Ford Focus, Fusion Class Action Lawsuit Filed Over Power Steering Issues July 9, 2014 Irvin Jackson Add Your Comments A class action lawsuit has been filed against Ford Motor Company, alleging that the power steering system in some Ford Fusion and Ford Focus vehicles is defective and could increase the risk of drivers getting into auto accidents. The complaint (PDF) was filed late last month in the U.S. District Court for the Northern District of California by several plaintiffs, including William Philips, Phillip Clay Cecil, Robert Halsey, Temple Halsey, Performance Fire Protection, LLC and Jason Wilkinson. The lawsuit seeks class action status to represent anyone who purchased a 2010 through 2014 Ford Fusion or the 2012 through 2014 model year Ford Focus. According to allegations raised in the lawsuit, all of the Ford cars targeted by the class action claim use the Electronic Power Assisted Steering (EPAS) system, instead of traditional hydraulic-assisted power steering pumps. The EPAS system uses a steering control motor, electronic control unit, torque sensor and steering wheel position sensor to help the driver navigate. Learn More SEE IF YOU QUALIFY FOR COMPENSATION “The EPAS system, however, suffers from systemic defects,” the lawsuit claims. “The multitude of defective elements in the EPAS system renders the system prone to sudden and premature failure during ordinary and foreseeable driving situations.” Plaintiffs claim that the system seeps conforming coating onto the ribbon cable, causing loss of connections, the ribbon cable pins are misaligned, causing loss of connections and breakage of critical wiring, the contact plate can corrode, and there are defects in the system’s sensors and gear assembly. The lawsuit indicates that the Ford steering problems result in significantly increased effort needed to control the vehicle, and can cause drivers to get into an accident. Ford is allegedly aware of hundreds of complaints, according to the lawsuit, but has failed to act appropriately to ensure consumer safety. The complaint accuses the company of intentionally concealing the problem. None of the plaintiffs claim to have been in an accident caused by the steering system. The lawsuit points out that not only has Ford received complaints, but so has the National Highway Traffic Safety Administration (NHTSA). The lawsuit claims that the agency has received about 450 complaints of sudden failure of power steering loss regarding the affected vehicles. A number of those resulted in crashes and injuries. The claim accuses Ford of violating consumer protection laws, fraudulent concealment, unfair competition, false advertising, breach of warranty, negligent misrepresentation, negligence, unjust enrichment and fraud. JoAnn March 6, 2016 I have a 2010 FordFusion my advance tracking and power steering went out 2xs the first time I went off the road and called my friend who pulled me out the 2nd time I was coming home from work. Ford fixed my car both times because I told them it was a recall on it. When I tried to get paper the other day of the repairs they wouldn’t give me any and said that I couldn’t get paper work because they had to check on warranty on my car. Technician also told me my car wasn’t included on recall it is2011 and up. So now I’m nervous that they are going to send me a big bill and that this problem will pop up again and I might not be so lucky. I have a 2012 Ford Focus with transmission and steering issues. The last time I had it serviced (oil change ect.) at my local Ford dealer (Longmont Ford in Longmont, Colorado) they said nothing was wrong with the transmission and it steered fine. It shutters when I start off and now I can’t drive it at all because the steering went out completely. They tell me that there is recalls about both transmission and steering issues on the Fusion and other Ford models but not the Focus. Why not the Focus????? Same electric assist power steering! max February 9, 2016 I have a ford fusion 2013 my power steering went out on me while I was driving ford company wants $1300 for the part $500 to install no one is caring the part because of the law suit please help !how do I get help? Rory February 9, 2016 My mother owns a 2010 Ford Fusion se. First car she has ever bought without financing. Within a year of owning the car the gas tank had to be rebuilt, the there was an issue with the head gasket which were both covered by fords recall and warranty service. Then at 60,000 miles the power steering assist went out. Never hit anything, but when taken to the dealership was told that I must have hit a curb and that this is around the mileage that this part usually goes out. ford has been little to no help on the situation and trying to get her info off the internet is frustrating to say the least. If there is a lawsuit or petition that can be signed I would like to be a part. Thank you. Antonio February 8, 2016 I currently own a 2010 Ford Fusion and am also having issues with the Power steering locking. I am able to turn the wheel, but a 10 minute is a serious workout. Ford sent a letter addressing the gas tank issue but not the power steering, why are they avoiding the problem? Cathy February 7, 2016 I started my 2010 Ford Fusion yesterday morning and the Power Steering Assist Fault light came on. The power steering was locked. I switched it off and back on and it was working then. I’m scared it will go out when I’m riding down the road. What should I do? KAYLA February 5, 2016 I’ve had this happen to me twice with my 2010 ford fusion in the past 2 week and is extremely dangerous. I was going down a busy highway with my 3 year old and 9 month old and power steering went out I could not turn my wheel at all almost wrecked had people blowing horns at me and this is absolutely not acceptable and completely rediculous that there is a recall on the 2011 ford fusion but not the 2010 ford fusion FORD IS LUCKY BECAUSE IF I WOULD’VE WRECKED WITH MY KIDS I WOULD’VE PAID FOR THE BIGGEST LAWYER KNOWN IN THE UNITED STATES, AND DROPPED THE BIGGEST LAWSUIT ON FORD NEVER IN MY LIFE WILL I OWN ANOTHER FORD FIX THE DANG PROBLEM… ONE PISSED MOMMA Brad February 4, 2016 I have a 2010 Fusion SE and my power steering went out. My wife and kids were in the car at the time. This needs to be addressed. How can I join the lawsuit? Debra February 