Indivior To Pay $300M To Settle Suboxone Opioid Marketing Claims By DOJ, States April 29, 2021 Irvin Jackson Add Your Comments The makers of the opioid addiction treatment Suboxone have agreed to pay $300 million to settle allegations raised by several states, claiming Indivior falsely advertised the drug as safer and less prone to abuse than it actually is. Last year, Indivior reached a $600 million settlement with the federal government over charges of aggressive and deceptive marketing. On Tuesday, the manufacturer agreed to pay another $300 million in a state settlement (PDF), which will be split among all 50 states and the District of Columbia, according to a press release by California Attorney General Rob Bonta. The states’ attorneys general alleged that Indivior improperly used Medicaid funds, due to its advertising techniques, which deceived regulators and the medical community about safety the profile and Suboxone risks. Lawsuits are being pursued by users of Suboxone who experienced tooth loss, broken teeth or required dental extractions. Settlement benefits may be available. Learn More SEE IF YOU QUALIFY FOR COMPENSATION Suboxone (buprenorphine and naloxone) is a drug approved to treat recovering opioid addicts; helping them avoid withdrawal symptoms while they undergo therapy to help them break their addiction. However, the federal government and the states say Indivior, formerly known as Reckitt Benckiser Group, PLC, promoted the sale of Suboxone to doctors they knew lacked legitimate medical use for the drug, and prescribed it to patients without other accompanying treatment, like counseling. One of the active ingredients, buprenorphine, is a powerful opioid in its own right, making Suboxone a vector of abuse by opioid addicts. The allegations also indicate Indivior falsely claimed the Suboxone Sublingual Film, the typical way the drug is distributed, was more resistant to abuse and less likely to be accidentally exposed to children than the drug in its pill form. The film is placed under the tongue to dissolve, which critics say is just as easy, if not easier, to abuse and be accidentally ingested by children. The states and federal government also claim the manufacturer submitted a fraudulent petition to the FDA in September 2012, which claimed the Suboxone Tablet had to be discontinued due to safety concerns. However, they say that, in actuality, the manufacturer sought to control supply and improperly inflate Suboxone pricing, including what state Medicaid programs paid for it. “Doctors and the public should be able to trust that what a company says their product can do is the truth, especially when the company claims it can be used during the treatment of something as serious as opioid addiction,” Attorney General Bonta said in the press release. “Today’s settlement should send a message that false marketing and improper use of California’s Medicaid dollars will have costly consequences.” In 2019, Reckitt Benckiser Pharmaceuticals reached a $700 million settlement with the federal government and states over Suboxone Medicaid fraud allegations. Indivior spun off from the company shortly afterwards and reached the $600 million agreement with the Justice Department last year. In a statement released in response to Attorney General Bonta’s press release, Indivior notes that the $300 million is coming from that $600 million agreement it made with the Justice Department last year, and does not constitute a commitment to pay additional money to resolve that settlement. “The various state settlement agreements being announced this week are administrative in nature, and simply formalize the individual state settlements which were previously agreed to in principle as part of the July 2020 criminal and civil resolution between Indivior and the states (and the federal government). As such, there is no new financial or legal obligation that has arisen,” the company’s statement reads. “The Company was pleased to put those issues behind it in 2020 and remains focused on realizing its patient-focused Vision and fulfilling its compliance commitments.” The company said it will have no further comments on the settlement agreement. My teeth repair has cost me about everything I own! 30k!!!! Please send me info on this law suit! Joe March 1, 2022 I received a check for this lawsuit back in 2021. However why hasn’t anything been done about the loss of teeth due to this film. Before I started the so-called new treatment for opiate addiction, I never had any problems with my teeth. Now I need implants. I have lost 12 rear teeth I feel is a result of these films. It’s not just Indivior but also the generics. When I started back 9+ years ago I was told this would be the safest way to help my prescribed opiate addiction. However no one talked about the withdrawals. I did the taper but once I was told it was time to do the jump, I found myself in such a state of deep depression. I was admitted voluntarily into an addiction center. They put me back on the stuff so now it’s still 8mg 3 times per day. Where does this end? Eric February 25, 2022 I was prescribed Suboxone for 5+ years. I need in! What about Methadone? I’ve been prescribed that for the last 6 years also. Kevin