Wage and Hour Lawsuits against Wal-Mart Settled for over $350 Million December 30, 2008 AboutLawsuits Add Your CommentsLast week, Wal-Mart Stores, Inc. announced that they have agreed to pay between $352 million and $640 million to settle 63 wage and hour lawsuits filed against the retailer in 42 different states. The lawsuits accused the company of cheating hourly workers by forcing them to work through breaks and not paying them for overtime. The wage and hour violation settlement may set a new standard for other companies who have been failing to pay employees according to the requirements of federal labor laws.In recent years, federal court wage and hour class action filings have surpassed employment discrimination class actions, with claims involving issues such as misclassifying employees as salaried or independent contractors, failing to pay for “off-the-clock” work or on-duty meal breaks, denied reimbursements and miscalculation of commissions and bonuses.Do You Know about…Spinal Cord Stimulator lawsuitsSpinal cord stimulator lawsuits are being investigated for individuals who suffered unnecessary shocks, burns or other problems, often resulting in the need for additional surgery to remove the SCS.Learn MoreSEE IF YOU QUALIFY FOR COMPENSATIONDo You Know AboutโฆSpinal Cord Stimulator lawsuitsSpinal cord stimulator lawsuits are being investigated for individuals who suffered unnecessary shocks, burns or other problems, often resulting in the need for additional surgery to remove the SCS.Learn MoreSEE IF YOU QUALIFY FOR COMPENSATIONClass action wage and hour lawsuits against Wal-Mart have generated a significant amount of media attention, as the retailer is the largest private employer in the world. The company has lost high profile lawsuits over wage violations in California in 2005 and Pennsylvania in 2006, which resulted in verdicts of $172 million and $78 million respectively for Walmart employees in each state.Earlier this month, Wal-mart agreed to pay $54.3 million to settle a wage and hour class action lawsuit brought on behalf of workers in Minnesota, after a judge found that the company had violated wage and hour laws more than 2 million times.Under the terms of this latest settlement, current and former employees in 42 states will receive at least $352 million, and the payments could reach $640 million, depending on the number of claims submitted by affected workers.According to the New York Times, the Walmart settlement resolves all but 12 pending wage and hour lawsuits against the company. Some advocacy groups have suggested that Walmart settled the claims to avoid becoming the target of increased wage and hour enforcement that is expected under the Obama administration. Scott October 19, 2010 I’ve been self-employed for 20+years. Now that the economy sucks I had to get a 2nd job. Sam’s Club was hiring part-time for Produce. I was hired on the spot. The pay sucked, but it was a paycheck. I have been busting my butt for 1.5 years and have lost 40+ lbs. Three months ago I was passed over for the first promotion (Deli Team Leader) without an interview. I used the Open Door Policy and the GM agreed that I had been shafted by the Fresh Manager, but it was too late. On the day that was my 1.5 year “anniversary” at Sam’s, as well as my 44th birthday, I was promoted to Meat Team Leader, Full-Time, 4 pay level increase. I am not a “take your time, I’m paid by the hour” person. Sometimes I take my breaks, sometimes not. I am responsible for that. I always take my lunch, if required. You get what you put in. But just in case…I also have a small digital recorder with several hours of conversations… shanitra October 16, 2010 i was sleeping and i thought about the walmart lawsuit i havnt heard anything so i decided to google and see what was going on i stay in texas so are checking coming in november as well , i also did the paper work they sent me and i sent it back so does that mean i will be getting a check let me know if someone in texas has information on this Carol October 15, 2010 This is to Jamie who wonders why everyone is in an uproar? Shaun October 4, 2010 i worked at walmart a few different times and all theses comments sound familiar. how do i know i have a claim? virginia September 30, 2010 My Husband and I both worked at walmart in Newark NY , and we never got a break only a 30 minute lunch. We were locked in to the store and had to wait on someone to let us out in the morning and they never was on time. Pluss i found out i was pregnant and when i told my manager he was pissed and very angree with me and said it didn’t matter i had to work the