Tylenol Lawsuits Over Autism, ADHD Risk From Prenatal Exposure Warrant Centralization: Motion Acetaminophen exposure during pregnancy increased the risk of children developing ADHD and autism, lawsuits filed over past few weeks allege June 17, 2022 Irvin Jackson Add Your Comments A growing number of Tylenol lawsuits are now being filed against CVS, Walgreens and manufacturers of acetaminophen-based drugs, alleging that use of the painkiller during pregnancy caused children to develop autism spectrum disorder (ASD) or attention deficit hyperactivity disorder (ADHD). In response to the growing litigation, a group of plaintiffs filed a motion (PDF) with the U.S. Judicial Panel on Multidistrict Litigation (JPML) on June 10, calling for complaints brought throughout the federal court system to be centralized before one judge for coordinated discovery and pretrial proceedings. There are currently at least 19 Tylenol autism and ADHD lawsuit filed in U.S. District Courts nationwide, each raising similar allegations that pharmacies and drug manufacturers failed to warn about the risks associated with prenatal exposure to acetaminophen: the active ingredient in Tylenol. Each of the complaints raise similar questions of fact and law, indicating that information about the link between Tylenol and autism, ADHD and other neurodevelopmental disorders has been withheld from consumers, who unknowingly exposed their unborn children to long-term risks and challenges that could have been avoided. Plaintiffs indicate in the motion that each of the 19 filed Tylenol lawsuits have been brought in just a matter of a few weeks, suggesting many more ADHD and autism claims are likely to be filed in the coming weeks and months as lawyer investigate additional claims. They argue that consolidation will eliminate duplicative discovery and contradictory judges’ orders, as well as serve the convenience of the parties, the court and witnesses. “Transfer and centralization are appropriate in this case given the substantial commonality of questions of fact and law,” the motion states. “The overlap of the factual allegations and legal theories in these actions is near total.” Tylenol ADHD, Autism Risks The lawsuits come in the wake of recent studies which have suggested the use of prenatal exposure to Tylenol increases the autism and ADHD risks. Tylenol Autism Lawsuit Does your child have Austism from Tylenol Exposure? Learn More SEE IF YOU QUALIFY FOR COMPENSATION Tylenol Autism Lawsuit Does your child have Austism from Tylenol Exposure? Learn More SEE IF YOU QUALIFY FOR COMPENSATION In October 2019, a study published in the medical journal JAMA Psychiatry found that children with the highest levels of acetaminophen metabolites in their blood at birth had the highest risk of the developmental disorders. According to additional research published in the European Journal of Epidemiology in June 2021, children exposed to Tylenol during pregnancy were 19% more likely to have autism spectrum disorders and 21% more likely to have ADHD symptoms compared to non-exposed children. Due to the potential acetaminophen pregnancy risks, researchers from Columbia University warned that doctors should re-evaluate the role of the pain medication for pregnant women in 2020, after finding that prenatal exposure may lead to impaired neurodevelopment in the fetus. 2023 Tylenol Autism and ADHD Lawsuit Update The U.S. Judicial Panel on Multidistrict Litigation (JPML) heard oral arguments over whether to centralize all acetaminophen autism and ADHD lawsuits on September 29, 2022, and rejected arguments by the drug manufacturers and retailers, who opposed the creation of a federal MDL (multidistrict litigation). In a transfer order issued on October 5, 2022, the MDL panel decided to centralize and consolidate all current and future Tylenol autism lawsuits and Tylenol ADHD lawsuits before Senior U.S. District Judge Denise Cote in the Southern District of New York, for coordinated discovery and pretrial proceedings. While the Tylenol lawsuits over ADHD and autism will be managed in a manner similar to a class action lawsuit, each claim will remain an individual action and if Tylenol settlements are not reached following discovery and a series of early bellwether trials, each individual case may later be remanded back to the U.S. District Court where it was originally filed for a separate trial date. Throughout 2023, it is expected that thousands of families will step forward to file a lawsuit against Tylenol or other acetaminophen manufacturers. I absolutely took Tylenol (the only thing I was told was safe), as I had had a bad cold with a fever over Christmas at 30weeks pregnant that year. How do I join a lawsuit?? Janet June 29, 2022 My son was born in 1986 he was diagnosed with ADHD when he was about 8yrs old. Took meds for years. I took Tylenol while pregnant with