Wage and Hour Lawsuits against Wal-Mart Settled for over $350 Million December 30, 2008 AboutLawsuits Add Your CommentsLast week, Wal-Mart Stores, Inc. announced that they have agreed to pay between $352 million and $640 million to settle 63 wage and hour lawsuits filed against the retailer in 42 different states. The lawsuits accused the company of cheating hourly workers by forcing them to work through breaks and not paying them for overtime. The wage and hour violation settlement may set a new standard for other companies who have been failing to pay employees according to the requirements of federal labor laws.In recent years, federal court wage and hour class action filings have surpassed employment discrimination class actions, with claims involving issues such as misclassifying employees as salaried or independent contractors, failing to pay for “off-the-clock” work or on-duty meal breaks, denied reimbursements and miscalculation of commissions and bonuses.Do You Know about…Spinal Cord Stimulator lawsuitsSpinal cord stimulator lawsuits are being investigated for individuals who suffered unnecessary shocks, burns or other problems, often resulting in the need for additional surgery to remove the SCS.Learn MoreSEE IF YOU QUALIFY FOR COMPENSATIONDo You Know AboutโฆSpinal Cord Stimulator lawsuitsSpinal cord stimulator lawsuits are being investigated for individuals who suffered unnecessary shocks, burns or other problems, often resulting in the need for additional surgery to remove the SCS.Learn MoreSEE IF YOU QUALIFY FOR COMPENSATIONClass action wage and hour lawsuits against Wal-Mart have generated a significant amount of media attention, as the retailer is the largest private employer in the world. The company has lost high profile lawsuits over wage violations in California in 2005 and Pennsylvania in 2006, which resulted in verdicts of $172 million and $78 million respectively for Walmart employees in each state.Earlier this month, Wal-mart agreed to pay $54.3 million to settle a wage and hour class action lawsuit brought on behalf of workers in Minnesota, after a judge found that the company had violated wage and hour laws more than 2 million times.Under the terms of this latest settlement, current and former employees in 42 states will receive at least $352 million, and the payments could reach $640 million, depending on the number of claims submitted by affected workers.According to the New York Times, the Walmart settlement resolves all but 12 pending wage and hour lawsuits against the company. Some advocacy groups have suggested that Walmart settled the claims to avoid becoming the target of increased wage and hour enforcement that is expected under the Obama administration. Our household just got our checks in Mass. ours both was for 702.00. Thank You Wallmart!!!!! Vismark December 3, 2010 While working at Wal-Mart I was forced repetely to work through my lunch and brakes, I was also forced to work overtime at the begining of the week, then I was forced to leave once I reached 40 hours so that do not get paid for overtime. Brian December 3, 2010 I worked at walmart well according to unemployment I still work at walmart but have not been on the payrol for 2yrs because of a suspension which was told to me I could come back after my court date which nothing happen at it. I keep getting benifits stuff in the mail from them and I ask why I can’t come back and they tell me I am not going to be rehired but I call the main office and they tell me I am still employed just not working. So I went to file for unemployment and they told me no I am still employed at walmart. I ask the area manager to write me a letter stating I was not employed there and she told me no. They know I can’t take them to court is there anyone that can help. Twila December 2, 2010 My husband Chris worked for Walmart 5 years as the meat manager, and 5 more years as the deli manager. Then his kidney’s failed after heart surgery. So he had to go on dialysis. He scheduled his dialysis after his work shift so he could be there from 5:00 am to about 12:00 three days a week and a full day the other days. Rob made him step down from the deli position, then told him he had to sign papers for FML. The HR person told Chris Rob was looking for a reason to fire him and would put him in another position where he would be bound to fail so they could fire him. They refused to recognize his diability and make reasonable accomodation for the dialysis, per the ADA laws. 5 + 5 = 0 with Walmart. They kicked him to the curb after 10 years of loyalty and devoted service! Don’t work for Walmart unless you want to be booted out at the first hint of trouble!!! Lee December 2, 2010 I live in NC, and filled out information over a year ago. How can they get by with not paying people. They would make me work overtime, and didn’t pay me. Nothing has changed November 29, 2010 My husband worked for Sam’s from April 2010 to October 2010. He had to beg for a break or lunch. He was a greeter and could not sit and he would call for a break/lunch and be ignored. He hated every moment working there. yeah right November 26, 2010 will