Indivior To Pay $300M To Settle Suboxone Opioid Marketing Claims By DOJ, States

The makers of the opioid addiction treatment Suboxone have agreed to pay $300 million to settle allegations raised by several states, claiming Indivior falsely advertised the drug as safer and less prone to abuse than it actually is.

Last year, Indivior reached a $600 million settlement with the federal government over charges of aggressive and deceptive marketing. On Tuesday, the manufacturer agreed to pay another $300 million in a state settlement (PDF), which will be split among all 50 states and the District of Columbia, according to a press release by California Attorney General Rob Bonta.

The states’ attorneys general alleged that Indivior improperly used Medicaid funds, due to its advertising techniques, which deceived regulators and the medical community about safety the profile and Suboxone risks.

Suboxone (buprenorphine and naloxone) is a drug approved to treat recovering opioid addicts; helping them avoid withdrawal symptoms while they undergo therapy to help them break their addiction. However, the federal government and the states say Indivior, formerly known as Reckitt Benckiser Group, PLC, promoted the sale of Suboxone to doctors they knew lacked legitimate medical use for the drug, and prescribed it to patients without other accompanying treatment, like counseling.

One of the active ingredients, buprenorphine, is a powerful opioid in its own right, making Suboxone a vector of abuse by opioid addicts.

The allegations also indicate Indivior falsely claimed the Suboxone Sublingual Film, the typical way the drug is distributed, was more resistant to abuse and less likely to be accidentally exposed to children than the drug in its pill form. The film is placed under the tongue to dissolve, which critics say is just as easy, if not easier, to abuse and be accidentally ingested by children.

The states and federal government also claim the manufacturer submitted a fraudulent petition to the FDA in September 2012, which claimed the Suboxone Tablet had to be discontinued due to safety concerns. However, they say that, in actuality, the manufacturer sought to control supply and improperly inflate Suboxone pricing, including what state Medicaid programs paid for it.

“Doctors and the public should be able to trust that what a company says their product can do is the truth, especially when the company claims it can be used during the treatment of something as serious as opioid addiction,” Attorney General Bonta said in the press release. “Today’s settlement should send a message that false marketing and improper use of California’s Medicaid dollars will have costly consequences.”

In 2019, Reckitt Benckiser Pharmaceuticals reached a $700 million settlement with the federal government and states over Suboxone Medicaid fraud allegations. Indivior spun off from the company shortly afterwards and reached the $600 million agreement with the Justice Department last year.

In a statement released in response to Attorney General Bonta’s press release, Indivior notes that the $300 million is coming from that $600 million agreement it made with the Justice Department last year, and does not constitute a commitment to pay additional money to resolve that settlement.

“The various state settlement agreements being announced this week are administrative in nature, and simply formalize the individual state settlements which were previously agreed to in principle as part of the July 2020 criminal and civil resolution between Indivior and the states (and the federal government). As such, there is no new financial or legal obligation that has arisen,” the company’s statement reads. “The Company was pleased to put those issues behind it in 2020 and remains focused on realizing its patient-focused Vision and fulfilling its compliance commitments.”

The company said it will have no further comments on the settlement agreement.

They first started with subs being for SHORT term detox. Then they pedaled it as long term bc big pharma knows the truth. The longer you are on them, the harder it is to get off them. Been on them for over seven years and it’s been hard to get off even at 2mg I’m on. Wish I never started them

Where to even start. I was lied to about my first born child and how he would react to the Suboxone after birth. He was in the hospital 28 days withdrawing. Good morning, hope all is well! I am reaching out to possibly bring (very much needed) awareness to the havoc this medication is causing to patients teeth, including myself. I’ve been in recovery since 2007 and have been prescribed Suboxone for the past 7 years, and now just learning of why my teeth started falling out, cracking, crumbling out of nowhere 3 years like and just like apples falling from a shaken tree. There were nothing wrong with my teeth until this, and my dental records will prove my truth. We as patients were never advised on this harsh and very unfortunate side effect. We have rights, too. I am currently a Substance Abuse Counselor Intern who is so close to sitting for the NJ CADC state exams, but was stopped dead in my tracks due to my teeth dropping like dead flies. This is not right, and I’m seeking some kind of restitution for NEVER being informed of the storm this medication has created in my mouth. Although I am so immensely grateful for this medication as it’s helped assist me on my journey, but how am I supposed to move forward and become the successful counselor I’ve worked so hard at becoming with MISSING teeth? I mean, c’mon.. let’s be REAL about this – No one is going to hire someone with missing front teeth, especially in this field. Like Claudia Merandi states – Your smile is YOUR business card, your smile is YOUR signature, and I haven’t been able to smile in 3 years. Can someone PLEASE advise if I possibly have any options? I had to travel to pa from Wv just to see a dr so that I can get off opiates. I had to pay cash for the dr as well as the medication and it was a struggle to find someone to fill it every time. The dr never told me that this medicine was addicting, never offered counseling or anything. I started on Suboxone and switched to subutex after I realized that it was cheaper, I stayed on this for years doing very well.