him. He still has and deals with the effects of ADHD now. Can I learn how to start a lawsuit? Sharon June 28, 2022 Both my children have ADHD and have been on medication for years. It is a struggle and I did take Tylenol during pregnancy. Richard June 28, 2022 My mom took Tylenol while pregnant with me and I came out with severe ADHD. Honestly it has ruined me. I gor special treatment in school with tests, I could NEVER focus, absolutely no desire to sit still, I was always distracting those around me, I cussed at my teachers and peers, I would impulsively hit others. I was on so many medications from preschool till high school I couldn’t even name all I took. Some made me too tired, some made me agressive, some made me neutral then eventually wore off and I had to try something new. That could not have been good for a developing child’s Brain. By the time high school hit I became an alcoholic by age 16 and got kicked out of school, I then graduated to trying almost every drug I could get my hands on. Anything to suppress the thoughts the doubts, the false hope, once I tried opiates… It was all over from there. Ive been in and out of the judicial system and I’m spiraling out of control more and more daily… Wow I can’t believe I just typed all of this. Sorry but someone needs to know dlfor once whats going on with me. Imagine… If my mom hadn’t taken Tylenol extra strength… Well I may have become an important person on this planet… Julie June 27, 2022 Both of my youngest kids who are 18 and 22 have been diagnosed with autism when they were younger! I took lots of Tylenol because I was told it was the saved even though they knew this before they were born! 2000 and 2003! Adam June 26, 2022 My mother took Tylenol while pregnant with me and I was diagnosed with adhd as a child all through school I always had issues with it couldn’t focus sit still couldn’t complete any task really without getting sidetracked. I feel like my life would have been much better if my mother hadn’t taken Tylenol while pregnant with me. Elizabeth June 24, 2022 How do I file for the Tylenol lawsuit? Holly June 24, 2022 My son was born in 1999. When he was not even 3 he was diagnosed with ADHD. I took Tylenol for back pain. I can’t remember the Dr due to it being 20 yrs ago but I DO KNOW the facility who diagnosed him. Michelle June 24, 2022 My son is 15 and has mild to moderate AU and ADD also my 10 year old son has ADHD I took tylenol with both. No family history. How do I get information? Stephanie June 24, 2022 I have 3 children who were all diagnosed with ADHD before or by age 7 and born in 2005, 2012 and 2014. All are currently on ADHD medications which are stimulants and Anphetamines which pose as additional risks for addiction, etc. They have not been promoted to the following grade on one or more occasions due to learning defecits, secondary to their diagnoses and all see a therapist for psychological and emotional distress. They have also had cardiac issues and Tachycardia diagnoses stemming from medications. I was prescribed Hydrocodne with Tylenol during at least one of those pregnancies by my OBGYN and given a specific list to use Tylenol as a “safe” pain reliever to use in addition to the prescription while pregnant from early gestation, on with all 3 of them. This has been a serious physical, emotional and physiological challenge for all of us and our family as a whole. Compensation for the last 16 years of this would be a blessing in the lives of my children and myself. Please contact me at your soonest convenience. Jessica June 24, 2022 I have 8 yr old twins who have both been diagnosed with ASD and ADHD. They are on numerous medications and need substantial support. I was prescribed several Tylenol based pain killers during my pregnancy. Could this be the cause of their difficulties. Adriana June 23, 2022 Especially with my 4th and last child I took Tylenol because my spine is fused along with my s.i. joint. I also suffer from CPS Chronic pain syndrome & Fibromyalgia. Tylenol was definitely some I needed to take for the pain. My son is now 13 and was diagnosed with ADHD years ago. He also has an IEP in school do to his Adhd. He has an extremely hard time in school. None of my other child have adhd nor do any family members. This is making sense now. Nisha June 23, 2022 My daughter is 6 soon to be 7 and I had to take her to be tested last year for Autism/ADHD and she was low on the autism spectrum but diagnosed with ADHD. I used Tylenol for light headaches when I was pregnant with her. Could someone please help me? Samantha June 22, 2022 My daughter is 6 and on the spectrum. I took Tylenol while I was pregnant with her and I’m not sure if that’s the cause. Neither I nor any other family members have autism. There’s no history. Not sure if this could have been the cause. Does anyone know how to go about finding out?