we get interest for the checks that have been in limbo for over a year now? How come when you call they can’t pull your info up and tell you how much you will get. In VA and still no check. Houston's Finest November 24, 2010 Well I jus spoke to the attonery that’s over my case and she said that checks (for TEXAS) will be processed the end of Dec or middle Jan Alicia November 24, 2010 David…I got the w-4 but there was no questionnaire in mine. Sent it off the next day. I have worked for four different Walmarts in 2 different states since 1997. Longest was 13 months from 2000 to 2001. Won’t they check our employment records prior to cutting the check? It also said we can receive anything from $50.00 to $600.00. I’m expecting the $50 just because that’s my luck. I still think they are getting off easy for treating their employees like garbage. stephanie November 22, 2010 i was told that the MA checks were being sent out on the 17th, after waiting months already, i was first told they where gonna be sent in april! car November 20, 2010 anybody from MA get their checks??? Ken November 18, 2010 Has anybody from WI. recieved any checks yet? Spoke to a rep. last week and she said checks should be mailed soon! we will see!!! tammy November 18, 2010 november 18th and still waiting anyone heard anything for west virginia?? mal November 18, 2010 I just called the Alabama number again, and she said, still no set date when the checks are going to be mailed, still waiting on the calculations. shirley November 18, 2010 called again….same thing….they are still calculating payments…you would think that they would send them out in as they calculate payments but no…same old answer. Candi (worked in Mo.) November 17, 2010 I recently relocated to Illinois and called to update my address. Also to find out how long it’ll be before the checks would be issued. I was asked my information and was told they didn’t have me in their system. I was sent a settlement form in June of 2009 and I filled it out the same day and mailed it the next. I’m now waiting on them to call me back after they updated my new address. NOTE* the customer service representative was “having issues” with her computer. Hmmm?? P.S. The CSR (cust. serv. rep.) said not to look for any checks before the end of the year (2010) because they were “still caculating”. Don November 16, 2010 when I said info on the forthcomming checks (lol) you understand that I am assuming that their will be checks but you know what assume means, and again LOL maria November 16, 2010 Nov 15 spoke to rep…Virginia and Alabama checks were suppose to go out Nov 3.. since then Wal-mart has decided to redo calculations on payments, could not tell me if the money would increase or decrease, 60 days if you have not received anything suppose to call back…I was told that my 2 claims were on file I have one for Va. and Al. mal November 16, 2010 I hope we will get checks within 60 days , they told me to call back around Jan 2011, next year. Shelly November 15, 2010 Don’t stop calling!!! If you don’t keep calling, we will never see the money. Let’s worry us, like Walmart worried us. kimberly November 14, 2010 i worked at walmart in ozark alabama and it was years ago and it was a hell job we never was treated fair my checks was always wrong and they never could get them rite my pay was wrong for all the hours i work they lied about the pay, breaks, wages and thet fired me for nothing (steve lawence)store manger fired me one day he called me in the office and said im firing you and i said y and he said because you look like you are *not happy* thet are devils from hell and they owe me big for all the lies and hurt and i will get my pay back asap thanks Don November 14, 2010 I live in Ma and so far no checks. I think they are peeing on my leg and expecting me to believe that it’s rain… If anyone in Ma. has any further info about the forthcomming checks please let me know sharon November 12, 2010 Hey Alicia, I know what you went through, because as an over-night support manager in a neighborhood market I was robbed at gun point and made to lay on the floor in cashoffice until they were gone. I was afraid for my life as well as the associates that were outside of that door working in the store. I too had nightmares, but do you know that walmart does not even offer you any paid time off after a truamatizing situation such as what we went through. They don’t care about us. It was me and other support manager that did the most investigating into our robbery because we felt it was an inside job and even told the police that. We were right, and we found out who did it and they ended up going to prison and we never even got a thank you or nothing. They don’t care about us. FACT!!!! Lin November 12, 2010 I worked Full Times Hrs for the longest time, but was kept on part tme. I was asked to assist customers on my break time and told I would be given a later break, but was never, I was called off breaks and lunches early all the time to assist customers or to count out or reboot a register because I was “so good at it”. I “HAD to stay in a locked store to clean, no matter how late