Mirena IUD Migration Problems Result in Lawsuit Against Bayer

A product liability lawsuit has been filed against Bayer by a woman who experienced problems with her Mirena IUD, alleging that the implanted birth control device migrated into her abdominal wall.

The complaint was filed in New Jersey Superior Court on July 26, by a 24 year-old woman who indicates that her Mirena intrauterine device (IUD) had to be surgically removed after it moved away from her uterus to another part of her body.

Not only did this require additional surgery to remove, but it also meant that she inaccurately thought she was protected against pregnancy by the device when she was not.

Introduced by Bayer in 2000, use of Mirena birth control has grown in recent years, amid heavy promotion of the device as a hassle-free form of birth control.  However, a number of users have reported experiencing severe and painful Mirena IUD problems, including perforation or puncturing of the uterus, or migration of the device to other parts of the body if a perforation is not detected.  This has caused some women to suffer intestinal perforations, obstructions, absecesses, adhesions as well as a risk of infection.

The Mirena IUD is a birth control device that is implanted in the uterus for up to five years. It is supposed to be easily removable and is promoted as a way to free woman from worrying about birth control. Placement is designed to prevent pregnancy by keeping the sperm from the egg, and the device also releases levonorgestrel, a progestin designed to keep a woman’s ovaries from releasing eggs for fertilization.

After receiving the Mirena IUD in March 2009, the plaintiff in this case indicates that her health care providers were unable to find the device in her uterus when they went to remove it in September 2010. A CT scan located the birth control device in her left abdominal wall, which resulted in the need for an operative laparoscopy in October 2010 to have it removed.

According to allegations raised in the Mirena lawsuit, as well as other similar claims filed against Bayer, the device maker has failed to adequately warn women and the medical community about the risk that the IUD may spontaneously migrate to other parts of the body. Complaints also allege that the manufacturer made unsubstantiated claims about the device’s safety and effectiveness.
