided for consumers and the medical community about the potential risk of cancer and other problems.

    I had Mentor smooth round moderate profile saline implants placed in 2011 by 2019 I was diagnosed with “benign” breast tumor called PASH and I’ve had chronic sinus infections ever since the placement. I am told I cannot get the tumor out with out removing the implants but insurance won’t cover.     I had mold on left valve when explanted mentor smooth saline implants for 18 years. Had severe anemia where I was bedridden, high heart rate constantly, spikes in heart rate, severe anxiety out of nowhere, daily muscle spasms, shortness of breath, severe thirst every day all day. Took them out 3 months ago and feel 90% better already. Implants should be illegal

I was naive and thought I’d never need replacement as I know several ladies with implants that don’t have any issues. I actually thought that if I got saline vs silicone it won’t be that bad if one leaked.     This story sounds like I wrote it. All the same symptoms and terrors in my life. My children don’t know a healthy mother. They suffered just as much as I did! We deserve justice for what we’ve been through. Mine were from a double mastectomy; not by choice. And the horror I’ve gone through after removal and attempted reconstruction- was just as bad. It’s been a nightmare that I can’t wake from.

I find it utterly repulsive that the same ingredients found in any other environment are considered toxic until it is put in an implant. There are studies done on these toxins being exposed to the body and the effects. However when put in the body it is supposed to have no effect? I have over $20,000 in my chest and am horrified by the way it looks. Being sick for 13 years - I feel my past, present and future have been stolen from me.     I have had Mentor, saline, under the muscle for 27 years. I am researching the Dr. to do the explant at the present time. I have numerous illness complaints connected to BII illness. I believe my implants are moldy, and my right one is ruptured. I have just had an MRI. I live in Victoria, BC, Canada, and wish to join any lawsuits connected to these toxic bags.

    I received my implants in 2003 on top of the muscle and now I am having EXTREME pain in my shoulders, arms, elbows, hands, hips, legs, knees, feet. swelling in the hands and feet and knees. Somedays I can't even walk.

I originally thought it was due to decades of birth control pill use that messed up my thyroid and starting menopause. I thought I did not have to worry about BII unless one of them ruptured. But now reading stories about women who did not have theirs ruptured but still had toxic silicone levels. [Show More]I had mentor smooth saline in 2003.     Menton saline implants put in June 2009. Have had issues that keep getting worst. Going in this Friday to get a diagnosis mammogram. The pain in my left side feels between electricity to like someone Is pushing on a bruise. I want these things out of me! My aunt passed due to cancer hiding behind her implants, I have 3 babies I can't leave.

Told me it would not hurt me if it stayed in. Due to it was saline. But it was in capsuled in silicone. He did not tell me that. I had a warranty for 10 yrs.     Mentor Smooth Saline Implants since 1998. Diagnosed with Hypothyroidism in 2008 Fatigue-joint pain-breast and chest pain-back and neck pain. Hand and arm numbness. Explanting on June 14th. Debating on having tested after removal.

After coming upon these sites, am seriously considering explant surgery. I'm 56 so not thrilled to have to consider that but if I can live with lesser symptoms then I'll do it. Even with platelet rich plasma injections , physical therapy etc I live in pain despite normal mri. Finally clicked thats the side with the larger implant and they looks all shriveled up on MRI. Going for pet scan today. I live with no energy. My heart rate is over 135 . The most frustrating part is being lied to.

Also my blood work has come back abnormal with my C reactive protein and sed rate high. Kidneys functioning at 50. Lost over half of my hair. I have strange burning around and under my breast and very tender. Left side hurts when I move a certain way. Have dealt with a bronchitis like cough and cold that starts in the winter and usually lasts for 6 to 8 months. Aches and twitches in my legs. Severe brain fog and memory loss. Migraines with an aura. I’ve even had times where my speech has been off and I couldn’t get words out of my mouth or say the right things my husband thought I was going crazy. Ringing/ thumping in the ears, dizziness and vertigo. Dry patchy like rashes. Wake up in pain every day from head to toe I’m only 37 and feel like I’m 90. It’s the most depressing thing ever I have young children and I can’t interact with them like I used to. Ready to take these toxic bags out!!!

    Mentor saline implants 2006. Tons of symptoms started 3 years ago. Autoimmune, neuropathy, a lot of enlarged lymph nodes in chest and under arms. Fatigue, abdominal pain and bloating. Lesions on kidney and liver.

    I had saline implants for 5byrs and started getting very ill.removed implants in 2016 and still have some symptoms. Have been tested and confirmed very high levels of metals toxins and mycotoxins. I was a healthy and energetic person until implants. I want my life back

Everyone that see me can’t believe how healthy I look and doing good... laughing and dancing again. They lied to me and stole many years of my life and spent a lot of money on health cost. Also had to take out gallbladder too and knee surgery also.