February 24, 2022 I’ve had such trouble trying to kick subutex and suboxone its worse then H, and to top that off half of my teeth are decaying from the gum line, of course medicaid says it’s cause I’m a addict and won’t do anything except take my teeth out and I’m only 30 years old, you know how embarrassing that is Micah February 21, 2022 I’ve been prescribed Suboxone and Subutex since 2007 so I could be part of this will you please get in contact with me and let me know thank you Tanya February 20, 2022 I would like to be included in this suit I’ve been on Suboxone and Subutex for over 10 years now. I have not gone out in years because I can’t afford to get my teeth fixed that were ruined fr this medication. Also I have tried a few times to come off of it but the withdrawal is ridiculous. I was not told either of these things would happen to me. Please contact me for any future class action suits. Joleen February 4, 2022 First of all I would like to say that I have been sober from alcohol since 1993 in 2000 because of a blood disease is when my chronic pain begin. I had no choice I thought but to take pain medication I was in too much pain to get around it got to where it was so bad I eventually had to get a disability. I would take the pain medication for two or three years and then I would take myself off of that and I would take Suboxone for two or three years and I did this back-and-forth for the last 15 years I’ve had to have the stomach lighting removed and my esophagus mighty removed about every six months because of the acid reflex that I have because of the mixture of all this medication. Neither one of the doctors who were prescribed via the Suboxone recommended or suggested any type of drug rehab all they did was have because it once months later Sharon’s paid the bill I spent 10 minutes got my refills and Alcindor I would and that was it. It got to be where I didn’t know what was worse the pain medication or the Suboxone . The withdrawals on both of them are absolutely tremendous I have never tried heroin so I can’t compare but I’ve been told it compares to that. For the last two years me and my ex-husband have fought for our life‘s trying to get off of Suboxone I believe the Suboxone is more addictive than the narcotic oxycodone I have never been through so much misery in my life I have now got high blood pressure off the hook high cholesterol and try to stay off of medication except no narcotic medication’s some pain you just have to live with , as long as possible! I quit fentanyl on my own cold turkey then got into a program after day 8 for counseling where they initially tried to push Suboxone on me but I refused I stayed cleaned for over a year had a 2 week relapse and immediately went back for counseling where I found out I was pregnant and was told over and over if I didn’t take Suboxone my child would miscarry. Not to mention the fact there’s studies showing where this crap is suppressing our personality leaving us “flat”.. not to mention my “addiction” sprouted from an orthopedic surgeon who didn’t want to do surgery on a 22 year old girl with a broken hip because “her ass was too nice to leave a scar on” so instead he pumped me full of 120 Percocet every 2 weeks for months Kristen December 5, 2021 how do we get our part of the settlement? they were extremely misleading about the long term effects as well as the fact it causes severe addiction to the medication causing withdraws if without. which is crazy to me considering it was prescribed to help combat addiction to opiates. She stayed in ICU on life support for couple weeks with little progress with narcam. The dr. Then resigned from office and went elsewhere. She suffered multiple sclerosis for22 years. She was paralyzed from her waist down. She had a urostomy, colostomy, had one kidney that was only functioning 15%. She passed away 0n 10-16-21. Working construction, I had to take the pain killers longer than expected. I became addicted, and suffered withdrawal symptoms which interfered with my working and general life situations. After several years of self medicating with street drugs and alcohol, my Mom paid for me to go to a Rehab Doctor. I was put on Suboxone, told that after regulating the dose over the first few weeks, I would stay on the Suboxone for a year, and then would be weaned down for a few weeks. I was told that I would then be free of addiction. It was not suggested or recommended that I get counseling while I was in Rehab. Unfortunately, I was fed a bunch of CRAP. I have been trying to get off Suboxone for about 5 years now, and no matter what I try, it can’t be done. When I take the Suboxone, I don’t experience the withdrawal symptoms, and I only take a small dose now. But over the past few years, my teeth have rotted out and I’m having to get dentures. My general health has gone downhill, and I haven’t been able to keep a long-term job. My life has been ruined by Suboxone. Let me be perfectly clear about this: THE FEDERAL GOVERNMENT HAS ALLOWED AND PROMOTED this “FIX” for the addiction problem by PUSHING ON THE AMERICAN PEOPLE THE ABSOLUTELY MOST ADDICTIVE DRUG IN HISTORY, without any way of a cure for this new addiction to Suboxone. In other words, once on