Zofran Lawsuits Filed Over Birth Defects Following Use for Morning Sickness

A mother from Massachusetts and a mother from Minnesota have both filed product liability lawsuits against GlaxoSmithKline over the past week, raising nearly identical allegations that side effects of Zofran used during their pregnancy caused their children to be born with severe birth defects. 

Zofran (ondansetron) is a prescription drug approved for prevention of nausea and vomiting among chemotherapy patients and following surgery. However, it is widely prescribed “off-label” to pregnant women for treatment of morning sickness, even though the FDA has not established that is a safe or effective use.

According to allegations raised in the two separate Zofran birth defect lawsuits, GlaxoSmithKline has illegally marketed the their drug as a morning sickness treatment and failed to warn women or the medical community about the findings of studies that have linked use of the medication during the first trimester to a potential risk of congenital malformations, such as cleft palate, cleft lip and heart defects.

One complaint (PDF) was filed by Cheri Flynn in the U.S. District Court for the Eastern District of Pennsylvania on February 12, indicating that both of her two minor children, born in 2004 and 2006, suffered congenital heart defects after exposure to Zofran while she was pregnant.

In another complaint (PDF) filed in the U.S. District Court for the District of Massachusetts on February 16, Tomesha LeClair indicates that her daughter suffered heart defects and a number of other congenital malformations following use of Zofran during the first trimester of pregnancy. LeClair’s child has required at least thirteen different surgeries and continues to suffer from developmental delays and other health problems, according to the lawsuit.

Both cases indicate that GlaxoSmithKline has known about the potential link between Zofran and birth defects for some time. According to the complaints, GlaxoSmithKline performed studies in the mid 1980s which showed that Zofran crossed the placenta in rats and rabbits during pregnancy.

Despite the company’s own studies showing toxicity, premature births, intrauterine fetal deaths and incomplete bone growth, the company declared that the tests showed no harm to the fetuses, the lawsuits claim.

The company began receiving reports of birth defects by 2000, including 32 reports involving pregnant women who used the drug and later gave birth to children with congenital heart disease, dysmorphism, stillbirth, kidney defects, bone and skeleton problems and other birth defects.

“In many instances, GSK received multiple reports in the same month, the same week and even the same day,” the lawsuits note. “For example, on or about September 13, 2000, GSK received three separate reports involving Zofran use and adverse events. For two of those incidents, the impact on the baby was so severe that the baby died.”

Despite the potential pregnancy risks with Zofran, GlaxoSmithKline has allegedly promoted the use of their drug among pregnant women to capitalize on the large market created by women suffering from morning sickness, which is a common complication associated with the first trimester of pregnancy.

Flynn and McClair point out in their complaints that the drug maker agreed to pay $3 billion to settle federal criminal and civil charges in 2012, stemming from the illegal marketing and promotion of some drugs, including promotion of Zofran for pregnant women.

Over the coming months and years, as more families learn about the link between the anti-nausea drug and birth defects, it is expected that additional Zofran lawsuits will be filed on behalf of children throughout the United States.

    I had 4 children and the last pregnancy I couldn't work without Zofran due to how sick I was. The Dr assured me it was safe. My baby was born with a sacral dimple, hole in his heart and developmental delays. My other 3 children are completely healthy and I never took Zofran with them. Too many coincidences to not believe Zofran had something to do with this.     I took zofran for about 3 months my daughter is speech delayed and has learning disabilities and is having trouble in first grade I believe it’s from the zofran I was also not told it wasn’t safe I’ve now been doing test to see if she is Autistic and it’s really hard to deal with I just want my baby to learn regularly without issues

Not only has my son, but myself and his father have gone through tests. We combed threw my entire environment and diet during pregnancy and found nothing. I was so cautious I even avoided the "typical food allergy" foods because idk maybe my baby would develop an allergy while developing. So you see...to all the mom's passing judgment on the mothers claiming it is all for $$$, I ask you to step back and reflect on what if it didn't work out so perfectly for you. And you went to the end of the world looking for answers and the ONLY SINGLE factor you and other medical professionals can think of being what contributed to your baby's life long disabilities was ZOFRAN. Now think about allll the care I will need because my baby is getting big and strong and at 10 already out power's me so I need to hire help, and then there are medical expenses your baby will need, therapies, medicine and the list continues..... so no it isn't about the money to go buy myself a fancy house or car. It is to provide some financial support for my kid. This COMPANY is about $ and greed and that was proven in court. So why should I turn to the government and take hard working American people's like you and me tax money when clearly this monster of a company with no guilt or remorse prompted this drug for morning sickness with no research saying it was safe. It was my first pregnancy and I was admitted from the severity of my morning sickness. I was so naive to think I didn't have to second guess what medication I was given as a pregnant woman.     I used it while pregnant with my son in 2006-2007. I was so sick I had a pic line in my arm so I could INJECT Zofran every 8 Hrs if needed. I was so so sick and constantly in the hospital. As soon as my 2nd trimester started I was off the zofran. My son was tongue tied , needed surgery at 1 month old for pyloric stenosis and delayed speech. He didnt speak till he was 5 yrs old.     4 pregnancies 3 healthy the youngest 3 yearsold. Was born with folded feet developmental delay speech disorder diagnosed with Autism. I took Zofran from 6 weeks to about 12/16 weeks daily to be able to work.

