Roblox, Fortnite Gaming Disorder Lawsuit Alleges Designers Engage in Behavioral Manipulation

A new lawsuit alleges that the makers of popular video games Roblox and Fortnite have intentionally designed their platforms to foster addictive behaviors in young users.

The complaint (PDF) was filed by Lashawn Turner on behalf of her minor child Antonio Dillard, in the U.S. District Court for the Northern District of California on April 7. It names Epic Games Inc., Roblox Corporation and various unidentified entities as defendants.

According to the lawsuit, both companies have knowingly implemented design features in their respective Fortnite and Roblox games that exploit developing brains, contributing to what plaintiffs describe as gaming disorder and related mental health issues.

Internet Gaming Disorder Symptoms

Internet gaming disorder (IGD) is a condition marked by compulsive video game use that begins to outweigh other interests and daily responsibilities. It has been recognized as a mental health disorder in both the International Classification of Diseases (ICD) and the Diagnostic and Statistical Manual of Mental Disorders (DSM).

Common signs of IGD include an inability to limit gameplay, fixation on gaming, abandoning prior hobbies, misleading others about usage habits, and continuing to play despite harm to relationships or opportunities. The effects of this addiction can extend into multiple aspects of life, including delayed financial independence, strained personal relationships and difficulty transitioning into adult responsibilities. Individuals suffering from the condition may neglect work, social interactions and routine obligations.

Amid growing concerns that certain games are deliberately structured to encourage compulsive use among younger players, families across the country have filed a series of gaming disorder lawsuits against developers of titles like Minecraft, Fortnite and Roblox, alleging the companies prioritized engagement and revenue over the well-being of children and teenagers.

Gaming Addiction Allegations

According to the complaint, Dillard began playing Roblox and Fortnite at just five years old, and by age 10 had developed what Turner describes as an uncontrollable addiction to gaming. The lawsuit alleges he lost interest in other activities, became preoccupied with gameplay, and experienced irritability and distress when unable to play, even during school hours. Despite attempts to reduce his usage, he was allegedly unable to stop, resulting in declining academic performance, social withdrawal and emotional harm.

The lawsuit claims the developers intentionally employ behavioral design strategies that mirror mechanisms commonly associated with addiction. These include variable reward schedules, randomized incentives and “core loop” gameplay systems designed to keep users continuously engaged. Such features, which include limited-time events, in-game currencies and social reinforcement pressures, are alleged to be central to the companies’ business models, driving both user retention and revenue.

Turner further alleges that the games are engineered to provide immediate gratification within minutes of play, while maintaining pacing that avoids frustration and encourages repeated engagement. The complaint suggests these mechanics are specifically designed to exploit neurological reward pathways in developing brains, reinforcing compulsive behavior patterns over time.

As a result of this alleged design, Dillard is said to have suffered a range of harms, including sleep disruption, loss of friendships, emotional distress and behavioral changes. The complaint also indicates he made unauthorized in-game purchases and exhibited withdrawal-like symptoms, including anger and outbursts when unable to access the games.

“Each Defendant has engaged in deceptive, unfair, immoral, and reckless behavior that damaged and continues to harm Plaintiff and countless other children. For this, Defendants should be punished, and punitive damages should be assessed against each Defendant for their respective misdeeds and unlawful conduct.”

The lawsuit raises allegations of strict product liability—design defect, failure to warn, negligence, negligent failure to warn, intentional misrepresentation and fraud. It is seeking general, special, exemplary and punitive damages.

Roblox Sexual Assault Lawsuits

Beyond claims that online video games are engineered to encourage compulsive use, an increasing number of Roblox sexual assault lawsuits also allege that platform has become a hub for child exploitation. Plaintiffs contend Roblox lacks adequate safeguards, allowing predators to reach and groom minors. This can lead to sextortion, the exchange of explicit images, in-person abuse and lasting psychological harm.

Hundreds of Roblox abuse claims have already been filed, and the number is expected to rise in the coming months. As a result, the cases have been consolidated in the Northern District of California before U.S. District Judge Richard Seeborg for coordinated discovery and pretrial proceedings.

Judge Seeborg is expected to establish a series of “bellwether” trials. In these cases, a small group of representative claims will be prepared for early trial dates to help gauge how juries may respond to common evidence and arguments.

If those proceedings do not lead to a settlement or other resolution, the court will likely begin remanding cases back to their original districts for individual trial settings.