it, you’re on it for life. The financial cost, and the physical problems that come with it, ARE NOT WORTH IT. AVOID AT ALL COST!!! Compensation should be paid to anyone harmed by this drug. I also had no notice of the previous lawsuit, but there should be another one open to anyone who is prescribed Suboxone. Robin July 23, 2021 I am not a drug addict. I was given Suboxone in a hospital to stop taking pain mediation for an injury. That was 10 years ago, costing about $20,000. I have tried many times to come off this drug, only to experience excruciating withdrawal that is so painful, it makes me suicidal. I have suffered major tooth loss and have spent $10,000 in dental treatment. I cannot concentrate enough to read. I have lost my motivation. My quality of life is very poor. Suboxone should be illegal. Tina July 23, 2021 Ive been on 12mg of suboxone 2 times a day for over 6 years.Im still being prescribed this medication can someone please reach out to me and let me know what i should do Ru8 July 22, 2021 man they telling my life story your skin crawls cannot sleep cannot function whole body hurts .Doctor need to be responsible take your money pharmacy should pay and the maker the suboxone man i been off for 5 yrs im still suffering addicted mess up no amount of money could make up what these people done to us but god knows. They knew what they was doing to us all we wanted to be better and functions.they took our lives away for money bad bad people.Next life they will pay They sent me a check for 2600 dollars out 10 yrs on sub.bad bad people .got by not away cause god will answer gain the whole world but yet lose your soul like our body cried out n ot havind it they soul will burn. Ernestina July 19, 2021 Ive been on soboxone for last 10 years. i really liked it alot at the beginning until allergic reactions started immediately. Doctors advised me it wasnt the soboxone. I take a pill for every allergic reaction my body gets. Sweating profusely, adema in my lower extremities mostly. My 3rd soboxone doctor around the 7 year, same facility referred me to get an echocardiogram the results on that was enlarged heart, leaky valve, high blood pressure in my lungs along with fluid. And still soboxone doctor states its not the soboxone. I know my body. I suffer so much with soboxone and im addicted to it. I have to wear compression stalkings thigh high. I take diuretics to alleviate the adema. Ive lost leg muscle around my calves down when my body is out of soboxone my lower extremities are skelitical looking, I look sick. Now around the 10th year with same symptoms im starting to faint alot. Ive had alot of bruises, fat lips, burns, i almost broke my ankles a few times from suddenly loosing oxygen to my brain. Im currently doing testing with wich ever doctor will stay. i have had quite a few doctors that get burnt out on prescribing it i guess. Im doing a sleep study any day now. I know im allergic to soboxone, nalexone, film buprenorphine is what they have me on recently, and I still have same symptoms. My husband is very worried for me. No doctor has ever did a plan, or suggestion to taper me off. Im also addicted to soboxone or buprenorphine…I’ve been on 8mg ×2.5 films for last 11 years. I hope an attorney reviews my case, Im afraid. Im slowly dieing. Katie July 19, 2021 I’velost everything due to this drug I’m addicted to it I’ve never been addicted to anything in my life the doctor put me on it because I was on purpose with my last pregnancy I had two back-to-back I wasn’t even a whole month pregnant and he put me on Suboxone I’ve been trying to get off of it for a year I’ve lost two homes two cars everything I have no energy I’m absolutely miserable I was never worn that this medicine would almost kill me and now when I try to go to the doctors I’m kicked out of the office and I’m refused medication medication I cannot live properly without this drug it’s very addictive and I was not warned I lay in bed sick everyday without this medicine it’s made me think about using other drugs and I’ve never thought like that please help Joel July 18, 2021 Holly, I also put in a claim. I knew about the settlement well before the deadline as I heard about it on SiriusXM. If not for that I would not have heard about it But when they were sending out checks I never got mine, so I called and spoke to several people who were put in charge of answer any questions about a claim or payment. When I gave them my information they said the address I gave them didn’t match the one on file but my name and my EMAIL address was the same. So I was livid because they would not help me out. I wasn’t eligible because I couldn’t come up with the correct address. I know I filed the claim correctly with the correct address. Just seems very sketchy that my address was different but my email was the same. So now I am waiting and hoping I get a payment because I said I would wait until the initial payments were sent out and if there is anything left I will get a check. Still waiting so not sure how long I have to wait or even if I’m getting a check. I’ve been on Suboxone since 2005. I’ve paid out of pocket several times plus with insurance. I’ve been to 4 detox facilities using methadone to ween