same way . I unloaded the convyer belt with 5-6 other man and he still wanted me to do this some of the boxes were very hevey and after a few months i started haveing trouble and then one night i started throwing up blood and the manager wouldn’t let me leave. Pluss we were locked in. I got upset and scared so my husband told me to run out the emerency doors or fire doors (witch we were told if we ever did this we would be firered) But i ran out them any way and my aunt came and picked me up and took me to the hospital. I was firered and they made me fillout saying that i Quit because they said that that is what i did when i ran out the doors. Theys said if i did fill out the paper saying that …that i wouldn’t be able to get my check for the 2 weeks i worked. I filled out the paper work about a month or 2 ago and havn’t hurd anything. mal September 30, 2010 I called th e 1-800-677-5163 and I spoke with a representative for the 30 states and alabama is included in this number, we will receive checks around november the 15th, if not then call back, everyone that sent in the paper work by sept 2009 will receive a check. Donna September 29, 2010 I started off in the bakery decorating cakes, after a few months I took a promotion to lead the Deli. Soon after the bakery lead got her back hurt so I ran BOTH departments asking for more help daily, I ask the Asst. Manager could I refuse to run both departments not only did she say ah no she pretty much told me if I wanted to keep my job to keep my mouth shut and just do it, A couple weeks later there was an out of date found in the bakery that the morning person missed, the store manager insisted that I was to be wrote up for a department that was not even my true responsibility ! I was like most people I got maybe a break a day, 1/2 a lunch worked off the clock, even done scheduling that was not my responsability from home, was even told I would not be allowed a vacation day unless I got the scheduling done for the asst. manager ! I live in Tennessee and I also received the papers and filled them out, but NO check and dont really figure after this long I will get one.. Dorothy September 29, 2010 I have worked for wal mart 61/2 years… didnt always get my whole break didnt always get my whole lunch worked off the clock and i had to wait about 20 minutes to leave the building to wait for the lazy managers to unlock the door so i can go home almost every single night…. so i fill out the forms mail it off right away and i still havent heard anything back yet…. i live in cali…. so if anyone knows anything please let me know…. or if you have a number i can call to check…. Melissa September 28, 2010 Hmmm… I never did get my check in the mail. I’d say about a year ago (around 2009) I recieved a large envelope from Walmart in the mail (I quit sometime after recieving this) and it was about how Walmart was/is being sued in many states (I assume this is the lawsuit ofcourse.) Anyway, there was a paper to fill out and send in. It asked questions about if my breaks were ever interupted and was forced to leave my breaks etc. If so, I would be getting compensated for it. I am still Not Compensated. I recieved Nothing in the Mail. I answered their questions (and yes I had at least One Break disrupted when I just Started it. I got it after two hours of work, so I took it and this middle aged, over weight, lady who was a sales associate yelled at me and slammed her hand right next to my face on the table. I was in Subway – we had one in our store. She told me my boss wanted to talk to me but when I spoke to him, I asked if anything was wrong… he said no. He asked me some question about my 3 month evaluation but it was NOT negative. That lady was a freaking psycho. We never spoke before, and to my knowledge, there was no beef between her and I (REALLY.) I had many other bad experiences but it would be too long to type so I’ll leave it at that. Anyway, I never did get this check I was suppose to recieve in the mail. In general, I experienced a lot of racism. I know people don’t like hearing about it but I’m being totally honest. This one customer said to his wife that I spoke “good english.” Um, I’m only 1/4 Filipino. I grew up in the U.S. I also had coworkers tell me how they didn’t like races that weren’t the same as theirs. I also had a manager who complained and worked me to the bone, but didn’t say jack to the other sales associates that worked Under her specifically. All these other sales people did (not all of them, but the ones that worked with me in the ladies department) just talked and galavanted around the store. One of these women