it go tto be. I was a single woman and told the manager I had to leave “ONE night” to pick someone up, I was told if I left I would be terminated. I had to leave to pick someone up, it was well after 11:30 pm after my shift was over, I assisted in clening the store, I was terminated, just like that, totally unfair. This was back a few years ago. I didn’t think I could do anything about it. I had been mailed papers to fill out about a law suit, but have not heard anythign since. shirley November 12, 2010 talked again with someone in the ofc and now the word is they do not have a set time on when they will mail the checks out because they have not calculated the amount of the checks yet. would’nt you know it. Sam November 12, 2010 I worked at Wal-Mart in two different states, Florida & North Carolina. The Florida class action lawsuit was filed separate from the North Carolina class action lawsuit. I was fortunate enough to be able to file a claim in both states. The Florida class action has been settled and I received a check in August 2010. I am still waiting for the North Carolina settlement and from what I have been told should be paid sometime in November of 2010. Had November 12, 2010 Anyone in PR get any checks? Alicia November 11, 2010 I worked for the Kennewick Wa.Walmart in 2000/2001. One night after we closed Management stood at the door to let the remaining customers out. She didn’t bother locking the doors and walked away. I was standing at the courtesy desk finishing up my drawer count. A man walked through the door with a shotgun wrapped in rubber bands. He said we need to buy our white t-shirts and kiss our kids goodbye, The worlds coming to an end. He wanted to know what religion people were. As he is saying this he continued to head back towards sporting goods. I am calling management over the intercom with no response back. I called a good 4 times. I open the door behind the courtesy desk to see 2 managers sitting there. I was so pissed. Typical ignorance of Walmart management. They called 911(I should of) and I started to clear the store. I don’t recall if management even left that room. By the time the man reached sporting goods he had the gun put together and in the face of a associate demanding ammo. The guys were able to get the gun from the man. Swat showed and did a sweep of the store. The mans girlfriend was sitting outside in front of the doors with the car running. Come to find out the next day the man was a felon. What really got me was to find out the gun was loaded. Nice to know he could of blown me away right when he walked in. Risking my life because of incompetent management and being told to work through breaks and lunches. Then we were told we wouldn’t be let out of the store until we help the other departments and everyone was done, after we clocked out. We were always locked in. Walmart needs to get their crap together and start caring. That gun man scared me so bad I had bad dreams for a week and was always watching to the doors after we closed. DOLLY November 11, 2010 I realie dont think we are gonna get any noney here it is the 11th they said they are sending them out the 3rd i realie think we are gonna get shafted…. sharon November 11, 2010 I think walmart (or hell mart as I call it) is out of control. They should all get burned down just like the one on South Park. If you haven’t seen it, you need to. LMAO!!!! It’s great! It will give you something to laugh about at least because what is happening in real life is not so funny. I hope they quit messing with our heads and send our checks soon. We all could use them. erick November 10, 2010 Anyone in ny get checks yet? connie November 8, 2010 i worked for walmart for about a year, and for me to even get a break or luch was a big hassle i would try to notify my csm so i can have breaks and most of the time i was ignore and had to work straight through, one day i was called to the office by a manager he was writting me up for a meal violation whick i refuse to sign but end up signing it or i would of got fired for not signing it,, i wis so pissed off i agrued with the manager because it was there fault for me going over my meal violation i could never get released for the cash register, i end up just leaving,<<<< never went back,,,, John November 8, 2010 Walmart is trying to force me to quit. I have been an Electronics associate for six years, am one of the most highly paid persons in the store, am over 65, and handicapped. Three years ago I had a stroke while working, but after I recuperated I returned to the same job. I have never had anything less than a glowing review and a good raise, have been assured that any help or accomodation I might need is fine by the reviewing manager, etc. Just this past month I was suddenly threatened with a poor review if I didn’t transfer out of the department because I “didn’t fit the job description”. After three years of solid evidence I can and do, do the job? And not one negative review or warning? And in October I got another great review after the first threat was received. This week I was summarily yanked from Electronics and thrown on an up-front