me of the Suboxone but I’m sent home after a week and once the methadone wore off I was still in withdrawal so bad I couldn’t stand it and Everytime I got right back on Suboxone. Wish someone could listen to us and help us get off Suboxone. It’s worse than heroine. I used a lot of dope and I could always get off it with minimal withdrawal but the Suboxone withdrawal is just in my bones, my emotions, my attitude, my energy, it just drains me and it lasts Soo long I can’t kick it. I have to work, and there is no way I could ever work without it. Just please hear us and get us something to get us off Suboxone please Jamie July 8, 2021 I have been on Suboxone for almost 7 years.. It did save me from being on all the pain medicine an nerve medicine I was on .. But in reality the doctor didn’t tell me this would be so much harder to get off of an so expensive the doctor visit plus the medicine..Just now found out about the lawsuit wish I would of known sooner I have a lot of money over the years in this medicine.. Holly July 4, 2021 Has anyone that missed the deadline and was added to the waitlist been contacted about a second distribution? My husband filled out a form for both myself and him and only he got the payment. I was told mine was never submitted so I had to be added to the waitlist. Such bull crap!! Suzanne July 3, 2021 I was first introduced to Suboxone back in 2008 and unfortunately am still taking it today! Only because the effects of this medication in your bloodstream and deep in your bones feels impossible to ever stop taking it all together! I’ve never once paid for Suboxone with any health coverage of any kind and I don’t even want to think of the total cost monetarily. Because the physical aspects of it are worse. It’s just a real terrible thing to realize the Cash out of pocket I’ve spent over all these years for something that’s keeping me addicted and also to you younger ppl out there . You Will Start to lose all your teeth before their time. I truly believe this because of having to leave it in your mouth to dissolve it definitely effects your teeth over time. I just wanted help from addiction and I’ve learned I’ve only traded one for another . David June 30, 2021 There’s got to be 10s of thousands if not millions of people who missed out and never even heard of this lawsuit Like myself who’s been on this medication since 2004 to present day 2021. I paid thousands of dollars out of pocket when I had no insurance!! Brandy June 22, 2021 My husband & I have been on Suboxone over 10 years.first we was prescribed tins of medications called pain Killers.suddenly they shut down all doctors giving it. So here we was left without any of it and began to use street drugs to fill in the loss of the medication we didn’t get anymore. We was non-functional in society and family life due to this.and getting on street drugs made it much worse. We have both overdosed and died and been revived. I have died more times than anyone I know. So started Suboxone and at first it seemed like the answer. But it was just another replacement for the pills the doctor’s gave and the street drugs that came afterwards. My 23 yr old daughter has now Bagan getting Suboxone. This Al me has caused serious family problems. I started opening up to my therapist/councilor who worked with the doctor giving us the Suboxone. And then of her how my disabled husband was having to eat more than usual due to his body being broken down weak due to Suboxone use and my memory and health has gotten the same. We now find ourselves not able to function without taking them. He can not work without them I can not get up without them. But I have been off them over 5 years ago and for several months and I felt better than ever in my whole life off them. People came in and forced me back on them. Said it was crazy to just stop them. But now almost 6 yes later I feel worse than ever before. And have been contacting everyone everywhere to get help to get off them. But No one cared and just wanted to keep us on them. I’ve tried so hard but no luck. I just want a normal life without them like before. I’ve been in hospitals but the just added more. I’ve been kept from contacting attorneys.over 2 yrs ago I contacted several but they worked for the hospital giving them/law enforcement. And I would call for help but they just told me to file complaints at the prosecutors office and I did. But since I’ve been tormented on a serious level and my whole life controlled they took over my cell phone and every decision I’ve made. Just because I asked for help. Before this I was vibrant and full of life, but since this all began I can’t go inside a store or do anything good or fun and they have made me family treat me so terrible. I’m all alone in this world looking for justice. And have had no luck due to a bunch of con artists during the coronavirus. They have scandled do much of my life and time. And my family. I’m 46 and not getting any younger. It’s time people who deserve it to take some responsibility and pay for the problems they have caused. Randy June 17, 2021 My son has been on suboxone since age 21 and he lis 34 now and can’t get off it. if he tries he gets really sick. I didn’t know about these lawsuits.
