November 5, 2025 Irvin Jackson Add Your Comments The U.S. District Judge presiding over all federal hernia mesh lawsuits being pursued against Medtronic and its Covidien subsidiary has canceled the first in a series of planned “bellwether” trials, which were expected to help gauge how juries may respond to certain evidence and testimony that may be repeated throughout thousands of claims alleging the medical implants were defectively designed. The canceled trial was set to begin on February 17, 2026, and was chosen since it raised similar allegations to those presented in more than 2,200 similar product liability lawsuits brought by individuals who experienced complications with certain polypropylene hernia mesh products sold in recent years, including Covidien Parietex, Covidien Symbotex and others. Since June 2022, all Covidien hernia mesh lawsuits brought throughout the federal court system have been consolidated in the District of Massachusetts under U.S. District Judge Patti B. Saris as part of a Covidien hernia mesh MDL, or multidistrict litigation, where they are undergoing coordinated discovery and pretrial proceedings. Each complaint raises nearly identical claims that the companies’ polypropylene hernia mesh products were defectively designed, causing painful complications that often require additional surgery to remove or replace the failed implant. Similar litigation has plagued other manufacturers of hernia mesh products for years, resulting in tens of thousands of lawsuits over Bard hernia mesh products, Ethicon’s Physiomesh and Atrium C-Qur mesh products, each of which resulted in global settlement agreements. Learn More SEE IF YOU QUALIFY FOR COMPENSATION As part of the pretrial process, Judge Saris has directed the parties to select a small group of representative cases to serve as bellwether trials. These early trials are expected to be closely watched and provide insight into the strength of each side’s arguments, as well as help guide future Covidien hernia mesh settlement negotiations. The court previously chose a claim filed by Larry and Tammy Patterson of Alabama to serve as the first Covidien hernia mesh bellwether trial, involving allegations that a defective Symbotex mesh implant caused a bowel obstruction, requiring surgical removal in 2020. However, in a text-only entry on the court docket posted on October 28, Judge Saris canceled the Patterson trial “until further notice.” This included a pretrial conference originally slated for February 4 ahead of the trial start. The judge did not provide an explanation for the cancelation, which followed a status conference held the same day. Instead, the entry indicates that a summary judgment hearing will be held on the same day the trial was slated to begin. In addition, Judge Saris also indicated that Daubert hearings scheduled for November 13 will be pushed back about four weeks, rescheduled to begin on December 18. The announcement comes as the parties continue to meet for Covidien mesh settlement negotiations, in hopes of reaching an agreement to resolve large numbers of claims. Negotiations were originally expected to be completed by late September 2025, but Judge Saris previously agreed to extend the deadlines for the settlement talks until January 14, 2026. If the bellwether trials move forward, their outcomes will not be binding on other plaintiffs. However, they will be closely watched to help the parties see how jurors may respond to a typical claim. Following the bellwether trials, if no Covidien lawsuit settlement has been reached, Judge Saris could begin remanding large numbers of cases back to their originating courts for individual trial dates.