told me I worked “too hard.” This same woman told me she was never complained to/about from our manager (they are both the same race from what they told me, and I’m another). It seemed like a racial situation because the only other women who worked a lot were these 50 year old women of other races while everyone else just talked about personal things, and walked around (and not in a frantic way… but just casually, while these two other woman were building large clothing racks and taking them down etc. Whether it’s subconscious or not, (it seems to me) that many people like to help out or befriend the ones that look like them. Yes, I’m being very racist, but so is every d-mn person I’ve met and worked with. I’m so glad my fiance is an Accountant and owns a business. I dont have to deal with nasty prejudiced women Ever Again! Ha ha ha – HA!!! ๐ That’s me giving the middle finger to every Horrible woman who didn’t like me because we weren’t the same – b-tch. And Yes! – Ther e was one coworker who told me that she didn’t like my background (3 times to my face – Really.) They’d be so Jealous to know the guy I’m with has a degree and theirs probably still dont! ๐ Mildred September 24, 2010 I have worked for Walmart since June 30, 2007. Last year I received papers to file the lawsuit for lost rest breaks and meals. I filled the forms in and mailed it in the early part of September 2009. Acouple of weeks ago some current and former employees got checks, but I didn’t. I don’t know why I didn’t get anything. I moved the end of July but I have changed my address at the store and have a forward on my mail with the post office. I need to know what happened and why I didn’t get anything. Dan September 24, 2010 I worked at the 1st Wal-Mart store in the state of Florida, Quincy, from October 1982- 1989. I was gone for approximately 5 years, they needed someone that would be a good night-time CSM (as I had been a store-clerk, CSM, Cash-Office, Support Manager) during this period of time. So I went back and talked with the manager, she hired me on the sport. I not understand there is OR was an ourstanding lawsuit for non-breaks / non-lunches, as being the Customer Service Manager, I was told I had to make sure each and everyone of the cashiers got their breaks & lunches, and management would see that I received mine (HA!)….Maybe, 2-3 times in the period of time I worked for them from 1982- 1989 did I get a break or lunch, BUT I Sure Had To Make Sure everyone ELSE did! Who’s the company, if I’m asking the right place, that handled this class action suit, I understand 2 others I had worked while there, THEY received letters in reference to this, I never did. I’d like to know more about this. Kevin September 24, 2010 I have installed some sheetrock 3 years ago or so. The building smells and I dont know why. How do I identify the bad sheet and how do I get rid of it, if it is the identified product. I hav 4 sheet not installed. BRANDI September 23, 2010 Do any one know if GA will be rec’ving anything? Christina September 23, 2010 I call on Sep. 22.2010 She told no check has been send out she say it be the first of week in November. I call 1-800-677-5163 and she don’t how much the checks will be. Montell September 22, 2010 I was included in the lawsuit but I recently moved and want to make sure that the law dept. that is handleing this case has my new address….who would I get intouch with to make sure they get my new info…. Debra September 21, 2010 Walmart is the worst place I have ever worked. Everything that all these people are saying are true. How could so many people that saying the same thing, be wrong? Theyre not! Walmart is famous for treating people lilke dirt, and getting away with it, because they know people need their jobs. patti September 17, 2010 has anyone from wv recieved any thing?is there a 800no.that i can call?i filled my form out and mailed it in aug2009.there were several people from ohio that i know recieved theirs in july2010.i havent saw anything about wv. helen o September 15, 2010 I started working for Sam’s club in 2006 and I am still there(nothing to write home about) just 15hrs a week. I got the form and every associate got the form also. to my surprise I was the only one and my daughter that filled the form out. We got checks in the mail August 9, 2010 and nobody else. This is just to show how intimidated people are working for walmart/sams club. these are people that were denied breaks and treated badly, were pressued and threatened. Then came time for themm to get some restitution and they weree still afraid. I got 675 and my daughter got $625. Some