Roblox Sexual Abuse Lawsuits Can Be Directly Filed in MDL Using Pseudonyms

With the number of Roblox sexual abuse lawsuits now exceeding 100, and a steady flow of additional claims expected in the coming months and years, the U.S. District Judge recently appointed to preside over the consolidated federal litigation has issued a direct filing order, eliminating the need for the cases to be transferred from various different districts into the multidistrict litigation (MDL).

The judge is also allowing survivors of sexual abuse tied to Roblox to bring their claims against the popular gaming platform under pseudonyms, to protect their identities and avoid further harm.

Each of the lawsuits raises similar allegations against Roblox, a gaming platform first launched in 2006, which now garners an estimated 111 million players per day. The video game construction set allows users to build their own games, create customized avatars, explore player-created games and worlds, make in-game purchases and communicate with each other.

Although Roblox has been marketed as a safe platform for children, an increasing number of young adults and parents are now bringing lawsuits alleging that the platform lacked critical safety features, which caused children to be targeted and groomed by sexual predators, often pretending to be children themselves. Many children playing the game were manipulated into exchanging sexually explicit photos and videos, and sometimes involved in incidents of rape and kidnappings.

Following increasing pressure, the platform began rolling out a new Roblox age verification system last year, which relies heavily on facial scans to identify which users are adults and which are not. The company says that future updates will also require minors to have parental consent to chat, limiting communication between them and adults. However, a growing number of families are now coming forward to present claims against Roblox, indicating that the efforts came too late to protect their children.

Late last year, the U.S. Judicial Panel on Multidistrict Litigation determined that all Roblox sexual abuse lawsuits filed throughout the federal court system will be consolidated in the Northern District of California, as part of an MDL. Given similar questions of fact and law raised in the complaints, U.S. District Judge Richard Seeborg has been appointed to oversee coordinated discovery and pretrial proceedings.

On February 10, Judge Seeborg issued a case management order (PDF) approving direct filing of all Roblox child sex abuse claims in the Northern District of California, regardless of where the plaintiff lives. The order limits direct filing to single-plaintiff cases only.

The move is being made to increase efficiency in the filing and processing of new cases, which will all be filed electronically, instead of waiting for the cases to be transferred from their originating districts. However, as part of the Roblox sexual abuse MDL, each case remains an individual lawsuit and would be returned to the originating district court if no settlement or other resolution is reached before the pretrial proceedings conclude.

Additionally, Judge Seeborg agreed to an order (PDF) proposed by the parties, allowing plaintiffs to use pseudonyms instead of their real names, due to the sensitivity of the content of the lawsuits. These pseudonyms will consist of the plaintiffsโ€™ initials and a number. The order also allows their parents or legal guardians to file anonymously as well.

It is expected that Judge Seeborg will eventually direct the parties to choose several representative claims for a bellwether process, where case-specific discovery will be conducted and claims will be prepared for early trials. These test cases will help the parties gauge how juries may respond to evidence and testimony likely to be repeated throughout Roblox sex abuse litigation.

Despite those trials being non-binding for any other claims, they would be closely watched to see how juries judge the parties arguments. This could result in a basis for a Roblox sexual abuse settlement agreement.

If no global settlement is reached following the MDL proceedings, Judge Seeborg may later remand each individual complaint back to its originating venue for individual trial dates.
