$79 Billion in Class Action Settlements Paid by Corporations in 2025 Report

Class action settlements reached an all-time high in 2025, showcasing the growing financial and legal exposure companies face amid expanding litigation over consumer safety, data privacy, antitrust and emerging technologies.

A class action lawsuit allows one or more named plaintiffs to pursue claims on behalf of a larger group of individuals who were allegedly harmed in a similar way by the same defendant or course of conduct. By consolidating related claims into a single proceeding, class actions can provide an efficient mechanism for resolving disputes involving widespread harm, such as defective products, consumer fraud, or wage and hour violations, particularly where individual claims may be too small or costly to litigate separately.

According to a Forbes report published on January 6, more than 1,700 class action lawsuits were resolved in 2025 for a combined total of approximately $79 billion, nearly doubling the amount paid in settlements the year before.

The report suggests the surge is driven both by an increase in case filings and by the expanding scope of damages alleged, as plaintiffs’ attorneys challenge corporate practices across a range of industries.

Antitrust, Product Liability Settlement Totals

Antitrust litigation accounted for the largest share of settlement dollars in 2025, with payouts totaling nearly $46 billion, a sharp increase from the prior year. Product liability cases followed with roughly $17.9 billion in settlements, reflecting continued litigation over defective drugs, medical devices and consumer products.

Other major settlement categories included securities fraud, government enforcement actions and consumer fraud claims. The report also identified newer areas of exposure, including lawsuits tied to generative artificial intelligence, cryptocurrency and algorithm-driven decision-making, which are expected to grow in coming years.

Data breach and privacy lawsuits were highlighted as one of the fastest-expanding categories of class action litigation, with Forbes reporting that nearly 1,900 new privacy-related class actions were filed in 2025 alone, representing a dramatic increase over recent years.

Corporate Litigation Risks

Beyond the monetary impact, the report emphasizes that class action lawsuits increasingly pose reputational risks for companies, often exposing internal decision-making, emails and corporate policies to public scrutiny. Legal experts cited in the analysis warned that even settlements without admissions of wrongdoing can permanently affect how companies are perceived by consumers and investors.

The report also noted that shifts in federal enforcement priorities have played a role in the rise of private litigation, with plaintiffs’ lawyers stepping in to fill perceived regulatory gaps, particularly in employment, discrimination and consumer protection cases.

For consumers and plaintiffs, the findings highlight how class action litigation continues to serve as a key mechanism for addressing widespread harms and holding corporations accountable when alleged misconduct affects large groups of people.