register with no training for that type of machine. This job is quite strenuous and I fear I can’t keep it up too much longer (which is precisely what they hope!) Also, they took my walker away from me and put it in customer service. When I needed to go for break there was no-one to go get it for me, so I got no break. Same thing when I needed to go off shift. I know for a fact that it’s strictly illegal to remove a mobility device from a handicapped person. They have also cut my 4hrs/day, 5 days/ week to just two days a week, even during the Black Friday period when traditionally everybody who’s breathing is on shift. I suspect they may cut me further. Any cut at all in hours and I’m in danger of losing my house. The stress is making me so ill I can’t eat, and I’m diabetic. It is unconscionable what a huge corporation is able to get away with! After reading all the other complaints, mine is slight in comparison to some, but at least I know I’m not imagining the things I’ve seen and heard and experienced. ‘Evil’ in its metaphysical sense is not too strong a word to use. Another earlier series of events in my sojourn with the company was also draconian. The store I worked at was closed for remodeling, and all the employees who didn’t voluntarily quit were transferred to a store twelve miles away. When the original store reopened, none of the original employees were allowed to re-transfer. We were told that we had to apply as if it were a new job. It turned out that they filled the store positions with brand new lowest paid youngest people off the street that they could find. Mostly twentys, a few thirtys, nobody I saw was over forty and I went back alot to be sure. Nobody who originally worked there got to go back except one or two youngsters who were promoted to management. All of this points to a Machiavellian juggernaut with complete lack of compassion or ethics that has the world by the throat, and knows it. Someone in a comment compared it to the Nazis, and that fits just right. What a shame. Walmart could do so much good if they had a mind to, but it’s a giant, insidious termite mound of mindlessnes and rules with no checks or balances, which condition promotes the worst of human instincts. They are so huge that I feel what they do and condone impacts so may people negatively that it could be considered treason to the US. I pray God someone stops them. Thinly veiled Horror movie, anyone? Linda November 7, 2010 I worked for walmart for 17 months. I filled out the paper work and mailed it on time but I haven’t recieved a check. I have a friend that told me his daughter recieved a check in september 2010 and I want to know where my share is. walmart needs to treat their employees with appreciation for the hard work they do and pay up what is owed to them. It is hard work and breaks are important so they need to make sure they get their breaks on time. My daughter recently worked for walmart and hated it because they are still neglecting to give their employees their breaks on time and they still refuse to pay overtime to their employees. lynn November 6, 2010 Sounds like another excuse not to give the employee the money they deserve just like the excuses they give when you don’t get a quarterly bonus ..even though you exceeded sales, profts, and payroll was in check. mal November 5, 2010 Bad news, i just called the number , and the rep said, checks has not been mailed, because they are waiting on a calculation for us, and he said to . call back, if not receive in about 60 days, this is a mess, they keep on delaying , the dates., now they are waiting on how to calculate for class members. shirley November 5, 2010 o.k. just talked with someone from the ofc and as of now it will be late november before the checks will be mailed…..another delay. Ms.Shae November 4, 2010 SEEMS TO ME THAT WAL-MART IS GIVING GEORGIA THE RUN-AROUND ABOUT THE CHECKS…I WORKED FOR WALMART FOR 4 1/2 YEARS…YOU LEAVE TO GO ON BREAK AND ARE FORCED TO COME BACK BECAUSE THEY ARE CALLING A CODE BECAUSE THEY DO NOT HAVE ENOUGH WORKERS…..IT SEEMS THAT THEY ARE NOT GETTING ANY BETTER BECAUSE NOW I HAVE A SISTER THAT WORKS FOR THEM AND COMES HOME COMPLAINING EVERYDAY ABOUT THE WAY THE MANAGERS TREAT YOU…I GUESS THIS WAS NOT A LESSON LEARNED FOR THEM AND HOPEFULLY WE’LL GET WHAT IS RITEFULLY OURS!!!!!! I FOUND OUT LATER THAT THE MANAGER SHOULD HAVE TOLD ME TO TAKE A LEAVE OF ABSENCE UNTIL I GOT SITUATED SO I WOULD HAVE KEPT MY BENEFITS. I WENT BACK IN JANUARY OF 2008. IN APRIL OF 2008 I FELL IN RAIN WATER (ON MY WAY TO CLOCK IN 4 WORK) BY THE BUGGIES AFTER THE DOOR GREETER HELPED ME UP ILIMPED TO THE BACK FILLED OUT AN INCIDENT REPORT. I TRIED 2 WORK THAT DAY BUT MY KNEE WAS HURTING BADLY,SO I WENT TO THE HOSPITAL THEY GAVE ME A PRESCRIPTION I WENT BACK TO WALMART TO GET IT FILLED AND THE STORE MANAGER MADE A COMMENT TO OTHER EMPLOYEES THAT I FELL BECAUSE I DONT KNOW HOW TO WALK. IN JUNE 2008 I SUFFERED FROM DEPRESSION. I STOPPED GOING TO WORK BUT I STILL CALLED THE HOTLINE NUMBER TO CALL OUT. I TALKED TO A MANAGER TOLD HER WHAT WAS GOING ON SHE TOLD ME TO GET THE MENTAL HEALTHNPEOPLE TO FILL OUT THE FORMS.