tried to find out if they can still do it, I beleive they were told that the deadline hasn passed. Well watchout, there are stil two more pending, so if you receive mail DONT THROW IT OUT. many believed that just because they are stll working for walmart/sams club they cannot fill the form. That is a lie from satan. I am still workinbg for them. i will soon leave though. PAUL September 14, 2010 I have never worked for walmart but I believe all these things that everyone has claimed. The reason why they happen is that they do have a UNION. Join the union and put a end to it. buhdakitty September 14, 2010 I have worked for walmart for nine years. I have worked in just about every department. When I was a CSM I got my lunch just as I was about to locked out each day. My breaks were nada since I was always by myself. I was told to suck it up and be a team player. I stepped down and was treated a bit better. I had to go on FMLA for medical reasons. I thought that it would save my job but it was the worst thing to do. I was only gone for a month and a half. I have never used any of my sick time. Each paycheck they shorted me and kept telling me that they would fix it next paycheck. So far I am still short. To make matters worse they cut me from 40 hours to 15, I don’t know what to do. Other than try to find another job quick. Walmart does not care about anything but the bottom line. mal September 13, 2010 Alabama number for information is 1-800-677-5163 Nicole September 12, 2010 I filled out the paper on line and recently moved. Mine was for the state of Texas, does anyone know who to contact in Texas about the change of address so I can collect my check or does anyone know when people from Texas will receive their checks? Thanks Good Luck all!!!! shirley September 9, 2010 I called the 800 number and they said they should start mailing out checks for multiple states in about 60 days. Im in texas which is included. Mary September 9, 2010 Check this out. I worked for Wal-Mart for several years. March 11, 2007, I was working as a night stocker. I worked as a floater at night to fill in for department associates that had the night off. I was working in toys that night and had to put some child wagons up on a high shelf. My super told me to get a male associate to help me, so I did. The guy went up to the top of the roll around ladder that we used, carrying one of the wagons. They weigh 65lbs. He went to swing it up on the shelf and ended up droping it down, hitting me in the head. I end up with no job because of permanent injuries. Can never work again. Got treated like dirt, no one ever even called to see if I was ok or anything else. Here now, almost 4 years later, they want to give me $11,000.00 as a settlement for my pocket and maybe $50,000.00 in a Medicare set aside bank acount. I had 9 more years that I could have worked. Without a raise for those years, I am loosing $190,000.00. Thats just an estimate. Wal-Mart is something else right? I am a Christian, so I can’t say what the devil wants me to say about Wal-Mart BETTY September 9, 2010 I STARTED WORKING FOR WAL-MART IN 1987 AND LEFT THE COMPANY IN 2008. I HAVE BEEN THROUGH SO MUCH WITH THE COMPANY. FROM BEING LOCKED IN THE STORE OVERNIGHT TO UNLOADING THE TRUCKS AT NIGHT AND PULLING PALLETS OF MERCHANDISE TO THE LOAD AND SPOTTING THE MERCHANDISE AND THEN PUTTING UP THE MERCHANDISE ALL IN AN 8-9HRS SHIFT . THEN YOU STILL NOT DOING GOOD ENOUGH FOR THE COMPANY SO SAY THE MANAGERS. THERE HAVE BEEN TIMES WHEN WE HAD TO COUNT OUR BOXES AT NIGHT FOR THEM TO KNOW JUST HOW MUCH MERCHANDISE WE WERE PUTTING UP. AND WORKING IN THE FREEZER AND COOLER IS ANOTHER THING. NOT SUPPLIED WITH THE RIGHT CLOTHING TO PROTECT YOUR BODY. JUST A COAT THAT EVERYONE WEARS AND NEVER WASHED OR REPLACED.I COULD GO ON AND ON. mal September 9, 2010 The deadline to file and fill out papers was sept 2009, its to late to be apart of the settlement , according to my papers, I hope alabama will receive a check. Jamie September 8, 2010 i just checked the walmart settlement website they dismissed all appeals and it said checks should be mailed with in the next 60 days its about time squeak September 8, 2010 I wonder if we will ever receive money that is due to us in mass. The person that appealed didn’t like the settlement and wants more, this could go on for a while. we are part of a MDL ( ?) it seems that we are divided by regions. Hope this helps. mal September 2, 2010 I worked in Alabama and according to the 800 number , only Florida workers will get some money, but I wish they would had, said that at first, because I had my hopes up , for a check.