4, 2016 I have a 2010 Ford Fusion. Today is the second time that my power steering has locked up on me. The first time it happened, luckily I was on a straight road while I was driving and I was able to control it. I have never received any information about this power steering glitch, but last week I did receive a recall in the mail concerning the gas tank. It said that the gas tank could crack and catch on fire, and as soon as they have the part in, they will contact me to bring my car in for service. I am missing work today because my power steering has locked up yet again. How do I join this class action lawsuit? Judy February 2, 2016 Last year 2014, I purchased a 2014 Ford Focus. I started having problems with it hesitating, spurting, sluggish when I pull away from lights or turn corners. I finally took it back to Ford last year thinking it just needed a tune up, but was told there was a recall on it, however, I never received a letter for the recall. They reprogramed the shifting. It was quiet for awhile, but started again. I returned with the car, but nothing was really done the second time, because, no ‘codes’ showed during their testing of the car. I was told to drive it another 750 miles and to bring it back if needed. Well, it’s been over 750 miles and is doing it again. The thing that bothers me is that it wasn’t revealed to me when purchased that this car had a ‘dual’ transmission and that is why it acts this way, so I was told. I drive my grandchildren in this car and I’m concerned for all our safety. I don’t want this car anymore. I want Ford to get me into another car without raising my payment. I’m getting ready to send letters to all involved. Help!! Jeremy February 2, 2016 Having the same problem with my 2010 ford fusion Melanie February 2, 2016 I have a 2010 Ford Fusion . Valarie January 28, 2016 I have a 2015 focus love the car but the steering system failed due to a pice of road debris I was told it would cost about $3000 to replace the subframe. How can ford continue to use unreliable technology after failure in previous years. I have a note but no car to drive. My steering went out at 9000 miles. How can I join the lawsuit? Arnecia January 26, 2016 I have a 2010 Ford fusion. The power steering assist fault is giving me trouble. Also the advancetrac warning has appeared. Ford says it will cost 2000+ to repair. They also claim that the part can only be purchased through the Ford dealership. How do I get involved in the lawsuit? Danielle January 21, 2016 I also have a 2010 ford fusion and for the 3rd time the power steer pump has locked on me it cost me $150 plus tow to rest the computer the initial price for the part is $1800 which I half to pay out of pocket the dealer has been no help. Heavenly January 20, 2016 I have a 2010 ford fusion se, I was on a main highway when my power steering went out, my advance trac and power steering light came on, It was very hard to turn, I’m not getting answers I need, I called the ford dealership, they told around 1800 dollars to repair. I have pictures of the car I will post them when I can find out how to post pictures. How can I join the class action lawsuit ? Michelle January 15, 2016 My service advance trac and service power steering has decided to show up on my 2010 Ford Fusion SEL for the second time. I had AAA to service the first time and they reset it and it was $100 for that plus had it towed. Left me stranded with a locked steering wheel twice now. So, had it towed to the dealership this time and was told that the repair will cost me a whopping $1800 and that the part not found as a recall and the part alone is $1300. This is rediculous especially to read that this same thing is happening to lots of other people. I fortunately was able to make it to work both times but once I turned off the car and then re-started to attempt to drive, the steering wheel was locked up. This needs to be a recall. Strange how 2011 models were recalled but not 2010. Jessica January 15, 2016 I have a 2010 Ford Fusion, the power steering isnt operational anymore and I have no one to look at the car for week. The Ford dealership hasn’t returned my calls for assistance. How can I join the lawsuit? Jerome January 12, 2016 My son purchased a 2010 in July of 2015, his just went out . Lucky he wasn’t in an accident. How do I join the class action law suit? Molly January 11, 2016 I have a 2010 Ford Fusion and suddenly the power steering went out. Luckily, we did not wreck. How do I join the class action law suit? Steve January 11, 2016 I have a 2012 Ford Focus that the EPAS went out on and just like all the other stories it was not covered under the extended warranty the estimated cost was $2500 to fix. My question would be do they install the same thing when they fix it? Then it really isn’t a fix it’s a accident waiting to happen. Due to everything I have read about the 2012 Ford Focus I have opted to give it back to the bank. I am not comfortable driving this vehicle and worry about my safety and they safety of my family. I bought this car for my daughter and could not live with myself if a gift I bought for her got her killed. This matter is no joke. Then you the service rep and their I don’t care attitude regarding this issue and it just adds to the frustration you are already experiencing. Carlos January 9, 2016 I couldn’t stop my 2011 ford fusion and lost control of my car and hit a rock now the body shop that repair the car say it’s not safe to drive this car because the power steering can lock any time. ..that my be that’s was the reason my car don’t stop and I lost control of the car Tim January 8, 2016 I get an advancetrac system warning and I briefly lose power and steering ability on my 2015 F150 and I only have a bit over 4k miles on it. Carolyn January 8, 2016 I had my Ford Fusion 2010 stuck in Park. It was towed twice. It has been at the dealer for 6 weeks because they say there is no computer part for it. They now say it is back ordered with no promised date when it will come in ??? Sign me up for this class action suit…k We were also told this was a known problem and that they have to redesign the computer…. Loni January 8, 2016 I also would like to be apart of the class action law suit. In 2013 paid 1,700 to get the power steering fixed. Where I would be just driving and loose power steering.