We just saw our 20th doctor about this issue and they suspect he might have a cleft larynx that was missed by previous ENTs. We will find out this summer.     I took both zofran and phernergan for 2 out of 3 of my pregnancies. 1st trimesters to 3rd. Extreme hypermesis gravium. Both are autistic and adhd. There is no genetic link to either one of my sons being autistic no family history on either side. Now my 3rd child who is 2 and 1/2 years old now. I Took no phernergan and only when I went to the hospital for dehydration I believe in the 2nd trimester [Show More]I took both zofran and phernergan for 2 out of 3 of my pregnancies. 1st trimesters to 3rd. Out of the 20 I only took 19 of the pills the remainder of my pregnancy. My 2 year old still showed slight delay with speech but IS NOT autistic has been in a study since I had him to monitor him for autism. He also had one kidney opening slightly larger and had to have an ultrasound after birth and go to a specialist. However it corrected itself thank goodness. All of my children are boys...I think there has to be a link with these pills and people who do not have a genetic link for autism.. and the ones I'm noticing that say they took the pills and their child did not develop autism have female children....I think there is definitely a link with these nausea medications and autism. And it needs to be studied. They stopped prescribing phernergan to children who came in with stomach viruses in the er...so if it's no good for children it's obviously a no no for fetuses.

If you don't have a healthy child and still think people that are concerned about this drug are being greedy maybe your not thinking about it from the right aspect. I also know that he is going to need to be cared for his whole life and that he will need a lot of special equipment etc. If my wife had been informed about the possible side effects of Zofran I honestly know that she would not have wanted to take the drug and would have requested other options to the issue. She was not throwing up and definitely would not have put our son's health nor her own at risk by not taking Zofran. Humanity has been degraded to a very sad level and I feel sad for all the individuals on this forum that have made comments that lack compassion and understanding. You need some serious emotional intelligence training.

He was in the NICU, and is now doing well at three years old, but it was a very scary time as new parents! My next pregnancy ended in miscarriage at only 7-8 weeks, and my third pregnancy of my daughter had heart issues that were watched throughout pregnancy, and had many preterm labor issues with her, but thankfully she was okay after birth! She is now nearing a year and a half. I was never informed about the possibility of heart problems by taking Zofran, and never saw it in the information sheets given with it. I really needed the medication, but it wasn't worth the risks of my children's health. I will not use it again, but have never filed a lawsuit!

My ob assured me several times that it was perfectly safe to take while pregnant.Besides only weighing 5 lbs 10 oz at birth ( I was only able to gain 10 lbs while pregnant) he appeared perfectly healthy.. By the time he was 4 months old we noticed he wasn't using his left [Show More]I am a mother of 4. By the time he was 4 months old we noticed he wasn't using his left arm or hand at all. He started physical therapy and has made small improvements with his arm. Now he is 9 months old and is having to start occupational therapy because he still can't use his hand. Also we just found out today that the optic nerve in his left eye is under developed. Now on top of those 2 therapists he also has to see a pediatric optometrist and has an appointment with a pediatric neurologist in August to determine if the problems he is having is caused by something neurological. He may have more specialists to come because he also has several developmental delays. We are just now starting to realize all the problems our "perfectly healthy" baby boy is having. I am seriously beginning to wonder if zofran is responsible for all of this because none of my other kids had any of these problems and there is no family history of it at all. It really breaks my heart that I was so misled about this medication and now my son may have to suffer for it for the rest of his life. If that's the case and if it was caused by zofran then they should have to pay for it as well.

    I found out i pregnant in oct.2014. I was six weeks baby heart rate was strong same day i was started on zofran a week later wasbin hosptial cause of bleeding 2 weeks after that on nov.9th miscarried it was my first it destroyed me i had a break down where i cut myself and wanted to die i am now on meds and seeking help now,but im still emotional wreck. I believe zofran did it...please help me

    I took zofran with my youngest daughter who now suffers from autism and seizures. I under stand that they are not sure what causes this but I can't help but wonder if the zofran had something to do with it. I come from a large family with lots of children and my little one is the only one that has anything like this.

    I have four. i took zofran big time with my first three basicly daily. My oldest son had asd vsd closed and my oldest daughter has pku and autism and my youngest son has hlhs i to wounder if its due to zofran.