I finally, just in the last 9 months have gotten enough relief to “keep my head” above water through non traditional medicine. Vitamin IV’s, holistic medicine including acupuncture, nutrition, counseling, radical diet changes. I am still in pain and have many medical issues ranging from heart arrhythmias, fibromyalgia, anxiety, depression, memory loss, headaches, neck, shoulder, and back pain. I have a appointment on October 10th of this year to consult regarding explant surgery. Will be more than happy to participate in any legal process that is currently ongoing. My husband has kept track of all of my medical records and the range of problems I have had are unbelievable. We were told of the normal surgical risks when we had the augmentation, still have the original card from the implant. We were never informed of the horrible possible outcomes either before or after they started to occur to all women. The Mentor company should be liable to inform the public of these occurrences and offer to remove them. As well as compensate me for the thousands of dollars I have spent to just survive. These issues have even made me suicidal at one point as I felt I could not go on any longer. The Integrative Holistic Medicine is the only thing that has saved my life. However it is mostly not covered by my insurance so the monies out just continue. but I can’t wait to get these things out and try to get my old self back. But I do feel as I have a case, what do you think?

I have been to two allergists for full panels and found no reason for the histamine condition. In fact, there hasn't been a GP, Endocrine, Allergist, or Neurologist who have been able to explain my symptoms. In the past 5 years these symptoms have worsened to the point where I have mild nephropathy in my legs, swelling in my extremities, pain in my chest, behind my breasts, in my neck, back and shoulders that just start and stop for no explanation. I have dry skin, hair, mouth, and eyes all of the time. I have had major bone loss, decline in vision, heart palpitations, and I have noticed both short and long term memory loss, which scares me to death. I have become more reclusive and have been unable to work for periods of time. I have experienced depression and anxiety because of this. I have a problem with mold and am scared that I have mold in my body due to the implants. I read an article on Breast Implant Illness and found that most of my symptoms are similar to the ones that other women are experiencing. I recently read an article about the FDA hiding the fact that women have become ill and even died from implants, in fact, they did not disclose that to their knowledge there are over 350K women who have experienced these horrific problems. I have been saving money to explant, but I am furious that I was not warned about the dangers before I implanted, or after...or that doctors are not told enough about it to diagnose properly. Something needs to be done about this. If I can tell my story, or help anyone else I am more than happy to do it. If there is a way to sue Mentor or the FDA for their negligence, I would be willing to be part of that. I am saving money to explant, and I hope I can do it before this kills me.

    I have had mentor textured implants since 2002 . In the last 3 years I have been diagnosed with Rheumatoid arthritis and hasimoto thyroid. I have almost all of the other breast illness issues as well. Absolutely horrible!!!!

Explanted May 11th one week ago today and one implant appears fine, the other is discolored and has particles floating in it. They were brought home and placed in the freezer, how about one has frozen and the other won't freeze. Never saw saline that won't freeze!! We are all in this together and I wish everyone the best. Get explanted as quickly as possible so we can attempt to gain our strength, health and lives back after losing so much because of Mentor.

    I had Mentor smooth mod.plus saline placed in 12/2009. Three years ago it all began. I now have Celiac disease, a cyst on my liver just found , lump behind my left breast, hormone and vitamin deficiency . I have knots between my shoulder blades that come up often and has to be massaged out. They hurt so bad and after the massage they leave but I feel like I have the flu the next day.     Mentor saline smooth implants 2006. E xplant scheduled for 2/21/17. Also numbness and pain in right side. Have had neurological tests and MRI no conclusions. I want them out and tested asap!

    I have mentor saline under muscle. I have been dying slowly for over 8 years! I have seen so many doctors and specialist and have been diagnosed with hypothyroidism and degenerated disc disease. I have 53 symptoms of BII. I feel like my organs and everything that lives inside me screaming for help. The doctors don't seem to understand and/or care.

    I have a Mentor Saline implant and have been having pain and numbness in hand and fingers. The plastic surgeons I have been to say the implant is not leaking but will not check for mold. I have the implant since 2004, due to breast cancer.

    In 2007, my saline implants were replaced with Mentor Memory Gel. I had bi-lateral mastectomy in 2000, reconstruction with the saline implants. I suffered from capsular contracture, a Mentor representative informed me I would be required to participate in their study. Two weeks after having these silicone implants placed, the study was closed. I was never contacted by Mentor recommending I have a[Show More]In 2007, my saline implants were replaced with Mentor Memory Gel. Two weeks after having these silicone implants placed, the study was closed. I was never contacted by Mentor recommending I have an MRI after 3 yrs and then every 2 yrs. Furthermore, the #1 selling point of these implants were that they would not leak and upon puncture, the silicone would not leave the implant. I began to experience pain in left breast, underneath the arm, pain that radiated from my neck down my left shoulder, arm & hand. Began getting cortisone injections for the debilitating pain. Implant began to extrude off chest wall to the point of looking deformed. Last week, my plastic surgeon removed these implants, discovering the left implant had ruptured, the silicone had completely leaked out embedding itself underneath my armpit & into the flesh! In 2012 while leaning over the side of the tub, something in my left breast burst, sending sharp pain deep inside my chest. I immediately saw my PCP and she dismissed my concerns regarding rupture of the implant. An x-ray was taken and it did not show rupture. I am so angry because all these years I've suffered with horrific pain, prescribed narcotic pain meds, muscle relaxers, physical therapy, mental & physical exhaustion, frustration & depression. Never once has an MRI been ordered of my breast. Needless to say, I am seeking an attorney to handle my case.