I think the people handling the Suboxone lawsuit should have gone about it totally different! They did not verify if claimants had legit prescriptions prescribed to them….so in other words, people that filed a claim that had NO PROOF they were prescribed this medication was able to receive the same amount as people who had legit prescriptions. In every other class action lawsuit, some state…you have to show proof you purchased an item & others state if you can provide proof, you will receive this amount & if you cannot, you will receive a much lower amount.. With the Suboxone lawsuit, you should have been required to provide legit dr’s or pharmacy name & number, so they could verify you were a legit patient. And if you could not provide that info, then you just don’t receive compensation.. PERIOD!!!!! How crazy is having to have a receipt for Godiva chocolate purchase to receive a higher amount. And For Suboxone, no proof whatsoever!!!! The people behind the Suboxone lawsuit must have been okay w/ awarding people that had never even purchased Suboxone….and the people who did, and overpaid for years have to split the awarded amount w/ non-legit claimants!! Unfortunately I lost all my teeth due to this prescription. Spent over 40,000 dollars and in result have to wear dentures. Asked doctor if any medication was to blame for the rapid tooth loss and was told had to be genetic . Never heard of the previous lawsuit anywhere .

Just found out about this lawsuit and I’m a little confused because FTC said they notified prescribers so they could notify the patient but that never happened. I talked to my doc and other doctors at my office and they were not notified by FTC. I’m pretty much toothless and the ones I have are on the way out. I’ve always taken good care of my teeth and it makes sense that the meds I put in my mouth daily is causing my problems.

I got a notice about the lawsuit online & signed up. I’d been prescribed at rehab two different stints & and I got a check for just under $400 last year. If it’s responsible for the tooth decay, that IS a completely different issue & we deserve compensation for that. I was never into meth but did it here and there, but my teeth are about half gone.

I think i should be eligible to file a claim being i was on suboxone for 13 years starting in 2004 but i never knew about the lawsuit and apparently missed the deadline.I suffered many years because of the drug and feel i should be compensated.

I have massive muscle skeletal issues, ra, degenerative tissue disorder.. and due to my addiction the only pain agent I was able to take was suboxone*script was 3(a day)8 mg Films my teeth are rotted beyond belief I have holes and almost all of them of them on top of all the other crazy side effects that the drs don’t even know about!! Why send me these postcard telling me that I will be getting money back from being on Suboxone for the past 14 years but it’s too late now that’s fucked up … who got all this money then ?? Start a taking suboxone in 2015 And I’m still prescribed them to this day but I was unaware of any lawsuit And did not read such notice on any blog anywhere I received a notice today in the mail for the 1st time for the 1st time March 2022 but it says the deadline was deadline was December 2020 that makes absolutely no sense at all I did not exclude myself from this and I do believe that The system fails us by not sending this notice way earlier how convenient to send a notice 2 years past the deadline to follow claim I think it’s unfair and I want to be able to File a claim

I have been on Suboxone for 7 years. I have just learned of the class action lasuit. I too have suffered from excessive tooth decay with nearly every tooth having been repaired and gum erosion. Working with my dentist over the years we have tried many things including “oil pulling” and special toothpastes and mouthwashes along with brushing 3 times a day but the decay continues. I never heard of the lawsuit and would like to join.

I want to know why everyone on Suboxone was not made aware of this lawsuit I have been on Suboxone since 2014 lost my teeth in 2016 and have had dentures since you know how bad it feels to have dentures at 32 years old it’s down right embarrassing and if the Suboxone is responsible for it then they need to pay for all of the people that suffer from these side effects to get new implants because dentures suck they fall out shit gets stuck under then you gotta go take them out redo everything and you not suppose to use dentures adhesive more then 1 time in 24 hours.

I feel for all of you. I have been on Suboxone & Subutex 2009-2011, & 2013-currently. I will never not be on some type of MAT. During the original lawsuit, my Dr’s office did not put the flyer up (to notify us of pending class action) until after the date to sign up had passed. Most of the prescribing physicians are unaware that: Even after a taper down to 1mg you will have the most painful & longest detox (lasting 1-6mo). It’s worst than Methadone. After detoxing from suboxone once, you will never detox from it again. Good luck if you need legitimate surgeries, or are in some type of accident, most MD’s have no idea how to blow buprenorphine off your receptors. Nor do they care to. Your teeth will rot, & fall out no matter how obsessive you are in regards to your dental hygiene. I currently need atleast $10K worth of work done to fix my teeth. Had I known 10 years ago that my teeth would fall out at the age of 34, (or that it was a side effect)I would have made a more informed decision in regards to MAT. The problem I see is most prescribers know little about the medication, & the pharmaceutical companies should be doing everything in their power to combat the horrible side effects.

Please contact me. I’ve been on Suboxson since 2013, 2019-2022. With-in the last year of being on Suboxone I’ve lost 3 bottom teeth and the fourth is about to go. Not to mention they taste horribly I’m not surprised at all they cause your teeth to fall out the medicine sits on your inner lip up against your teeth.

I would like to know the steps for getting in on this . I have been prescribed for 4 years. All of my teeth are bad now. Not to mention this was supposed to help with addiction. In my opinion being prescribed 4 8mg a day has destroyed me. Not to mention I’m still stuck on it.. I’m sick of this medication. Better for you.. safer .. I think not…