    I understand this is a touchy subject and I see a lot of comments ending with "it makes me wonder " it makes me ponder" I also seen some thinking this is about greed. But I feel this can be seen as a tornado for example- maybe one child gets affected , but your second child doesn't. Just like a tornado can hit your neighbors house but not yours.     I always questioned if the Zofran i took was safe for my unborn child. I was told yes. My other option was to be hooked to an IV for a dehydration, so I took it. My son was born with ADHD, Autism, speech delays, fine and gross motor problems, among other things. I had severe morning sickness,so when I went to the doctor they prescribe zofran for that.I went back to the doctor office and they did a ultrasound that came back with some issues to mmake a long story short. At week 23 I went into emergency labor, 31 hours of being hooked on an IV for hydration as Zofran causes dehydration (which I did not know until i conducted later research) which can lead to premature birth, poked at every hour, and not knowing what may happen to my unborn child. I didn't get to touch him. 5 seconds to peek at him and he was rushed to the NICU to be put on life support. He had an open PDA, ROP, chronic lung disease, a bleed of the brain, and many other things. He is now 16 1/2 months with a fairly weak muscular structure and physical development delays, misshapen pupils, neurological development delays, chronic lung disease, pulmonary hypertension, has a feeding tube because he doesn't know how to eat and so many other things. Zofran barely helped and I took so much of it. I ate healthy and exercised regularly. I only took Zofran and my prenatal vitamins also prescribed by my doctor. When I asked my doctor what could I done wrong, her response was "Things like this just happens sometimes. Would you like to resume the life support?" Words could not express the feeling I had when she said that. My question is this how come they pay $3M to sell illegally, why shouldn't they have to also pay the mothers like me who are struggling with our babies. I'm a single mom raising my first my only special needs child. It would be easier to take care of him if he weren't special needs. Because there is a possibility that this drug caused all this why shouldn't they pay for mental and emotional hurt. The extra financial burdens and uninsured medical expenses. Why can't we as struggling mothers get a percent of that $3M that made it okay to give this possibly dangerous drug?

    I took Zofran my entire pregnancy in 2011 the whole nine months it made me feel better but my baby was born with congenital ear deformities If I was warned my child could be born with a birth defect while using Zofran I woulda tuffed it out and didn't take it.

All medications have the potential to cause side effects, even vitamins, and even if the medication doesn't list a particular side effect it could still occur. You, as a consumer, have to decide what you want to take and decide if you want to risk side effects, and stop blaming drug companies. If it weren't for pharma we wouldn't exist as a population. We love pharma when we need antibiotics or pain meds, but if something goes wrong we're ready to collect. Billions of dollars and countless hours are put into developing lifesaving and therapeutic medications for people, that many people do well on, but some people will have adverse events. It's a fact. If you can't live with that, don't swallow the pill. I wouldn't be so quick to make assumptions and jump on the "Zofran is terrible" bandwagon Zofran truly helped me and other women I know and without causing any birth defects. I think it is safe, and if a birth defect occurs who is to say it wasn't totally random or due to some other factor.

    My questions is this...Our son was born with no amniotic fluid and my fiance was taking zofran the whole time she was pregnant. Could the use of the zofran caused this to happen? I've seen where it said it would make you dehydrated; will that also apply to the child?

    Took Zofran like crazy during my last pregnancy, AND had one of the most handsome and healthiest babies ever. If I ever ended up pregnant and needing it again I wouldn't hesitate to take it,

    I took Zofran during my last pregnancy and my daughter presented at birth with Metopic Craniosynostosis with moderate/severe Trigonacephaly. She also has several midline deformities like an ear pit, class IV lip tie and a sacral dimple. She also suffered from Torticollis causing slight plagiocephaly.

    Zofran was the ONLY thing I could take. I had to take 8 out of 9 months of both of my pregnancies. If I didn't take zofran, I was constantly in the hospital for dehydration, and had to be dehydrated via IV. For me, the benefits outweighed the risks. Both of my kids are completely healthy. Obviously, if you can suffer the morning sickness without medication, it's best.

    I took Zofran during my first and second trimesters and I was taking it often because my sickness was so awful. It was the ONLY thing that worked for me. My daughter was born very healthy and she is still healthy. I'm thankful after reading this. But I'm going to stop taking it during my current pregnancy, I don't want to risk it now!

    I have had 4 boys. Each time I took zofran during pregnancy. I have 2 healthy boys and 1 that had multiple birth defects. He passed an hr after birth. My last one was born with a congenital diaphragmatic hernia. He also has a heart defect. Do I think zofran had anything to do with it? Maybe if I had had 4 unhealthy children.     My child has no muscle function I'm her kidneys and is awaiting surgery now. I was given zofran during my pregnancy with her. Makes me wonder...

    Each of my children were born with with Ad/HD. Autism. Vision problems. Delayed development. I took zofran with all 6 of my pregnancies. And two miscarriages!!! Now this makes me ponder!!!

Also, I worked as a labor and delivery nurse for over 7 years until may 2013 and administered Zofran well over 400 times.
